(EXTRA.), FEB. 17, 1989 405 (MAGHA 28, 1910 SAICA) . . . , [Authorised English Translation] HARYANA GOVERNMENT ANIMAL HUSBANDRY DEPARTMENT Notification The 15th February, 1989 No. G.S.R.27/C.A.52/84/S.65/89.—In exercise of the powers conferred by section 65 of the IncVan Veterinary Council Act, 1984, the Governor of Haryana, here by makes the following rules for carrying out the provisions of this Act, namely .—
PART -I
1. These rules may be called the Haryana Veterinary Council Rules,
1988.
2. In these rules, unless the context otherwise requires—
(a) "Act" means the Indian Veterinary Council Act, 1984.
(b) "Committee", means an Executive Committee and such other committee as may be constituted by the Haryana Veterinary Council ;
(c) "Council" means the Haryana Veterinary Council established under the Act ;
(d) "Director", means the Director of Animal Husbandry ;
Haryana ;
(e) "Fees", means the fees fixed for the registeration of the Veterinary Practitioner under the Act ;
(f) "Government" means the Government of the State of Haryana ;
(g) "Registrar" means the Registrar appointed under sectirn 42(1); and ;
(h) "Tribunal", means the Registration Tribunal constituted for the purpose of first preparing the State Veterinary register under section 45(1) of the Act.
PART -II Short title.

(EXTRA.), FEB. 17, 1989 (MAGHA 28, 1910 SAKA) who may be entitled to vote at such electicn upto the date appointed by the Returning Officer in the official Gazette and in such other manner as he may think fit. An announcement to this effect shall also be made in the press through the daily newspapers.
(2) Draft electrolls shall be kept open in the office of the Returning Officer for public inspection for a period of not less than fifteen days, during which any objection relating to entries in or omission from the said draft electoral rolls may be preferred by any person to the Returning Officer at his office.
(3) On, or after, the expiry of the period specified in sub -rule (2) the Returning Officer shall consider, the objections, if any, so received and revise the draft electoral rolls and get the draft of the electoral rolls published in the official Gazette sixty days prior to the date of election. The electoral rolls shall then be deemed to be final and conclusive.
(4) The Returning Officer shall notify in the Official Gazette and in such other manner as he may deem fit, the date, time, and place, fixed for each of the following proceedings :—
(i) receipt of nomination papers and their Scrutiny ;
(ii) sending of voting papers; and
(iii) receipt of voting papers and scrutiny and counting of votes.
4(i) Any person whose name appears in the electoral rolls and is not disqualified under section 32(3) of the Act. may be nominated as a candidate for election to the Haryana Veterinary Council.
(2) Such nomination shall be made by means of a nomination paper in form A which shall be supPlied by the Returning Officer to the Electrol who may apply for the same.
(3) Each nomination paper shall be subscribed by one elector as proposer and the other as seconder. Provided that no elector shall subscribe more nomination papers than the seats allotted to his electorate :
Provided further that if more than prescribed number of nomination papers are subscribed by the same elector, in instalments, the prescribed number of nomination papers first received by the Returning Officer.

(4) On receipt of each nomination paper the Returning Officers shall forthwith endorse thifl n the date and hour e f receipt.
5.(1) Nomination papers not receiv( d by the Returning Officer at his office address before noon on the last day appointed by the Returning Officer in this behalf, shall be rejected.
(2) The candidates and their proposers and seconders may end the office of the Returning Officer on the date and hour notifizel undet sub-ru1e(4) of rule 3 and the Returning Officer shall allow them to examine the nomination papers of allcandidates which have been received by him as aforesaid.
(3) The Returning Officer shall then Scrutinize the nominatie n papers and may either of his own motion or on an objection made by any person decide all questions which may arise w to the validity of any nomination and his decisic non such question shall be final.
6. (1) If the number of the nominated candidates who stand for election does not exceed the number of members to be elected under that clause, the Returning Officer shall forthwith declare such candidates to be elected.
(2) If the number of such candidate excedes the number of members to be so 4lected,the Returning Officer, shall forthwith publish their names and addresses in the official Gazette and shall further cause their names to be entered in voting papers in Form B.
(3) Any nominated candidate may withdraw his candidature by sending to the Returning Officer a written and signed withdrawal not later than fourteen clear days before the date appointed fir the scrutiny and counting of votes and it shall not be permissible for him subsequently to cancel such withdrawal.
(4) On receiving notice of such withdrawal the Returning Off cer shall publish the fact of such withdrawal in the Official Gazette.
(5) On or before the date as may be appointed by the Returning Officer he shallsend by registered post to each elector a voting paper in Form C alongwith declaratie n in n i m F duly signed by the Returning Officer:
Provided that such a voting paper shall be supplied to any such electoral on his applying to the Returning OMeer for the same at any tin a3 b... -fore the date appointed for the counting of votes and no electionshallbe invalidated by reason of the non -receipt by an elector of his voting paper.
7. Provided that the voting papers which are not received by the Returning Officer before the time and date appointed for the scrut ny and counting of votes shal be rejected.

