PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पयाावरण, वन और जलवाय ुपररवतान मतं्रालय अजधसचूना नई ददल्ली, 12 नवम् बर, 2021 सा.का.जन. 798(अ).—कें द्रीय सरकार, पयाावरण (संरक्षण) अजधजनयम, 1986 (1986 का 29) की धारा 6, धारा 8 और धारा 25 द्वारा प्रदत्त िजियों का प्रयोग करत ेहुए, पररसंकटमय और अन्य अपजिष्ट (प्रबंध और सीमापार संचलन) जनयम, 2016 का और संिोधन करन ेके जलए जनम्नजलजखत जनयम बनाती ह,ै अथाात ्:-
1. (1) इन जनयमों का संजक्षप्त नाम पररसंकटमय और अन्य अपजिष्ट (प्रबंध और सीमापार संचलन) दसूरा संिोधन जनयम, 2021 ह ै।
(2) य ेराजपत्र में प्रकािन की तारीख को प्रवृत्त होंग े।
2. पररसंकटमय और अन्य अपजिष्ट (प्रबंध और सीमापार संचलन) जनयम, 2016 (जजसे इसमें इसके पश्चात् उि जनयम कहा गया ह)ै में, जनयम 3 के उप-जनयम (1) में, -
(i) खंड (3) में, “पररसंकटमय अपजिष्टों” िब्दों के स्ट्थान पर “पररसंकटमय और अन्य अपजिष्ट” िब्द रखे जाएंग;े
(ii) खंड 23 के स्ट्थान पर, जनम्नजलजखत खंड रखा जाएगा, अथाात् :- ‘23. “अन्य अपजिष्ट” से आयात और जनयाात के प्रयोजन के जलए अनुसूची के भाग ख और भाग घ में जवजनर्ददष्ट अपजिष्ट अजभप्रेत ह ैऔर जजसके अंतगात ऐसे स्ट्वदेिी रूप से उत्पाददत अपजिष्ट भी हैं जो समय समय पर अजधसूजचत दकए जाएं;” ।
3. उि जनयमों के जनयम 9 में, .—
(i) उप जनयम (1) के स्ट्थान पर जनम्नजलजखत उप-जनयम रखा जाएगा, अथाात ्:- स.ं 649] नई ददल्ली, सोमवार, नवम् बर 15, 2021/कार्ततक 24, 1943 No. 649] NEW DELHI, MONDAY, NOVEMBER 15, 2021/KARTIKA 24, 1943 सी.जी.-डी.एल.-अ.-16112021-231156 CG-DL-E-16112021-231156 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “(1) उत्पादक के पररसर सजहत (यदद यह प्रदिया का भाग नहीं है) एक संसाधन के रुप में पररसंकटमय अपजिष्ट का उपयोग या तो सह-प्रसंस्ट्करण या दकसी अन्य प्रयोग के जलए पूवा-संस्ट्करण, केवल कें द्रीय प्रदषूण जनयंत्रण बोडा द्वारा समय-समय पर जारी मागादिाक जसद्ांतों या प्रदियाओं के मानक प्रचालन के आधार पर अपजिष्ट के संबंध में राज्य प्रदषूण जनयंत्रण बोडा से प्राजधकार अजभप्राप्त करने के पश्चात् ही दकया जाएगा । ”;
(ii) परंतुक के पहले उप जनयम (2) के स्ट्थान पर जनम्नजलजखत उपजनयम रखा जाएगा, अथाात् :- “(2) जहां पररसंकटमय अपजिष्ट के जवजिष्ट उपयोग के जलए मानक प्रचालन पद्जतयां उपलब्ध न हों वहां कें द्रीय प्रदषूण जनयंत्रण बोडा से अनुमोदन की वांछा की जाएगी जो परीक्षणों के आधार पर अनुमोदन प्रदान करेगा और इसके पश्चात् कें द्रीय प्रदषूण जनयंत्रण बोडा द्वारा मानक प्रचालन प्रदियाएं तैयार दकए जाएंग;े”।
4. इन जनयमों में जनयम 13 के उप जनयम (2) में, खंड (ग) के स्ट्थान पर जनम्नजलजखत खंड रखा जाएगा, अथाात:्- “ग” ऐसा आयातक जो एक व् यापारी ह,ै वास्ट् तजवक प्रयो् ताओं की र से अपजि ट का या राज् य प्रदषूण जनयंत्रण बोडा द्वारा प्राजधकृत प्रयो् ताओं के उपयोग के जलए आयात करता ह,ै प्ररुप 7 में एक बारगी प्राजधकार के जलए आवेदन करेगा और प्ररुप 7क में एक बारगी प्राजधकार अजभप्राप् त करेगा और ऐसे प्राजधकार की एक प्रजत प्ररुप 6 के साथ संलग् न की जाएगी ।” ।
