PART III HARYANA GOVERNMENT PUBLIC WORKS DEPARTMENT IRRIGATION BRANCH Notification (The 26th June, 1970) No. C.S.R. 84/ Const. Art.309/70 - In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules for regulating the recruitment and conditions of service of persons appointed, to the Haryana Service of Engineers, Class-II, Public Works Department (Irrigation Branch), namely :- RULES
1. Short title, commencement and application- (1) These Rules may be called the Haryana Service of Engineers Class-II, Public Works Department (Irrigation Branch) Rules, 1970.
(2) They shall come into force at once.
(3) They shall apply to every member of the Service.
Provided that where any of these rules varies to the disadvantage of any such member the conditions of service applicable to him immediately before the 1st day of November, 1966, the rules applicable to such member immediately before that date in respect of his conditions of service to the extent to which any of these rules is to his disadvantage shall, unless such variations is made in accordance with the provisions of sub-section (6) of section 32 of the Punjab Reorganization Act, 1966, continue to apply to him.
2. Definitions - In these rules unless the context otherwise requires,-
(1) "Appendix" means an appendix appealed to these rules;
(2) "Appointment to the service" includes an appointment made according to the terms and conditions of these rules to an officiating vacancy or an ex-cadre post;
Provided that an officer so appointed shall not be deemed to have become a member of the service as defined in clause (12);
(3) "Assistant Engineer" means an officer incharge of a Sub Division and includes an officer holding a post of equivalent responsibility in the Public Works Department, Irrigation Branch.
(4) "Cadre Post" means a permanent post in the service;
(5) "Chief Engineer" means a Chief Engineer of the Haryana Public Works Department, Irrigation Branch and includes a post declared by Government and a post of equivalent responsibility;
(6) "Class-I Service" means the Haryana Service of Engineers Class-I Public Works Department (Irrigation Branch) Public Works Department (Building and Roads Branch) and Public Works Department (Public Health Branch);
(7) "Commission" means the Haryana Public Service Commission;
(8) "Department" means the Irrigation Branch of the Public Works Department of the Haryana Government;
(9) "Direct Appointment" means an appointment by open competition but does not include;
(a) an appointment made by promotion; and
(b) an appointment by transfer of an officer already in service of a State Government or the Government of India;
Explanation- A member of the Haryana Public Works Department (Irrigation Branch) Overseers (Engineering) service or a member of the Irrigation Branch Draftsman and Tracers Service, who enters the service by open competitive 2 selection shall, for the purpose of these rules, be deemed, to have entered the Service by direct appointment.
(10) "ex-cadre post" means a temporary post of the same rank as a cadre post.
(11) "Government" means the Haryana Government in the administrative department.
(12) "Member of Service" means an officer appointed substantively to a cadre post, and includes;
(a) in the case of a direct appointment an officer on probation or an officer who, having successfully completed his probation, awaits appointment to a cadre post;
(b) in the case of an appointment by transfer, an officer, who is on probation or who having successfully, completed his probation awaits appointment to a cadre post;
Provided such officer does not have a lien on a substantive post in any Government Department.
Explanation- It is not necessary that a member of service shall at any given time be actually doing the work of a cadre post. He may be working in an ex-cadre post for reasons of administrative convenience. Conversely, an officer officiating against an ex-cadre post may in fact perform the duties of a cadre post.
(13) "Haryana Public Works Department (Irrigation Branch) Overseers (Engineering) Service" and "Draftsmen and Tracers Service" means "The Haryana Public Works Department (Irrigation Branch) Overseers Engineering State Service Class-III and" The Haryana Public Works Department Irrigation Branch, Draftsmen and Tracers State Service Class-III respectively;
(14) "recognized university" means-
(a) any university incorporated by law in India;
(b) in the case of Degrees or Diplomas obtained as a result of examination held before the 15th August, 1947, the Punjab Sind or Dacca University; and
(c) any other university which is declared by the Government to be a recognized university for the purposes of these rules.
(15) "Service" means the Haryana Service of Engineers Class-II Public Works Department (Irrigation Branch); and
(16) "Temporary Engineer" means an officer in the service of the Public Works Department, Irrigation Branch, whose appointment is non-pensionable and temporary within the meaning of the Civil Service Rules and who was appointed as such in the Irrigation Branch prior to the commencement of these rules.
