(1) इन िनयम' का संि�5 त नाम प3रसंकटमय और अ9 य अपिश: ट ("बंधन और सीमापार सचंलन) सशंोधन िनयम, 2019 ह।ै (2) ये राजपB म� उनके "काशन क तारीख को "वृ# त ह'गे। 2. प3रसकंटमय और अ9 य अपिश: ट ("बंधन और सीमापार संचलन) िनयम, 2016 म� - (i) िनयम 3 म�, ख1 ड 39 के पF चात, िन= निलिखत खंड अ9 त:H थािपत �कया जाएगा, अथा�त् :- ''40 ''अपिश: ट संIाहक'' से ऐसा K यि& अिभ"ेत ह ैजो अिधभोगी से वाH तिवक "यो. ता या िनपटान सुिवधा के "चालक क ओर स ेप3रसंकटमय और अ9 य अपिश: ट एकिBत करता हो।'' 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ii) िनयम 6 म�, उप-िनयम (1) के पF चात, िन= निलिखत अ9 त:H थािपत �कया जाएगा, अथा�त् :- ''(1क) ऐसा अिधभोगी िजनसे राO य "दषूण िनयंBण बोड� या "दषूण िनयंBण सिमित से जल ("दषूण िनवारण और िनयंBण) अिधिनयम, 1974 (1974 का 25) और वायु ("दषूण िनवारण और िनयंBण) अिधिनयम, 1981 (1981 का 21) के अंतग�त H थापना हतुे सहमित या "चालन के िलए सहमित "ा5 त करने क अपे�ा न हो, के िलए इन िनयम' के अंतग�त "ािधकार अिभ"ा5 त करने क अपे�ा नहS होगी; परंतु अिधभोगी !ारा उ# प9 न प3रसकंटमय और अ9 य अपिश: ट को वाH तिवक "यो. ताT, अपिश: ट संIाहक' या िनपटान सिुवधा के "चालक' को के9 �ीय "दषूण िनयंBण बोड� के �दशािनदUश' के अनुसार �दया जाएगा।'' (iii) िनयम 12 म�, उप-िनयम ‘‘6क’’ का लोप �कया जाएगा; (iv) अनुसूची III म�, भाग ख म�, - (क) "िविV ‘‘ ख3010 ठोस 5 लािHटक अपिश: ट पॉिलिमथाइल मेथाXाइलेट ’’ का लोप �कया जाएगा। (ख) बेसल सं. ‘‘ख3030’’ के सामने, ‘‘िस� क अपिश: ट (रीYलंग के िलए अनुपयु. त कुसवारी, धागा अपिश: ट और तामि़डत H टॉक सिहत) श\ द' तथा को: ठक' के H थान पर श\ द' तथा को: ठक' • धुने या साफ नहS �कए +ए • अ9 य’’, के िलए िन= निलिखत रखो अथा�त् :- ‘‘िस� क अपिश: ट (रीYलंग के िलए अनुपयु. त कुसवारी, धागा अपिश: ट और तामि़डत H टॉक सिहत)** • धुने या साफ नहS �कए +ए • अ9 य **िस� क अपिश: ट के िनया�त को पया�वरण, वन और जलवायु प3रवत�न मंBालय से अनुमित क अपे�ा से छूट "ा5 त ह।ै’’ (v) अनुसूची III म�, भाग घ म�, H तंभ (2) म� बेसल सं. ख1110 के सामने, "िविVय' के पF चात अंत म� िन= निलिखत "िविVयां अ9 त:H थािपत क जाएगंी, अथा�त् :- ''य�द भारत म� िविनaम�त और िनया�ितत इलैि.bकल और इल.ै bॉिनक अस=े बली और संघटक Bु3टपूण� या B3ुटपूण� पाया जाता ह ैतो ये िनया�त क तारीख से बारह माह के भीतर मूल उपH कर िविनमा�ता (ओईएम) !ारा वापस आयात �कए जा सकते हe।’’ (vi) अनुसूची VI म�, बेसल स.ं ख3010 के सामने, H तंभ (2) म�,- (क) 3ट5 पण.- ‘‘‘‘‘‘‘‘�ट� प�ट� प�ट� प�ट� पणणणण,,,,----िवशेष आaथ�क ज़ोन वाली इकाइय' और क� �ीय सरकार !ारा अिधसूिचत िनया�त अिभमुख इकाइय' को आयात क अनुमित ह।ै’’ का लोप �कया जाएगा। (ख) ‘‘पॉलीिसलो. से9 स’’ श\ द के पF चात्, ‘‘पॉलीिमथाइल मथेाXाइलेट’’ श\ द अंत:H थािपत �कए जाएंगे। ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 (vii) "gप 1 म�, भाग घ के उप-शीष�क के अधीन शीष�क म� िन= निलिखत रखा जायेगा, अथा�त् :- ‘‘भाग घ: प3रसंकटमय और अ9 य अपिश: ट' के पुनच�Xणकता�T या पूव�-"संH करणकता�T या सह-"संH करणकता�T या अपिश: ट संIाहक' या "यो. ताT !ारा भरा जाए’ [Qk.la. 23/4/2009-एचएसएम] 3रतेश कुमार Yसंह, संयु. त सिचव �ट� प�ट� प�ट� प�ट� पण :ण :ण :ण : मूल िनयम भारत के राजपB, असाधारण, भाग ।।, खंड 3, उप-खंड (i) म�, सा.का.िन. 395(अ) तारीख 04 अ"ैल, 2016 !ारा "कािशत �कए गए थे और त# पF चात सा.का.िन. 670(अ) तारीख 6 जुलाई, 2016; सा.का.िन. 177(अ) तारीख 28 फरवरी, 2017; और सा.का.िन. 544(अ) तारीख 11 जनू, 2018 !ारा संशोिधत �कए गए थे। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 1st March, 2019 G.S.R. 178(E).—In exercise of powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government, after having dispensed with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rule in public interest, hereby makes the following rules further to amend the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, namely: -