5. उ् त जनयमों के जनयम 19 में, उप जनयम (6) के पश् चात् जनम् नजलजखत उप जनयम अंत:स्ट् थाजपत दकया जाएगा, अथाात् :- “(7) इस जनयम के उपबंध अन् य अपजि ट पर लागू नहीं होंग ेजो अनुसूची III के भाग घ में सचूीबद् हैं ।” ।
6. उि जनयमों की अनुसूची ।।। में, (क) भाग ख में, -
(i) मद ख 2 के अधीन बेसल सं. ख2020 और उससे संबंजधत प्रजवजष्टयों का लोप दकया जाएगा;
(ii) मद ख 3 के अधीन बेसल सं. ख3020 और उससे संबंजधत प्रजवजष्टयों के पश्चात् जनम्नजलजखत रखे जाएंगे, अथाात ्:- “ख3011 ठोस प्लाजस्ट्टक अपजिष्ट जमथाइल मथेािाइलेट --टेरेफ्थालेट” (ख) भाग घ में, --
(i) स्ट्तंभ (1) में, मद ख1 और उससे संबंजधत प्रजवजष्टयों के पश्चात् जनम्नजलजखत प्रजवजष्टयां अंत:स्ट्थाजपत दकए जाएंगे, अथाात ्:- ख2 मुख्यत: अकाबाजनक संघटक वाले अपजिष्ट धात ु जजनमें धातु और काबाजनक तत्व हो सकते हैं ख2020 गैर-जवक्षेजपत रुप में कांच अपजिष्ट : कांच ्युलेट और अन्य अपजिष्ट कैथोड रे ट्यूबों और अन्य एज्टवेरटड कांच के अलावा कांच सिैप”
(ii) स्ट्तंभ (2) में, मद ख3 के अधीन, बेसल सं. ख3020 के सामने प्रथम पंजि में, िब्दों और संकेतों के स्ट्थान पर जनम्नजलजखत रखे जाएगं,े अथाात ्:- पेपर, पेपरबोडा और पेपर उत्पाद अपजिष्ट **#”;
(iii) रटप्पणी में, “**देि में आयात की अनुमजत” संकेतों और िब्दों से आरंभ होने वाले और “सत्यापन के अध्यधीन ह”ै िब्दों से अंत होन ेवाल ेखंड के स्ट्थान पर जनम्नजलजखत खंड रखे जाएंगे, अथाात् :- [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 “**देि में आयात की अनुमजत वास्ट्तजवक प्रयोिा या एक बारगी आधार पर राज्य-प्रदषूण जनयंत्रण बोडा द्वारा प्राजधकृत वास्ट्तजवक प्रयोिा के उपयोग के जलए व्यापारी को सीमािुल्क प्राजधकरण द्वारा इन जनयमों की अनुसूची VIII में जनर्ददष्ट दस्ट्तावेजों के सत्यापन के अध्यधीन ह ै। **# देि में आयात की अनुमजत वास्ट्तजवक प्रयोिा या एक बारगी आधार पर राज्य प्रदषूण जनयंत्रण बोडा द्वारा प्राजधकृत वास्ट्तजवक प्रयोिा की र से व्यापारी को सीमािुल्क प्राजधकरण द्वारा इन जनयमों की अनुसूची VIII में जनर्ददष्ट दस्ट्तावेजों के सत्यापन के अध्यधीन ह ै।”।
7. उि जनयमों की अनुसूची में, -
(i) स्ट्तंभ (1) में मद ख3 के अधीन “ख3010” िब्द और अंकों के स्ट्थान पर “ख 3011” िब्द और अंक रखा जाएगा ;
(ii) स्ट्तंभ (2) में “पाजलइजथलीन, टैररफ पैकेट” िब्दों का लोप दकया जाएगा ;
8. उि जनयमों की अनुसुची VIII में, --
(i) स्ट्तंभ (2) में बेसल सं. ख1010, ख1050 और ख1100 से संबंजधत ि.सं. 1,2 और िम सं. 3 के सामन ेमद (ड.) के स्ट्थान पर िमानुसार जनम्नजलजखत रखा जाएगा, अथाात् “(ड.) इंस्ट्टीट्यूट ऑफ स्ट्िैप ररसाइक््लग कोड या अंतरराष्ट्रीय व्यापार में प्रचजलत समतलु्य कोड में आने वाले अपजिष्टों से जभन्न आयात दकए जा रह ेअपजिष्ट की रासायजनक जवश्लेषण संबंधी ररपोटा ;” ।