3. Constitution of Service - The service shall be constituted at the commencement of these rules, or as soon thereafter as possible, in the manner laid down in Appendix 'E'.
4. Strength of Service - (1) The service shall comprise of such number of posts of Assistant Engineers as may be specified by Government from time to time.
(2) Without prejudice to the generality of the provision of sub rule (1), the strength of service shall be determined each year on the 1st day of January or as soon thereafter as may be practicable according to the provisions of Appendix "A". The strength so determined shall remain in force till it is revised.

(3) Notwithstanding anything contained in sub-rules (1) and (2) Government may appoint an officer to an ex-cadre post and included in the service in accordance with the provisions of these rules provided such post has been sanctioned.
5. Nationality and Domicile:- (1) No person shall be appointed to the Service unless he is;
(a) a citizen of India;
(b) a syvhect of Sikkim;
(c) a subject of Nepal;
(d) a subject of Bhutan;
(e) a Tibetan refugee who came over to India before the 1st January, 1962 with the intention of permanently settings in India; or
(f) a person of Indian origin who has migrated from Pakistan, Burma, Ceylon and East African countries of Kanya, Uganda and the United Republic of Tanzania (formerly Tangenyike and Zenzibar) with the intention of permanently settling in India;
Provided that a candidate belonging to categories (c), (d), (e) & (f) shall be a person in whose favour a certificate of eligibility has been given by the competent authority and if he belongs to category (f) the certificate of eligibility will be issued for a period of one year, after which a candidate will be retained in service subject to his having acquired Indian citizenship. Certificate of eligibility will not be necessary in the case of candidates belonging to any of the following categories :-
(i) Persons who migrated to India from Pakistan before the 19th day of July, 1948, and have ordinarily been residing in India since then.
(ii) Persons who migrated to India from Pakistan on or after the 19th day of July, 1948, and have got themselves registered as Citizens under Article 6 of the Constitution.
(iii) Non citizens in category (f) above also entered service under the Government of India, before the commencement of the Constitution, viz. 26th January, 1950, and who have continued in such service since then. Any such person who re-entered or may re-enter such service with break after the 26th January, 1950, will, however, require certificate of eligibility, in the usual way.
(2) A candidate in whose case a certificate of eligibility is necessary may be admitted to an examination or interview conducted by the Commission or other recruiting authority and he may also provisionally be appointed subject to the necessary certificate being given to him by the Government.
6. Recruitment to Service :- (1) Recruitment to the service for cadre and ex-cadre posts shall be made in the following manner only from the sources listed below in the proportions and the order indicated against a lot of every 10 vacancies :- ________________________________________________________________ Method of Recruitment Proportion Allocation to each source in a lot of 40 vacancies _________________________________________________________________

(2) In case suitable candidates are not available from source No.4 the vacancies shall be filled from sources 2 and 3.
(3) In case, a candidate is not available from sources (1) and (3) and a person has, to be appointed, in public interest as a stop gap arrangement, from other than the allotted source; such a person shall be liable to be reverted to his original cadre when a candidate from the allotted source is available and the period of service rendered by such person shall not be reckoned for the purpose of seniority.
(4) The Government may fill a short-term vacancy, in the exigencies of public service, after recording specific reasons, for a period not exceeding six months in each case, by local arrangement from among the members of Haryana Public Works Department (Irrigation Branch) Overseers (Engineering) Service, without resorting to the select list of prepared under rule 9.
(5) (i) No person, who has more than one wife living or who has a spouse living marries in any case in which such marriage is void by reason of its taking place during the lifetime of such spouse, shall be eligible for appointment to the service; and
(ii) No women, whose marriage is void by reason of the husband having a wife living at the time of such marriage or who has married a person who has a wife living at the time of such marriage, shall be eligible for appointment to the service.
(6) No person, except to the extent provided under sub-rule (4) :-
(a) who is not a substantive member of the Public Works Department (Irrigation Branch) Class-II Service or a member of Haryana Service of Engineers Class-I, Service in the Junior Scale on the date of enforcement of these rules; or
(b) who is not considered suitable for appointment to the service as provided in rule 7 read with appendix "E" shall hold the post of a Sub-Divisional Officer, even in an officiating capacity, unless he is declared, within a period of six months from the date of enforcement of these rules, as suitable for appointment to the service under the provisions of these rules.