8. (1) The Returning Officer shall scrutinize and count the Votes at his office on such date and time appointed by him for this purpose.
(2) Any candidate duly nominated and accepted for election may be present in persons or may send a representative duly authorised by him in writing to watch the process of counting.
(3) The Returning Officer, i f so requested shall show the voting papers, but not the counterfoils, to the candidates or their authorised representatives.
(4) rf any objection is made to any voting paper on the ground that it does not comply with instructions contained therein, or to the rejection by the Returning Officer of a voting paper, it shall be decided at once by the Returning Officer, whose decision shall be final.
9. (1) When the counting of the votes has been completed the Returning Officer shall forthwith declare elected the candidate or candidates polling the largest number of votes.
(2) When the equality of votes is found to exist between any candidate and the addition of one vote will en t i t le any of the candidates to be declared elected, the determination of the candidate to whom such addtional vote shall be deemed to have been given shall be made by lottery to be drawn in the presence of the Returning Officer in such manner as he may determine. 7
10. Upon the completion of the count ing and after the result has been declared, the Returning Officer shall seal up the voting papers and all other documents relating to the election and shall retain the same for a. period of s ix months and there after cause them to be destroyed.
The Returning Officer shall got published the name of the elected candidates in the Official Gazette.
12. The above procedure shall be strictly adhered to for the election of the President, who shall be elected by the members of the Haryana Veterinary Council from amongst themselves, HARYANA GOVT GAZ. (EXTRA.), FEB. 17, 1989 (MAGMA 28,1910 SAKA) 400
13. When a vacancy in Haryana Veterinary Council established under section 32 of the Act occurs or at any time within ninety days of the date when such a vacancy will occur in the ordinary course of events, the President shall, in the case of nominated member, inform the Government of the Vacancy and in the case of an elected member, issue a precept to the electrorate concerned aprising of the said vacancy and requiring it to elect a substitute within a period to be specified in the precept; Such precept may take the form of a notice published in the offi cal Gazette.
14. In the case of a election of a member the procedure prescribed in ruele 4 to 11 shall be followed.

15. The Returning Officer shall communicate the result publication of the election to the Director, Animal Husbandry and the Presi- of Result dent. section 65(2)(c).
PART III
16. For carrying out the purposes of the Act the Haryana Veterinary Council may constitute an executive committee and such number of persons as it may deem fit. Each committee constituted iby the council shall perform such functions as may be assigned to t by the Council.
17. There shall be paid to the no official members for attending meetings of the Haryana Veterinary Council or any Committee thereof, such travelling and other allowances in accordance with the Punjab Civil Services Rules Volume III (T.A. Rules) as amended from time to time. In addition to it a member shall be paid Rs. 16 per day for attending the meeting.
IS. For attending meetings of the Council or any committee thereof the official members shall be paid travelling allowance in accordance with the provisions of the Punjab Civil services Rule Volume III (T.A. Rules) asamended from time to time.