1. (1) These rules may be called the Hazardous and Other Wastes (Management and Transboundary Movement) Amendment, Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016: -
(i) in rule 3, after clause 39, the following clause shall be inserted, namely: - “40. “waste collector” means a person who collects hazardous and other wastes on behalf of actual user or operator of disposal facility from the occupier;”;
(ii) in rule 6, after sub-rule (1), the following shall be inserted, namely: - “(1A) An occupier shall not be required obtain an authorisation under this rule, from the State Pollution Control Board, in case the consent to establish or consent to operate, is not required from the State Pollution Control Board or Pollution Control Committee under the Water (Prevention and Control of Pollution) Act, 1974 (25 of 1974) and Air (Prevention and Control of Pollution) Act, 1981 (21 of 1981);
Provided that the hazardous and other wastes generated by the occupier shall be given to the actual user, waste collector or operator of the disposal facility, in accordance with the Central Pollution Control Board guidelines.”;
(iii) in rule 12, sub-rule “6A” shall be omitted;

(iv) in Schedule III, in Part B, -
(a) the entry “ B3010 Solid plastic waste Polymethyl methacrylate ” shall be omitted;
(b) against the Basel No. “B3030”, for the words and brackets “Silk waste (including cocoons unsuitable for reeling, yarn waste and garneted stock) • Not carded or combed • Other” , the following shall be substituted, namely: - “Silk waste (including cocoons unsuitable for reeling, yarn waste and garneted stock) ** • Not carded or combed • Other ** Export of silk waste is exempted from requiring permission from the Ministry of Environment, Forest and Climate Change.”;
(v) in Schedule III, in Part D, against Basel No. B1110, in column (2), after the entries, at the end the following entries shall be inserted, namely: - “Electrical and electronic assemblies and components manufactured in and exported from India if found defective or non-functional can be imported back by Original Equipment Manufacturers (OEMs) within twelve months from the date of export.”
(vi) in Schedule VI, against Basel No. B3010, in column (2), -
(a) the Note “Note. -Import is permitted to the units in Special Economic Zones and Export Oriented Units notified by the Central Government.” shall be omitted;
(b) after the word “Polysiloxanes”, the words “Polymethyl methacrylate” shall be inserted.
(vii) in Form 1, in the heading under sub-heading Part D the following shall be substituted, namely: - “Part D: To be filled by recyclers or pre-processors or co-processors or waste collectors or users of hazardous and other wastes” [F. No. 23/4/2009-HSM] RITESH KUMAR SINGH, Jt. Secy.
Note: The principal rules were published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 395 (E), dated the 4 th April 2016 and subsequently amended vide G.S.R. 670(E) dated the 6 th July, 2016; G.S.R. 177(E) dated the 28 th February, 2017; and G.S.R. 544(E) dated the 11 th June 2018.