(7) No person shall be recruited to the service by direct appointment unless he produces a certificate of character from the principal academic officer of the university, college, school or institution last attended, if any and similar certificate from two responsible persons, not being his relatives, who are well acquainted with his university, college, school or institution.
7. Qualifications: - No person shall be appointed to the Service; unless he-
(1) In the case of persons appointed by direct recruitment;
(a) Possesses one of the degrees of recognized university or universities in India which are incorporated by any Central Act or an Act of a State Legislature in India or other qualifications prescribed in Appendix "B"
(b) Obtains from the Standing Medical Board a certificate of mental and physical fitness after being examined in accordance with the regulations prescribed in Appendix "C" and is considered by the Medical Authority to be fit in all respects for active outdoor duties.
(c) is a person with a satisfactory character and antecedent, verification in respect of which shall be arranged through appropriate Government agency except in cases where such verification may have already been made at the time of his entry into Government service;

(2) In the case of appointment by promotion from sources 2 and 3 under Rule (6)(1)- Is a member of the Haryana Public Works Department (Irrigation Branch) Overseers Engineering Service of a draftsman member of the Irrigation Branch, Draftsmen and Tracers Service and has put in a service of ten years. He will have to pass Departmental Professional Examination and Departmental Revenue Examination within three years of such promotion otherwise he will be reverted to his original post and his seniority will be determined from the date of passing the examinations;
(3) In case of appointment by promotion from source 4 under rule 6(1)
(i) is a member of the Haryana Public Works Department (Irrigation Branch) Overseers (Engineering) Service or a draftsmen member of Irrigation Branch Draftsmen and Tracers Service;
(ii) possesses any of the qualifications included in Appendix B and has put in five years service in case he possesses AMIE qualifications and two years service in case he is a degree holder. He will have to pass Departmental Examinations within three years on such promotion otherwise he will be reverted to his original post and his seniority will be determined from the date of his passing the examinations;
(4) in case of appointment by transfer, possesses the qualifications prescribed for the members of the service;
(5) has not more than one wife living or in the case of woman, is not married to a person already having a wife living; provided the Government may, if satisfied that there are grounds for doing so, exempt any person from the operation of this clause.
8. Direct Appointments - (1) A candidate for direct appointment shall not be less than twenty years and more than twenty seven years of age on or before the first day of August next preceding the last date of submission of applications to the Commission :
Provided that -
(a) In the case of candidates who are displaced persons and in whose case the age limit for admission to Engineering College had been relaxed, and in the case of candidates belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes the upper age limit shall be such as may be fixed by Government in consultation with Finance Department, from time to time;
(b) In the event of no direct recruitment being made for some years the upper age limit of twenty-seven years may be extended by the Government in consultation with Finance Department upto thirty years in the case of eligible candidates to enable them to have two opportunities in all for appearing in the interview; and
(c) In the case of candidates possessing the requisite qualifications who are already in the service of the State Government, the upper age limit shall be thirty-five years, and they shall be entitled to avail of only three chances in the examination held under this rule in addition to any chance availed of by them upto the age of twenty-seven years.
(2) The selection of candidates, including those belonging to Scheduled Castes, Scheduled Tribes or Backward Classes shall be made by the Commission after holding an interview.
(3) Appointment to the service shall be made according to the number of vacancies to be filled by direct appointment strictly in the order of merit indicated by the Commission.
(4) A candidate recruited by direct appointment shall have to give an undertaking to serve the department for a period of at least 2 years after completion of his training failing which he shall be liable to refund to Government, the cost of training in addition to three months notice or pay and allowances in lieu thereof,. In case he fails to complete the training satisfactorily, he shall refund the cost of training that the Government may have undergone by then.
9. Appointment by promotion - (1) Government shall at intervals, ordinarily not exceeding one year, consider the cases of all eligible officers; for promotion to the Service, as on the first day of January of that year.

(2) Government shall prepare a list of officers suitable for promotion to the service. The selection for inclusion in such list shall be based on merit and suitability in all respects with due regard to seniority.
(3) The names of the officers included in this list shall be arranged in order of seniority in Haryana Public Works Department (Irrigation Branch) Overseers (Engineering) Service and Members of the Draftsmen and Tracers Service;
provided that any junior officer who in the opinion of the Government is of exceptional merit and suitability may be assigned a place in the list higher than that of officers senior to him in his own class.