(ii) ि.सं. 6 और उससे संबंजधत प्रजवजष्टयों के पश्चात ्जनम्नजलजखत अतं:स्ट्थाजपत दकए जांएगे, अथाात ्:- “7 “ख2020 गैर-जवक्षेजपत रुप में कांच अपजिष्ट : कांच ्यूलेट और अन्य अपजिष्ट और कथोड रे – ट्यूबों और अन्य एज्टवेरटड कांच से कांच के जसवाय कांच स्ट्िैप” (क) सम्यक रुप से भरा हुआ प्ररुप 6 – संचलन दस्ट्तावेज;
(ख) जवदेि व्यापार महाजनदेिालय से आयात अनजु्ञजप्त, जहां कहीं लाग ूहों;
(ग) जनयाात करने वाले देि की जनरीक्षण अजभकरण या जवदेि व्यापार महाजनदेिालय द्वारा अनुमोददत जनरीक्षण एवं प्रमाणन अजभकरण द्वारा जारी पूवा-जिपमेंट जनरीक्षण प्रमाणपत्र;
(घ) वास्ट्तजवक प्रयोिाओं के जलए वायु (प्रदषूण जनवारण और जनयंत्रण) अजधजनयम, 1981 (1981 का 14) और जब (प्रदषूण जनवारण तथा जनयतं्रण) अजधजनयम, 1974 (1974 का 6) के अधीन काया करने के जलए और इन जनयमों के अधीन प्राजधकार के जलए सहमजत पत्र । व्यापाररयों के जलए केवल संबंजधत राज्य प्रदषूण जनयंत्रण बोडा से जवजधमान्य प्राजधकार अपेजक्षत ह ै। (ङ) आयात दकए जा रह े अपजिष्ट की रासायजनक जवश्लेषण संबंधी ररपोटा;
(च) जपछल े जवत्तीय वषा में आयात के जलए संबंजधत राज्य प्रदषूण जनयंत्रण बोडा को फाइल की गई वार्तषक जववरणी की पावजत की प्रजत ।” ।
9. उि जनयमों के प्ररुप 4 में, -
(i) “(उत्पादवार) जहां कहीं प्रयोज्य हो “कोष्ठकों और िब्दों से अंत होन ेवाले ि. सं. 4 के पश्चात् जनम्नजलजखत अंत:स्ट्थाजपत दकया जाएगा, अथाात ्:- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “4क. भाग क. के िीषाक में “पररसंकटमय अपजिष्ट के उत्पन्नकताा” िब्दों के स्ट्थान पर “पररसंकटमय अपजिष्ट के उत्पन्नकताा या आयातकताा” िब्द रखे जाएगंे ।
(ii) भाग क. के िीषाक में “पररसंकटमय अपजिष्ट के उत्पन्नकताा” िब्दों के स्ट्थान पर “पररसंकटमय अपजिष्ट के उत्पन्नकताा या आयातकताा” िब्द रखे जाएंगे ।
10.उि जनयमों के जनयम 7 में, --
(i) िम सखं्या 3 और उससे संबंजधत प्रजवजष्टयों के स्ट्थान पर जनम्नजलजखत रखा जाएग, अथाात् :- “3. इंस्ट्टीट्यूट ऑफ स्ट्िैप ररसाइक््लग कोड या दकसी अन्य समतुल्य कोड के साथ वणान जहां कहीं लागू हो या आयात दकए जा रह ेअपजिष्ट का और उसकी क्वाजलटी का सजम्मश्रण”;
(ii) ि. सं. 5 और उससे संबंजधत प्रजवजष्टयों के स्ट्थान पर, जनम्नजलजखत ि. सं. और प्रजवजष्टयां रखी जाएंगी, अथाात ्:- “(5क) प्राजधकृत वास्ट्तजवक प्रयोि (प्रयोिाओं) का (के) नाम और पता : (बेसल सं. ख3020 का आयात के जलए लाग ू (पेपर, पेपर बोडा और पेपर उत्पाद अपजिष्ट);
(5ख) भावी वास्ट्तजवक प्रयोिा का नाम और पता (अन्य अपजिष्टों की आयात के जलए लागू)” ।
11. उि् जनयमों में प्ररुप 7 के पश्चात् जनम्नजलजखत प्ररुप रखा जाएगा, अथाात ्:- “प्ररूप 7क [जनयम 13(2)(ग) देखें] ऐस ेव् यापाररयों को, जो अनसुचूी 3 के भाग घ में उजल् लजखत अपजि ट का आयात कर रह ेहैं, राज् य प्रदषूण जनयतं्रण बोडा द्वारा एकबारगी प्राजधकार प्रदान करन ेके जलए प्ररूप
1. प्राजधकार सखं् या:-
2. सदंभा:-- पररसंकटमय और अन् य अपजि ट (प्रबंध और सीमा पार संचलन) जनयम, 2016 की अनुसूची के भाग घ के अनुसार अपजि ट के आयात के जलए व् यापाररयों के प्राजधकार के जलए आवेदन प्ररूप (जवजि ट आवेदन संख् या) तारीख........