(2) The appointment of employees of the I4aryana Veterinary Council shall be terminable on one month's notice and on the abolition of the post, the employee shall be liable to be reverted to his substantive rank, if on deputation with the said council. Under the conditicns of the employment the employees of the Council shall have to complete a probation period of two years.
20. (1) It shall be the duty of the Registrar to maintain the register of Veterinary Practitioners and to act as the Secretaty to the Haryana Veterinary Council.
(2) The Registrar shall keep the Register Correct as for as possible and may from time to time enter there in any material alteration in the address or qualifications of the practitioners. The name of the registered practitioners who die or whose names are directed to be removed from the register under the Act shall be removed from the register.
PART V Constivicetution 21. The posts shown in appendix 1 to these rules shall constitute theof Ser Section service of the Haryana Veterinary Council :
40(2) and Section Provided that nothing in these rules shall effect the inherent right of the Haryana Veterinary Council to add to or reduce the number of posts or to creat new posts with different designations and scales of pay either permanently or temporarily.
22.(1) No person shall be appointed to any post in the service unless he is —
(a) a citizen of India; or
(b) a Citizen of Nepal; or
(c) a Subject of Bhutan; or
(d) a Tibetan refugee who came over to India before the 1st January, 1962, with the intention of permanently settling in India; or
(e) a person of Indian origin who has migrated from Pakistan, Burma, Sin i Lanka or any of the East African Countries of Kenya, Uganda, and United Republic of Tanzania (formerly Tanganyika and Zanzibar), Zambia, Malavi, Zara and Ethopia with the intention of permanently settling in India:
Provided that a person belonging to categories (h), (c), (d), or (e) shall be a person in whose favour a certificate of eligibility has been issued by the Government of India.
(2) A person in whose case a certificate of eligibility is necessary may be admitted to an examination or interview conducted by the Haryana Veterinary Council on his furnishing a proof that he has applied for the HARYANA GOVT GAZ. (EXTRA.), FEB. 17,1989 411 (MAGHA 28,1910 SAKA) certificate and he may also provisionly be appointed subject to the necessary certificate being issued to him by the Government of India.
(3) No person shall be appointed to the service unless he produces a.
certificate of charater from the principal academic officer of the University, College, School or institution last attended, if any, and a similar certificate from two other responsible persons not being his relatives who are well acquainted with him in his private life and are unconnected with his University, College, School or institution.
23. No person,—
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) having a spouse living, has entered into or contracted a '.arriage with any pz:rson, shall be eligible for appointment to any pest in the service :
Provided that the I-faryana Veterinary Council may if satisfied that such marriage is pecmissible under the reese nal law applicable to such person and the other party to the mai ri age and there are other grounds for so doing exempt any person from operation of this rule.
24(1) No person shall be recruited to the seiviee by direct appointment if he is less than eighteen years of age or is more than thirty yeat s of age on such date as may be specified by the Har yana Veteri nary Council while inviting applications or is not within such limits of age as may be sp :cif ically prescribed by Government for direct appointment from time to time in respect of its employees of the eerresponding category:
Provided that the Haryana Veterinary Council may f r reasons to be recorded in writing relax the uper age limit for eat( g( ry or class of persons :
Provided further that in the ease of a prson belonging to scheduled caste and other backward classes, upper age limit shall be such, as may be fixed by the state government, from time to time in resp( ct of recruitment to the service under it.

26. (I) .A.ppointment to the service shall be made in the manner specified in Appendix -II to these rules.
(2) No person shall be appointed to the service unless he possesses the quatificiations specified in Appendix -II to these rules.
(3) All appointments to the service by promotion shall be made by selection based on seniority:cum-merit and no person shall be entitled to claim promotion on the basis of seniority alone.
27. (I) A person appointed to a post in the service shall remain on probation for a period of two years, if appointed by direct recruitment and one year, if appointed otherwise :
Provided that,—
(a) Any period after such appointment spent on deputation on a corresponding or a higher post shall count towards the period of probation.