(4) The list so prepared shall be revised every year.
(5) If in the process of preparing the list or its revision, it is proposed to supersede any eligible candidate, Government shall draw up a list of such officers and may record its reasons for the proposed supersession.
(6) The list prepared or revised in accordance with sub-rules (2), (4) and (5) shall then be forwarded to the Commission by Government alongwith-
(i) records of all officers included in the list;
(ii) records of all officers proposed to be superseded as a result of the recommendations of Government;
(iii) the reasons, if any, recorded by Government for the proposed supersession of any officer.
(7) The Commission shall consider the list prepared by Government alongwith other documents received and unless it considers any change necessary, approve the list.
(8) If the Commission considers if necessary to make any change in the list received from Government, the Commission shall make the changes it proposes and forward the list it considers suitable to the State Government.
(9) Appointment to the Service shall be made by Government from this list in the order of which names have been placed by the Commission.
(10) Appointment by promotion may be made to an ex-cadre post or to any post in the cadre in an officiating capacity from the list prepared under this rule.
Note - This rule shall also apply for assessing the suitability of Temporary Engineers for the Service as provided in Appendix 'F'.
10. Appointment by transfer - Government may in special circumstances with the approval of the Commission appoint a Class-II Officer to the Service by transfer.
11. Probation - (1) Officers appointed to the service shall remain on probation for a period of two years :
(a) any period, after appointment to the Service, spent on deputation on a corresponding or a higher post shall count towards the period of probation fixed under this rule;
(b) in the case of an appointment by transfer, any period of working the rank of Assistant Engineer or above prior to appointment to the Service may at the discretion of Government, be allowed to count towards the period of probation fixed under this rule; and
(c) an officiating appointment in the service shall be reckoned as a period spent on probation but no member who has thus officiated shall on the completion of the prescribed period of probation be entitled to be confirmed unless he is appointed against cadre post.
(2) If the work or conduct of an officer appointed to the service during the period of probation is, in the opinion of Government, not satisfactory, it may-
(a) dispense with his services, if recruited by direct appointment;
(b) if recruited otherwise:-
(i) revert him to his former post; or
(ii) deal with him in such other manner as the terms and conditions of his previous appointment permit.
(3) On completion of the period of probation of an officer, the Government may-
(a) confirm such officer in his appointment provided he has passed the Departmental Revenue Examination and Departmental Professional Examination.
OR
(b) if no cadre post is vacant for him, declare that he has completed his probation satisfactorily.
OR 7
(c) if his work or conduct has, in its opinion, not been satisfactory, dispense with his services, if recruited by direct appointment; or
(d) if recruited otherwise
(i) revert him to his former post; or
(ii) deal with him within the terms and conditions of his previous appointment; or
(e) extend his period of probation and thereafter pass such orders as it could have passe don the expiry of the first period of probation;
Provided that the total period of probation including extension, if any, shall not exceed three years. Confirmation would be made provided he has passed the Departmental Professional and Departmental Revenue Examinations.
(4) On the satisfactory completion of the period of probation, Government shall confirm such officer in a cadre post, if one is available for him.
12. Seniority - (1) Except as provided in sub-rule (5) of this rule relating to officers appointed by transfer, the seniority of the members of the service, shall be determined by the order of their appointment in service according to rules 6, 8 and 9 irrespective of their date of joining.
Provided that where the period of probation of an officer has been extended, the order of appointment shall be deemed to have been issued on a date determined by adding to the original date the extended period of probation.
(2) The inter-se-seniority of the members of the service shall be in the order of recruitment provided under rule 6-
Provided that in case an officer does not join his appointment within six months of the date of order of appointment his seniority shall be determined by Government on an adhoc basis after taking into consideration all the circumstances of the case.
(3) The inter-se-seniority within the group of direct recruitment shall be as in the merit grading under rule 8.
(4) The inter-se-seniority within the group of promoted officers from a particular source, shall be as in the list prepared under rule 9.
(5) In the case of an officer appointed by transfer as an Assistant Engineer, he would be placed junior to all the officers appointed directly or by promotion, as Assistant Engineer in a particular year;
Provided that the provisions of proviso to sub-rule (1) shall apply to such an officer if his period of probation is extended.