3. [व् यापारी का नाम और पता], जजसकी --------------------पर भडंारण अवजस्ट् थजतया ंहैं, को अनुसूची 3 के भाग घ में अंतर्तव ट अन् य अपजि ट के आयात, भंडारण और व् यापार करने के जलए जनम् नानुसार प्राजधकार प्रदान दकया जाता ह:ै ि.सं. पररसंकटमय और अन् य अपजि ट (प्रबंध और सीमा पार संचलन) जनयम, 2016 की अनुसूची के भाग घ के अनुसार अन् य अपजि ट का नाम और बैसल संख् या वास्ट् तजवक या भावी उपयोगकतााओं की सूची और जवस्ट् तृत पता* मात्रा (टन/एनम) (आवश् यकतानुसार अजतरर् त पजं् तयां जोेंें) *- प्रत् यके अन् य अपजि ट के जलए जवस्ट् तृत सूची संलग् न की जा सकेगी ।
4. पररसंकटमय और अन् य अपजि ट (प्रबंध और सीमा पार संचलन) जनयम, 2016 के जनयम 13 के उपजनयम (2) के खंड (ग) के उपबंधों के अनुसार प्राजधकार प्रदान दकया जाता ह ै।
5. यह प्राजधकार जनम् नजलजखत साधारण और जवजनर्दद ट िततों के अध् यधीन होगा:- क. साधारण ितें:
(i) प्राजधकृत व् यज् त, पयाावरण (संरक्षण) अजधजनयम, 1986 (1986 का 29) और उसके अधीन बनाए गए जनयमों के उपबंधों का पालन करेगा ।
(ii) यह प्राजधकार, राज् य प्रदषूण जनयंत्रण बोडा द्वारा प्राजधकृत दकसी अजधकारी के अनरुोध पर जनरीक्षण के जलए उपलब् ध कराया जाएगा । [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 5
(iii) प्राजधकृत व् यज् त, इस प्राजधकार के माध् यम से अनुज्ञात अपजि ट से जभन् न अन् य आयाजतत अपजि टों का आयात, भंडारण और व् यापार नहीं करेगा ।
(iv) प्राजधकृत व् यज् त राज् य प्रदषूण जनयंत्रण बोडा को भंडारण अवजस्ट् थजत में पररवतान या भंडारण सुजवधा की बंदी के संबंध में सूजचत करेगा ।
(v) ऐसे अपजि ट का, जो अन् य आयाजतत अपजि ट के भंडारण और व् यापार के दारान जजनत होता ह,ै उपचार और जनपटान प्रचजलत जवजनयमों के अनुसार दकया जाएगा ।
(vi) आयातक, आयात के खचा का वहन करेगा और नुकसानी में, यदद कोई आयात, भंडारण और व् यापार की प्रदिया के दारान काररत हो कमी करेगा, ।
(vii) यथाजस्ट् थजत पयाावरण, वन और जलवायु पररवतान मंत्रालय या केन् द्रीय प्रदषूण जनयंत्रण बोडा द्वारा समय-समय पर जारी मागादिाक जसद्ांतों के अनुसार अनुपालन के जलए कोई अन् य ितें ।
(viii) वार्तषक जववरणी प्ररूप 4 के अनुसार दकसी वषा के 31 माचा तक की अवजध के जलए 30 जून तक फाइल की जाएगी ।
(ix) प्राजधकृत व् यापारी ऐसी अन् य कानूनी अनुज्ञाए ंप्राप् त करन ेके जलए उत् तरदायी होगा जो अपेजक्षत की जाएं । ख. अन् य अपजि ट के भडंारण और हथालन की बाबत जवजनर्दद ट ितें:

सा.का.जन. सं. 641(अ), तारीख 9 अ् तूबर, 2020 और सा.का.जन. सं. 47(अ), तारीख 27 जनवरी, 2021 द्वारा पश् चात्वतस संिोधन दकए गए । MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 12th November, 2021 G.S.R. 798(E).—In exercise of powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government, herebymakes the following rules further to amend the Hazardous and Other Wastes (Management and Trans boundary Movement) Rules, 2016, namely: -
1. (1) These rules may be calledthe Hazardous and Other Wastes (Management and Transboundary Movement) Second Amendment Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 (hereinafter referred to as the said rules), in rule 3, in sub- rule (1),-
(i) in clause(3), for the words ―hazardous wastes‖, the words ―hazardous and other wastes‖ shall be substituted;
(ii) for clause(23), the following clause shall be substituted, namely: - 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ‗23. ―other wastes" means wastes specified in Part B and Part D of SCHEDULE III for the purpose of import and export and include such indigenously produced wastes as may be notified from time to time;‘‘.
3. In the said rules, in rule 9, -