(2) If, in the openion of the appointing authority, the work or conduct of a person during the period of probation is not satifactoty, it may,—
(a) If such person is appointed by direct recruitment dispense with his services, or revert him to a post on which he held lien prior to such appointment, and
(b) If uch person is recruited otherwise,
(i) revert him to his former post; or
(ii) deal with him in such other manner as the terms and conditions of his previous appointment permit.
(3) On the c..impietion of the period of probation of a pers on, the appointing authority may,—
(a) If his work or conduct has, in its openion, been satisfactory, -- 0) confirm such person from the date of his appointment, if appointed against a permanent vacancy; or
(ii) confirm such person from the date from which a permanent vacancy. occurs, if appointed against a temporary vacancy ; or
(iii) declare that he has completed his probation satisfactorily if there is no permanent vacancy, or HARYANA GOVT GAZ. (EXTRA.), FEB. 17, 1989 413 (MAGHA 28, 1910 SAKA) (b} if his work or conduct has in its opinion been not satisfactory;
(1) dispense with his service, if appointed by direct recruitment, if appointed otherwise revert him to his former post or deal with him in such other manner as the terms and conditions of his previous appointment permit ; or
(ii) extend his period of probation and thereafter psss such orders as it could have passed on the expiry of the first period of probation specified in clause (1) ;
Provided that the total period of probation including extension;
if any, shall not exceed three years.
28. The Seniority of the niembers of the service in each cadre shall Seniority be determined by the length of continuous service on a post in that cadre of Merrber of the service: of Service Section 40

Council as the case may be, shall not be disturbed in fixing the Seniority :
Provided further that in the case of two or more members, appointed on the same date, their Seniority shall be determined as follows :—
(a) a member appointed by direct recruitment shall be senior to a member appointed otherwise.
(b) in the case of members appointed by promotion, the seniority shall be determined according to the seniority of such members in the appointments from which they were promoted.
Note.—(i) This rule shall not apply to members appointed on purely provisional basis.
(ii) In the case of members whose period of probation is extended under these rules, the date of appointment for the purpose of this rule shall be deemed to have been deffered to the extent the period of probation is extended.
29. The members of the service shall be entitled to such scales of pay as are given in Appendix 1 to these rules or such scales of pay as may be authorised by the State Government from time to time for similar posts.
30. In the matters of discipline, penalties and appeals, members of the service shall be governed by the Haryana Civil Service (Punishment and Appeal) rules, 1987, as amended from time to time.

Provided that the authority competent to impose any of the penalties specified in rule 4(1) of the aforesaid rules and the appellate authority thereunder shall respectively be the Haryana Veterinary council and the State Government.
31. In respect of pay, leave, and other matters not expressly provided for in these rules, the members of the service shall be governed by such rules and regulations as may have been or may hereafter be adopted or made by the competent authority for the State Government employees of the corresponding Status.
32. The members of the service shall be required to subscribe towards the contributory Provident Fund in accordance with the Contributory Provident Fund Rules of the Haryana Veterinary Council Specified in Appendix III to these rules.
33. The members of the service shall be entitled to such benefit of reimbursement of all the medical expenses incurred by them on themselves and the members of their family as may be admissible to the employees of the State Government of the Corresponding Status.
34. Every member of the service shall be entitled to gratuity equal to a half months salary drawn by him at the time of his retirement for each cornp:eted year of his service under the Haryana Veterinary Council:
Provided that if a member of the service who is a subscriber to the contributory provident fund, dies, while in service, the member of his family shall be paid as gratuity such sum as shall when added to the amount of contribution made by the Haryana Veterinary Council towards his contributory provident fund and the interest thereon, be equal to,—
(a) two months emoluments for the member if his death occurs during the first year of service;
(b) Six months emoluments of such member, if his death occurs after five years service;
Note (i)----The term emoluments for the purpose of these rules means, emoluments as defined in rule 6.19 (a) of the 1-laryana Civil Services Rules Volume IL
(ii) The term family for the purpose of this rules means:—
(a) in the case of a male member of the service, the wife and children of such member and widow or widows and children of such member and children or the son of the deceased member.
(b) in the case of female member of the service, the husband and children of such member and children or the son of the said deceased member;
35. The Haryana Veterinary Council shall pay compensatory allowance to its employees at the rates at which it is admissible to State Government employees of the Corresponding category.