13. Pay of members of service - Members of the service will be entitled to such scales of pay, including special pay, as may be authorized by Government in consultation with Finance Department from time to time. The scales of pay at present in force in respect of the specified posts are given at Appendix "D".
Provided that Government may in consultation with the Commission and Finance Department, grant an initial start to any person appointed to the Service, higher than that to which he would have been otherwise entitled.
14. Leave, pension and other matters - In respect of leave, pension and other cogaate matters not expressly provided for in this Act, the members of the Service shall be governed by such rules and regulations as may have been, or may hereafter be, framed by competent authority under article 309 of the Constitution of India.
15. Departmental Examination - (1) Officers appointed to the Service, except from the sources (2), (3) and (4) of rule 6(1) shall pass such departmental examinations and within three years of their appointment.
Provided further that the Government may, for any sufficient cause extend the period within which any member is required to pass the departmental examination.
(2) If an officer fails to pass the departmental examination within the prescribed period or with in the extended period, if any, he shall not earn his future grade increments till such time as he passes it when the increments shall be released retrospectively.
Provided that he shall not be entitled to get any arrears of the released grade increments for the period during which he could not pass the examination.
8 Note- The increment of the officer to whom extension is granted beyond 3 years period for passing departmental examinations shall be withheld without cumulative effect for failure to pass the departmental examination.
16. Vaccination - Every member of the Service shall get himself vaccinated and revaccinated as and when the Government so directs by special or general order.
17. Discipline, penalty and appeal - (1) In matters relating to discipline, penalties and appeals, members of the Service shall without prejudice to the provisions of the Public Servants (Inquiries) Act, 1850 be governed by the Punjab Civil Services (Punishment and Appeal) Rules, 1952 as amended from time to time.
Provided that the nature of penalties which may be inflicted, the authority empowered to impose such penalties and the appellate authorities shall subject to the provisions of any law or the rules made under article 309 of the Constitution of India be as specified in Appendix "E".
(2) The authority competent to make an order under clauses (e) and (d) of sub-rule (1) of the rule 10 of the Punjab Civil Services (Punishment and Appeal) Rules, 1952 shall be Government.
18. Oath of allegiance - Every member of the Service, unless he has already done so, shall be required to take the oath of allegiance to India and to the Constitution of India as by law established.
19. Liability of transfer - (1) Every member of the Service shall be liable to serve under the orders of Government anywhere within the State of Haryana or any other place in India where he may be required to proceed by Government.
(2) Any person appointed to the service would be required to serve in any defence service or post connected with the defence of India for a period of not less than four years, including the period spent on training, if any;
Provided that such a person-
(a) shall not be required to serve as aforesaid after expiry of 10 years from the date of appointment; and
(b) shall not ordinarily be required to serve as aforesaid after attaining the age of 40 years.
20. Publication of grounds of dismissal - If a member of the Service is dismissed by Government or other competent authority as a result of a departmental enquiry or an enquiry under the Public Servants (Inquiries) Act, 1950 or on conviction on a criminal charge by a court, Government may publish in the Official Gazette the reasons for such dismissal, if it is of the opinion that such publication is desirable in the public interest.
21. Power to relax - (1) Where the Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
(2) Notwithstanding anything contained in these rules, it shall be open to Government to recruit a person other than an Indian citizen to the Service, in which event it shall, in consultation with the Commission, pass such orders as it considers appropriate in respect of the qualifications required for appointment and in respect of all other matters which arise in connection with such an appointment.
Provided that where the rule to be relaxed has financial bearing the relaxation shall be allowed with the concurrence of Finance Department to the extent and subject to such conditions as that department may think fit to impose.
22. Repeal - (1) The Punjab Service of Engineers, Class-II (Irrigation Branch) Rules, 1941, published with Punjab Government notification No. 3912-E-878/38, dated the 27th February, 1941, and the corresponding rules, if any, of the erstwhile State of Patiala and East Punjab States Union are hereby repealed.

Provided that the repeal shall not affect any action taken or any orders passed under the provisions of the rules hereby repealed and the action taken or passed under the corresponding, provisions of these rules.
(2) Notwithstanding the repeal of the rules referred to in sub-rule (1) the rules applicable to any member of the Service, immediately before the 1st day of November, 1966, in respect of his conditions of service to the extent to which any of these rules is to his disadvantage shall continue to apply to such member.
