Section 13: (1) The District Level Committee on disability shall consist of the following members, namely

(i) Deputy Commissioner. Chairperson

(ii) Civil Surgeon/Chief Medical Officer. Member

(iii) A psychiatrist from the District Hospital. Member

(iv) A Public Prosecutor of the district to be nominated by the Chairperson.

(v) An eminent person of an organization registered under section 50 of the Act in the district as nominated by the Chairperson.

(vi) A person with disability as defined in clause (s) of section 2 of the Act as nominated by the Chairperson.

(2) The District Level Committee shall perform the following functions, namely:-

(i) to implement all activities mandated by the State Government for the benefit of the persons with disabilities under the Act;

(ii) to spread awareness regarding the provisions of the Act;

(iii) to effectively implement the Unique Identity for disabled persons in the shortest possible time;

(iv) to direct the Executive Engineer, Public Works Department or the Superintending Engineer as the case may be to make an assessment of all Government buildings in order to make these accessible to disabled persons.

The District Level Committee shall monitor implementation of Accessible India Campaign in the district regularly and ensure that the work is done in a time-bound manner. It shall also issue directions to all owners of private buildings like hotels, restaurants, banquet halls, community halls, corporate offices, shops and malls, etc. to convert the buildings into disabled-friendly buildings at the owners expense;

(v) to ensure that every effort is made for accommodating destitute disabled people of any category in a safe home where their needs are taken care of and provisions for a healthy lifestyle and skill development are provided.

The committee shall be assisted financially by the State Government in the accomplishment of these goals;

(vi) to monitor grievances received from disabled persons regarding social security benefits or on any other issue and try to resolve these by coordinating with the Social Justice and Empowerment Department;

(vii) to receive complaints from disabled employees of the State Government and coordinate with departments concerned for their resolution;

(viii) to receive demands of any registered organizations that represent disabled persons and resolve the same if it is within its competency or forward the same to the State Government;

(ix) to ensure that there is a clear and harmonized data base of persons with disabilities receiving benefits under various Government schemes of different departments;

(x) to make efforts to garner help under Corporate Social Responsibility (CSR) for pilot projects for the care and benefit of disabled persons. It shall also represent the case of disabled persons through such pilot projects to the State Government and ask for financial support from the department;

(xi) any other functions that may be assigned by the State Government.

Salaries, allowances and other conditions of service of State Commissioner.

14. (1) The tenure of State Commissioner shall be for a period of three years. The State Government may however, curtail the period of tenure at any time in public interest.

(2) The State Commissioner shall be paid a honorarium of (Fifty Thousand rupees) per mensem and shall avail of-

(i) Re-imbursement of actual rent not exceeding (Fifty Thousand rupees) per mensem for private accommodation;

(ii) telephone facility:- Telephone facility may be provided at the office as well as at residence alongwith one cell phone equivalent to entitlement of Grade- I officers of the State Government;

(iii) Daily Allowance:- The rate of daily allowance may be admissible to the State Commissioner as per entitlement of Grade-I officers;

Note.— Daily allowance is admissible for ten days in the calendar month;

(iv) Medical facilities:- The State Commissioner may be given medical facilities as admissible to the Government employees;

(v) Staff Car:- A staff car shall be placed at the disposal of the State Commissioner for official use at the headquarter and also for outside official journeys;

Note.— When journeys are undertaken to places outside the State and the staff car is not used, travelling allowance shall be payable for distance beyond the State limits. The rate of travelling allowance, when admissible shall be the same as applicable to Grade-I officers.

(vi) Staff:- Staff may be provided as per requirements assessed and approved by State Government.