36. The members of the service shall also be entitled to such other Other Benebenefits as may be sanctioned by the Haryana Veterinary Council from fits section 40(2)and time to time with the prior approval of the State Government. I 65(2)(f),

(2) The Haryana Veterinary Council, if it is of the opinion that it is (0 .
in public interest to do so, have the absolute right by giving a member of the service three months prior to notice in writing to retire such member on the date on which he completes twenty-five years of service or attains fifty five years of age or on any date thereafter to be specified in the notice.
Any such member may also after giving at least three months previous notice in writing to the Haryana Veterinary Council, retire from service on the date on which he completes twenty-five years of service or attains fifty-five years of age or on any date thereafter to be specified in the notice:
Provided that no member of the service under suspension shall retire from service except with the specified approval of the Haryana Veterinary Council.
(3) Notwithstanding anything contained in sub -rules (1) and (2) a member of the service may be retired by the Haryana Veterinary Council earlier if he is certified to be unfit for service under Haryana Veterinary Council by the Chief Medical Officer Working under the State Government.
38. The members of the service for Journey undertaken in connection with the affairs of the Haryana Veterinary Council within or outside the State of Haryana with the permission of the President in the case of Registrar and with the permission of the Registrar, in the case of others shall be paid travelling allowance and daily allowance in accordance with rules as are applicable to the employees of the State Government of the corresponding Category.
39. The duties of the members of the service shall be such as may be assigned by the Registrar from time to time.
40. The members of the service may be allotted by the Haryana Veterinary Council such residential quarters as may be available according to their status on payment of such rent as is specified by the State Government for its employees or in the alternative the members of the service shall be paid house rent allowance at the rates admissible to the employee of tile State Government of the Corresponding Category at the same station.
41. Every mmnber of the service shall get himself vaccinated or revaccinated as and when the Haryana Veterinary Council so directs by a special or general order.

42. Every memb r of the service unless he has already done so, shall11::required to take oath of allegiance to India and to the constitution oflndia as by law established.
PART VI Maintenance of State Veterinary Practitioners register and registration
43. (1) The register of Veterinary Practitioners shall be maintained in form G.
(2) The names of, the Veterinary practitioners shall be entered in the register in the order in which the applications for registration are admitted and sufficient space shall be left for future additions and alter atie m in the qualifications address etc., of each entry. Each page of the register shall be attested by the Registrar.
(3) On the registeration of every practitioncr under the rules the Registrar shall grant to such practitioner a certificatt on the payment of a fee of Rs. 15 in form 1̀-1'.
(4) In the event of a certificate issued under the sub -rule (3) being lost or accidently destroyed the holder shall ;may at any time during which such certificate is in force, apply to the Registrar for a duplicate and the Registrar may, if he thinks fit, on satisfactory pie of w to the identity of the applicant grant such certificate on payment of a fee of Rs. 10.
44. Every person who holds a recognised Veterinary qualification and desires to have himselfregistered shall apply to the Registrar in form -1 duly filled and signed by himself. Every such application shall be accompanied by a fee of Rs. 15.
45. A name removed from the register may be restored therein on payment of fee of Rs. 15.
46. Printed copies of Haryana Veterinary Register under sectic n of act may be issued to a practitioner on payment of Rs. 10.
41. When a registered Veterinary Practitioner desires to transfer his registration from one state to another, he shall apply in Form 47 .
The fee for suchtransfer shall be Rs. 15.
48. (1) The Haryana Veterinary Council shall meet at least twice in a year at such time and place as may be appointed by the said Council.
(2) The Quorum necessary for the transaction of business at meeting of the Haryana Veterinary Council shall be nine.