10 APPENDIX - A (See rule 4)
1. The strength of the service shall be determined each year in the following manner :- First Add.- (a) Posts which have existed continuously for three years or more prior to 1st January of the year in which the cadre is being fixed or revised;
(b) Deputation and leave reserve at the rate of 15 per cent of (a) above.
Deduct (c)- 15 per cent of temporary posts;
Deduct (d)- Posts of Assistant Executive Engineers in Class-I Cadre.
Add. (e) - Training reserve posts, at five per cent of (a) above.
2. In addition to the cadre posts as determined above, there shall be ex-cadre or temporary posts according to the requirements of the department depending on the work-load for a particular year.

Candidates recruited for Mechanical Charges will be required to possess degree in Mechanical Engineering.
14 APPENDIX 'C' (See rule 7) Regulations for the medical examination of candidates for admission to the Haryana Service of Engineers, Class-II (Irrigation Branch).
1.To be passed as fit for an appointment as an officer of the Haryana Service of Engineers, Class-II a candidate must be in good mental and bodily health and free from any physical defect likely to interfere with the efficient performance of the duties of his appointments.
2.In the matter of the correlation of age, height and chest-girth, it is left to the Medical Board to use whatever correlation figures are considered most suitable as a guide in the examination of the candidates.
3.The candidate's height will be measured as follows:- He will remove his shoes and be placed against the standard with his feet together and the weight on the heels and not on the toes or outer side of the feet, will stand erect without rigidity, and with the heels, calves, buttocks and shoulders touching the standard, the chain will be depressed to bring the vertex of the head level under the horizontal bar and the height will be recorded in inches and parts of an inch to quarters.
No fixed limit of height is enforced.
4.The candidate's chest will be measured as follows :- He will be made to stand erect with his feet together and to raise his arms over his head.
The tap will be so adjusted around the chest that its upper edge touches the inferior angles of the shoulder blades behind, and its lower edge the upper part of nipples in front. The arms will then be lowered to hand loosely by the side, and care will be taken that the shoulders, are not thrown upwards or backwards so as to displace the tape. The candidate will then be directed to take a deep inspiration several times, and the minimum expansion of the chest will be carefully noted. The minimum and maximum will then be recorded in inches, 33-35, 34-36 1/2 etc. In recording the measurement fraction of less than 1/2 inch should not be noted.
5.The candidate will also be weighed and his weight recorded in pounds. Fractions of a pound should not be noted.
6.The candidate's eye sight will be tested in accordance with following rules. The results of each test will be recorded:-
(i) General - The candidate's eyes will be submitted to a general examination directed to the detection of any disease or abnormality. The candidate will be rejected if he suffers from any morbid conditions of the eyes, eyelids or contiguous structures of such a sort as to render, or to be likely at a future date to render him unfit for service.
(ii) Visual acuity - The examination to determine acuity of vision will include two tests, one for distant and the other for near vision. Each eye will be examined separately. (iii) Field of vision - The fields of vision of the candidate's eyes will be examined. Any defect will be a cause for rejection of the candidate.
7.The urine (passed in the presence of the examiner) should be examined and the result recorded.
8.The following additional points should be observed :-
(a) that the candidate's hearing in each ear is good and that there is no sign of disease of the ear;
(b) that his speech is without impediment;

(c) that his teeth are in good order and that he is provided with dentures where necessary for effective mastication.(Well filled teeth will be considered sound).
(d) that his chest is well formed and his chest expansion sufficient that his heart and lungs are sound, and that his blood pressure is within normal limits;
(e) that there is no evidence of say, abdominal disease;
(f) that he is not reptured;
(g) that he does not suffer from any severe degree of hydrocele,varicocole, varicoso vains or piles;
(h) that his limbs, hands and feet are well formed and developed and that there is free and perfect motion of all his joints;
(i) that he does not suffer from any inventer to skin disease;
(j) that there is no congenital malformation or defect;
(k) that he does not bear traces of acute or chronicle disease pointing to an imparted constitution; and
(l) That he bears marks of efficient vaccination. When a defect is found it must be noted, and the medical examiners should state their opinion as to whether or not it is likely to interfere with the efficient performance of the duties which will be required of the candidate. If the condition is remediable by operation it should be so stated. He should (unless he has already had small-pox and shows obvious sears thereof) have been successfully vaccinated or re-vaccinated within the previous 12 months.