(a) "interest"rimns the interest accrued on the balance of a subscriber to the contributory provident fund calculated as if such balance were a deposit in the saving Bank.
(b) "Salary" means monthly salary and includes special pay if any, but does not inzlult travelling allowance, conveyance allowance or other such allowance.
(c) "Servant" includes every servant of the Haryana Veterinary Council who holds a substantive or temporary post under the said Council.
(d) "Saving Bank" means the Post Office Saving Bank of the State and of India or a subsidiary of State Bank of India.
(e) "Subscriber" means a .servant who is required or permitted to subscribe to the Provident Fund by the Haryana Veterinary Council, and
(f) "Fixed deposit account" means a fixed deposit account in any branch of the State bank of India or any other bank in India, functioning as a subsidiary to the State bank of India or functioning under the supervision or control of Reserve Bank of India.
2. Servant shall or may contribute to the Provident Fund. Every servant whos e s alary is not les s than Rs . 750. per mensurn appointed, promoted on or after the date on which the Haryana Veterinary Council may, by resolution, decide to establish and maintain a Provident Fund Account shall be required to Subscribe to such provident fund at the rate of ten percentof the salary. Any servant appointed or promoted to such office before the date of resolution may subscribe to such funds if the Haryana Veterinary Council so permits;
Provided that the Haryana Veterinary Council may allow any servant appointed or promoted to an office ofwhich monthly salary is less than as Mentioned above to subscribe to the contributory provident fund in accord dance with these rules.
3. Recovery of subscription—(1)Every subscription to the contributory provident fund shall be recovered by means of a deduction of the amount of such subscription from each salary bill of the subscriber;
provided that in calculating the deduction to be made fraction of a rupee shall be ignored.
(2)Notwithstinding anything contained in these rules, no servant shall be permitted to subscribe to the contributory provident fund who is absent or pn earned leave, except during the firs t 20 days of the leave.

4. Haryana Veterinary Council's contribution to the contributory proident fund—The Haryana Veterinarytouncil shall contribute to the Contributory provident fund of each subscriber an amount equal to his subscription provided that—
(a) if a subscriber who is so required or permitted to subscribe to a contributory provident fund for the first time on or after the date on which he started subscribing towards the contributory provident fund, resigns from the service of the the Haryana Veterinary Council except on account of illness or any other cause which the said Council may consider to be sufficient he shall_ (0 be entitled to half the contributions made to his contributory provident fund by the Haryana Veterinary Council and the interest accrued thereon if he has completed five years service, and
(ii) not be entitled to get any subscription made to his contributory provident fund by the Haryana Veterinary Council or interest thereon if he has not completed five years service.
(b) if a subscriber is dismissed from service, the Haryana Veterinary Council may with held the whole or any part of the contribution made to his contributory providt nt fund by it and the interest thereon after affording him an apportunity for showing cause against the proposed payment'to be with held.
5. Ledger accoimt subscription.—(1) The Haryana Veterinary Council shall maintain a contributory fund ledger in formP.F.1 appended to these rulesin which separate portion shall be assigned to each subscriber and for the amount of such subscription the amount of the Haryana Veterinary Council's contribution and the monthly balance on which interest is to be calcualted shall be entered therein each month.
(2) The amount of interest accrued on the balance of the credit of a sunscriber shall be calcualted at the end of the each year or when the account is closed to the nearest paise on the lowest balance excluding the fraction of a rupee at the credit of the subscriber between the close of the fourth day and the last day of each month.
(3) At the end of the each year the Haryana vterinary Council shall furnish each subscriber with a statement inform P.F. 2 appended to these rules, sowing the balance at his credit at the begining of the year ; the amount added thereto by way of subscription and contributions and the interest accrued during the year and the balance at the credit of his account at the end of the year.
6. Payment of subscriptions and contributions to be made monthly to the post office savings bank, State bank of India or its subsidiary bank, Accounts.—
(1) The Haryana Veterinary Council shall open an account to be called the "Haryana Veterinary Council employees Contri- HARYANA GOVT GAZ., (EXTRA.),FEB. 17, 1989 4 5 .
(MAGHA 28, 1910 SAKA) batory Provident Fund Account". With the post office or the State 'Bank of India; its subsidiary Bank. As soon as may be at the begining if each month and if possible before the fourth day o f each month,the amount of all the subscriptions and contributions, recoveries made under the provisions of these rules shall be paid into such account
(2) Before a cheque is drawn out of subscription and contributions a bill shall be prepared on the Haryana Veterinary Council's vouch..-:r form and submitted with the relevant salary and establishment bill for signatures of the authorised Officer of the said Council. The said council shall make the payment of the subscription and contribution on a single bill by way of single cheque.
7. General rules of withdrawl—No sum shall be withdrawn from the contributory fund account except—
(a) Under the provision of sub rule(I) of rule 8 arid rule 9 of the contributory Provident Fund Rules for the purpose of making an advance to subscriber, or
(b) Under the provsions of rule 10 of the contributory Provident Fund rules when a subscriber's account is to be closed for payment to the subscriber or his heirs.
8. Advanees.—(1) In the sanction of the Haryana Veterinary Council, any subscriber, may up to the limit of the amount shown at the credit of his account in column 6 of the contributory provident fund ledger, be granted as advances from the contributory provident fund of the amount not exceeding three times of his salary for either of the following purposes—
(a) to pay expenses incurred in connection with illness of subscriber or a member of his family, or
(b) to pay expenses in connection, with the marriage, funeral or other ceremonies which by religion of the subscriber, it is in cumbment upon him to perform and in connection with which it is obligatory that the expenditue shall be incurred:
Provided that no such advance shall be sanctioned unless circumstances of the subscriber are such that the indulgence is, in the openion of the Haryana Veterinary Council are absolutely necessary.
Note.—'Family" for the purpose of this rule shall mear— .
(1) (i) in the case of a male subscriber, his wife, and deoeased.son, • • if any.
• • • •
(ii). in the case of female subscriber, her husband and children • and the widow or widows chidren of her decased son, of any.
(2) The amount of advance shall be repayable is not more than twenty four equal instalments as may be fixed by the Haryana Veterinary 436 HARYANA GOVT GAZ., (EXTRA.), FEB. 17, 1989 (MAGHA 28, 1910 SAKA) Council when sanctioning the advances and such instalments she:11 be recovered in the manner provided in rule 3 of the contributory provident fund rules.
(3) The amount of advance shall be recorded in column 5 of the Contributory provident fund ledger and a note shall be made in column 8 of the contributory provident fund ledger as regards the number of instalments by which the advances are recoverable, shall be shown in red ink in column 2 of the ledger and in column 7 shall be entred the amount of balance of the advance outstanding. 'The amount of the interest last calculated on the monthly outstanding balance shall be recovered from the subscriber in the month following which the last instalment of the advance is recovered which shall be added to the interest calculated on the monthly balance in column 6 at the end of the year.
(4) Tf under provisions of clause (a) or clause (b) of rule 4 of the contributory Provident Fund, Rule, the whole or any portion of the council contribution is to be with held when a subscriber's account is closed and if such account is closed, any portion of an advance made to such subscriber is still outstanding plus the amount of interest last calculated on the monthly outstanding balances of the advance shall be added to the amount shown at the credit of the account in column 6 for the purpose of calculating the T-Iaryana Veterinary Council's share of the total credit of the account.
9. Payment towards insurance etc. --(a) the amount of subscription with interest thereon standing to the credit of subscriber i n the fund may withdrawn to meet payment towards a policy of life insurance.
(b) the policy shall be—
(1) such as legally assignable to the Haryana Veterinary Council
(ii) One effected by the subscriber himself on his own life.
(c) The Haryana Veterinary Council shall not make any payment on behalf of the subscriber to the life insurance corporation nor shall he take steps to keep the policy alive. The President, T-Taryana Veterinary Council can demand and scrutinize at any time the premium receipts showing that such payments have actually been made to the Insurance Company. In the event of subscriber not furnishing the same, the Haryana Veterinary Council shall make the necessary deductions from the subscriber's pay for deposits in his fund.
Note.—(1) when a subscriber proposes to convert his policy into paid up value, it is necessary to see that the paid value of policy is not less than the amount of premium diverted from the fund. If the paid up value is less than the total of sums withdrawn from the fund from premium payments, the subscriber, shall forthwith he required to pay the differences into the fund. If, however, a subscriber proposes to have a new policy in place of the paid up one the new policy shall be assingned to the Haryana Veterinary Council.
(ii) When a subscriber proposes to surrnder the nolicY he should pay if the surrend ethe surrender value of the policy into his fund account and HARYANA GOVT GAZ., (EXTRA.), FEB. 17, 1989 437 (MAGHA 28, 1910 SAKA) • value be less than the total of the sum diverted from the funds for premium payment, he shall also pay the difference into the fund.
(iii) If a policy assigned to the Haryana Veterinary Council matures before the subscriber quits, the subscriber shall pay to the fund the whole or any amount withdrawn (with interest accrued thereon) from the fund for premium payment.
The fotlowing procedure shall be observed with regard to assignment of life Insurance Policies:—
(a) the assigned policy shall be delivered to the Haryana Veterinary Council within three months of withdrawl of any sum for the purpose of making premium payments and it shall be accompanied by a certificate from the subscriber to the effect that no prior assignment of the policy exists. The . Haryana Veterinary Council shall also verify Independently ' the fact by direct refrence to the insurance company.
(b) the noticeof the assignment of policy shall be given by the subscriber to the Insurance company and acknowledgment of the notice of the Insurance Company shall be sent by subscriber to the Haryana Veterinary Council within three months of the date of assignment :
Provided that the subscriber shall not be required to refund or ,. deposit any amount or its portion, he had contributed towards payment of premium to the life insurance corporation from his own pocket in the contributory provident fund.
(c) the Haryana Veterinary Council may reassign the policy to the subscriber for the purpose mentioned in the notice in note under clause (c) subject to the conditions mentioned therein.
(d) the assignment of the policy under this rule shall be endorsed on the policy and shall be in the following form :— "I. hereby assign to the Haryana Veterinary Council, the policy of insurance as security for payment of all sums which under clause (a) of rule 9, T may hereafter become liable to pay to the Councils Contributory Provident Fund".
10. Withdrawal, closing of account.—When a subscriber dies; the amount shown to the credit of his account in column 6 of the Contributory provident fund account ledger plus interest, accrued to date shall be withdrawn from the saving bank and payment of such amount shall be made,—
(a) if the deceased had during his/her life time made a valid declaration with regard to its payment;
(i) to his widow or widows or husband, as the case may be, and
(ii) to his child or children if there be rmore than one in such proportional as the deceased may have declared it to be payable ;