1.Pay of the members of the service, shall be in a scale rising from Rs. 400 per mensem by annual increments of Rs. 30 to Rs. 700 with an efficiency bar at Rs. 700 and then by annual increment of Rs. 40 to Rs. 1,100/-.
Provided that :-
(a)increments during the period of probation shall not be drawn except with the approval of the Government.
(b)direct recruits shall draw the fixed pay of Rs. 400 per mensem or as decided by competent authority from time to time during the period of six months training, on the successfully completion of which they shall be given Sub-Divisional Charge; and
(c)members promoted or directly recruited from P.W.D. (Irrigation Branch) Overseers, Engineering Service and Draftsman and Tracers Service shall be allowed pay according to the provision of Rule 4.4 of Punjab C.S.R.Vol.I Part-I, read with rule 4.14.

1.On the date of commencement of these rules, the service shall comprise of:-(a)Officers who are holding the posts of Engineers in the substantive capacity in Class-II Service, as it existed immediately before the commencement of these rules thereafter referred to as the existing Class-II Service.
(b)Officers who are not holding the posts of Engineers in the substantive capacity but who were selected by direct recruitment with the approval of the Commission for the post of temporary engineers.
(c)Officers who are not holding the posts of Assistant Engineers in a substantive capacity but who were selected, with the approval of the Commission, from the members of P.W.D. (Irrigation Branch) Overseers (Engineering) Service or Draftsmen and Tracers Service officiating as Sub Divisional Officers or Assistant Design Engineers.
(d)Notwithstanding anything to the contrary content contained in clauses (b) and (c) above, officers who are temporary Assistant Engineers, officiating Sub-Divisional Officers of Assistant Design Engineers on the date of commencement of these rules but have not, been declared, with the approval of the Commission, as fit for the existing Class-II Service will not be deemed to be members of the Service constituted under these rules, even though they have been appointed as Temporary Engineers or officiating Sub-Divisional Officers, or Assistant Design Engineer with the approval of the Public Service Commission. On being declared by the Commission as suitable for appointment to the Service in accordance with these rules they shall become members of the service as provided for in paragraph
2.The Officers, who according to Clause (d) of paragraph 1 above are not members of the service on the date of commencement of these rules but are declared fit for appointment to the service in accordance with the procedure laid down in rule 9 shall be deemed to be members of the Service to the extent of the number of vacancies which exist at the time they are declared fit for appointment to the service and the officers who cannot be absorbed on the existing vacancies shall be appointed against sanctioned ex-cadre posts.
3.(1)At the time of the initial constitution of the service, the percentage of officers to be included in the service from different blocks shall be the same as prescribed in rule 6 in respect of the cadre.
(2)The ex-cadre posts will also be allotted in the proportions given in para 3(1) for the three blocks.
Note - Some officers have been temporarily promoted as officiating SDO's or officiating Assistant Design Engineers against ex-cadre posts in place of direct recruit. Such officers would be reverted as and when direct recruits are available.
4.The Officers mentioned in paragraph 2 shall be junior to members of the Existing Class-II Service.
The inter-se-seniority of the officers mentioned in paragraph 2 will be fixed as follows :-
(1)The officers may be classified as -
(a)those who are graded higher under the proviso to sub-rule (5) of rule 9; and
(b)the rest.
(2)The inter-se-seniority should be determined by continuous period of service officiating either as temporary Engineer of officiating Sub Divisional Officer, or officiating Assistant Design Engineer, except in the case of officers under (a) who will be assigned seniority as recommended by the Commission and accepted by the Government.
Note - (i)For the purpose of determining continuous period of service the period spent as Apprentice Engineer would be included in the case of Temporary Engineer.(ii)in the cae of officiating Sub Divisional Officers or officiating Assistant Design Engineers; the date of continuous service will be reckoned from the date of issue of orders promoting the official as officiating Sub Divisional Officer or officiating Assistant Design Engineer.