1. (1) One moiety to the widow, or widows of the deceased in equal shares or the husband of the deceased, as the case may be, and
(ii) the other moiety to his child or children if there be more than one in equal shares ; or
2. (i) to the widow or widows of the deceased in equal shares or to the husband, as the case may be, if the deceased left no child: and
(ii) to the child/children in equal shares if the deceased left ncn widow or husband, as the case may be; and (1) to his legal heirs in all other cases.
ExplanatN1,—(1) For the purpose of sub -rule (1) Subscriber's posthumous child shall be considered to be a member of his family at the time of his death and if born after shall be treated in the same way as a serviving child born before the subscriber's death.
(2) Subject to the provisions of rule 7 when subscribcr ceases to he a servant of the Haryana Veterinary Council the amount in the credit of h is account in column 6 of the contributory provident fund ledger plus interest accrued to date shall be withdrawn and paid to him:
Provided that—(a) if he is transferred otherwise than temporarily to the service of another local body which maintains a contributory provident fund or when having been transferred temporarily from the service of another local body, he reverts to such other local body: and
(b) if he is transferred temporarily to the service of another lccal body the amount shown to the credit of his account in column 6 of the contributory provident fund ledger shall not be withdrawn but shall remain to the credit on his account.
(3) Notwithstanding any thing contained in sub -rule (1) or sub -rule (2) no amount shall be withdrawn for payment to a subscriber or his heirs under the provision of these sub -rules unless such payment can be made immediately:
Provided that if such payment cannot be made within one year, if the amount at the credit of' the subscriber's contributory provident fund account is rupees ten or less, or within three years if such amount is more than ten rupees the Haryana Veterinary Council shall withdraw such amount and credit it to the current accounts of its own.
(4) When an account is closed under provisions of this rule a line shall be drawn in red ink across the page below the last entry in the Contributory provident fund ledger account and the number and date of the Voucher with which the amount at the credit of the account is deposited in the savings bank shall be recorded below this red ink.
11.