(iii)Officiating Sub Divisional Officers or officiating Assistant Design Engineers' promoted from Public Works Department (Irrigation Branch) Overseers (Engineering) Service or Draftsmen and Tracers Service, whosubsequently not appointed as Temporary Engineers through Commission shall, on appointment, to the Service be allowed to opt for either of the two blocks. In case, an officer opts for the officiating Sub Divisional Officer or officiating Assistant Design Engineer, Block benefit of services rendered as officiating Sub Divisional Officer or officiating Assistant Design Engineer as well as Temporary Engineer will be admissible to him. No benefit of service but in as officiating Sub Divisional Officer or officiating Assistant Design Engineer, however will be admissible to him to for the fixation of his seniority as a Temporary Engineer.

(ii) from the members of the Haryana Public 5% Works Department (Irrigation Branch) Junior Engineer's (Engineering) Mechanical.
(iii) from Draftsmen, members of the draftsmen 6% and Tracers Service.
(iv) from the members of the Haryana Public 8% Works Department (Irrigation Branch) Junior Engineers (Engineers) Civil, possessing qualification prescribed in Appendix-B.
(v) from the members of the Haryana Public 2% Works Department (Irrigation Branch) Junior Engineer(s) (Engineering) Mechanical/Electrical possessing qualifications prescribed in Appendix-B.
(vi) from the members of Draftsmen and Tracers 2% Service, possessing qualifications prescribed in Appendix-B.
Note -(i)The above percentage shall be maintained from time to time.
(ii)To cover the shortfall, if any, in any categories, the future vacancies shall be filled from the category till the shortfall is completed. However, to complete the shortfall no reversion/retrenchment shall be made.
(iii)The vacancies arising due to retirement, promotion/dismissal or death etc. shall be filled in from the88 category from which the vacancy falls vacant" and II. in Sub-rule (2) _
(i)for the words and figures "source No.4", the words brackets, figures, letter and sign "categories (1) (b)(iv), (v) and (vi)" shall be substituted; and
(ii)for the words and figures "sources 2 and 3" the words, brackets, figures, letter and sign" categories (1)(b)(i),(ii) and (iii) shall be substituted; and
(iii)in sub-rule (3) for the words, brackets, and figures "sources (1) and (3)", words, brackets, figures and letters "categories (1) (a) and (1)(b)(iii)" shall be substituted.
3.In the said rules, in rule 7 :-
(i)in sub-rule (2), for the words, and figures "sources 2 and 3" the words, brackets, figures, letter and sign "categories (1) (b) (i), (ii) &(iii)" shall be substituted; and(ii)in sub-rule (3), for the words, figures and sign "source 4,5 and 6", the words, brackets, figures, letter and sign "categories (1)(b)(iv),(v) and (vi)" shall be substituted.

MAY 11, 2004 (VYSK 21, 1926 SAKA) HARYANA GOVERNMENT PUBLIC WORKS DEPARTMENT (IRRIGATION BRANCH) Notification The 11 th May, 2004 No. GSR 13/Const./Art.309/2004 - In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and all other powers enabling him to this behalf, the Governor or Haryana hereby makes the following rules, further to amend the Haryana Service of Engineers, Class-II, Public Works Department (Irrigation Branch) Rules, 1970, namely :-
1.These rules may be called the Haryana Service of Engineers, Class-II, Public Works Department (Irrigation Branch) Amendment Rules, 2004.
2.In the Haryana Service of Engineers, Class-II, Public Works Department (Irrigation Branch) Rules, 1970, in rule 6, the sub rule (1) the following sub rule shall be substituted namely:- "(i)Recruitment to the service for cadre and ex-cadre posts shall be made;
(a) 50% by direct recruitment.
(b) 50% by promotion from the following categories :-
(i) from the members of the Haryana Public 25% Works Department (Irrigation Branch) Junior Engineers (Civil Engineering)
(ii) from the members of the Haryana Public 5% Works Department (Irrigation Branch) Junior Engineer's (Mechanical/ Electrical Engineering)
(iii) from Draftsmen, members of the draftsmen 6% and Tracers Service.
(iv) from the members of the Haryana Public 10% Works Department (Irrigation Branch) Junior Engineers (Civil Engineers), possessing qualification prescribed in Appendix-B.
(v) from the members of the Haryana Public 2% Works Department (Irrigation Branch) Junior Engineer(s) (Mechanical/Electrical Engineering) possessing qualifications prescribed in Appendix-B.
(vi) from Draftsman, the members of Draftsmen and Tracers 2% Service, possessing qualifications prescribed in Appendix-B.