(i) for sub-rule (1), the following sub-rule shall be substituted, namely:- ‗‗(1) The utilisation of hazardous wasteas a resource or after pre-processing either for coprocessing or for any other use, including within the premises of the generator (if it is not part of process), shall be carried out only after obtaining authorisation from the State Pollution Control Board in respect of wastes on the basis of standard operating procedures or guidelines issued by the Central Pollution Control Board from time to time.‘‘;
(ii) for sub-rule (2), before the proviso, the following sub-rule shall be substituted, namely: - ‗‗(2) Where standard operating procedures are not available for specific utilisation of hazardous waste, the approval has to be sought from the Central Pollution Control Board which shall be granting approval on the basis of trial runs and thereafter, standard operating procedures shall be prepared by the Central Pollution Control Board:‘‘.
4. In the said rules, in rule 13, in sub-rule (2), for clause (c), the following clause shall be substituted, namely: - ‗‗(c) importer who is a trader, importing waste on behalf of actual users or for use of the actual users authorised by State Pollution Control Board, shall apply in Form 7 for onetime authorisation and obtain one-time authorisation in Form 7A and copy of such authorisation shall be appended to Form 6.‘‘.
5. In the said rules, in rule 19, after sub-rule (6), the following sub-rule shall be inserted, namely: - ―(7) The provisions of this rule shall not be applicable to other wastes as listed in Part D of
SCHEDULE III.‘‘.
6. In the said rules, in SCHEDULE III,
(a) In part B, -
(i) under item B2, the Basel Number B2020 and the entries relating thereto shall be omitted;
(ii) under item B3, for Basel Number B3010 and the entries relating thereto the following shall be substituted, namely: - ‗‗B3011 Solid plastic waste - Polymethyl methacrylate - Polyethylene terephthalate‘‘
(b) in Part D, -
(i) in column (1) after item B1 and the entries relating thereto the following shall be inserted, namely: - B2 Wastes containing principally inorganic constituents, which may contain metals and organic materials ‗‗B2020 Glass wastes in non-dispersible form:
- Cullet and other waste and scrap of glass except for glass from cathode-ray tubes and other activated glasses‘‘
(ii) In column (2), under item B3, against Basel No. B3020, in the first line, for the words and symbols, the following shall be substituted, namely: - ‗‗Paper, paperboard, and paper product wastes ** # ‘‘ ;
(iii) in the Note, for the clause beginning with the symbols and words ― ** Import permitted in the country‖ and ending with the words ―Custom Authority‖, the following clauses shall be substituted, namely: - [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 7 ―** Import permitted in the country to the actual user or to the trader for use of the actual users authorised by State Pollution Control Board on one-time basis and subject to verification of documents specified in Schedule VIII of these rules by the Custom Authority.

7. In the said rules, in SCHEDULE VI, -
(i) in column (1) under item (B3) for the letter and figures, ―B 3010‖, the letter and figures ‗‗B 3011‖ shall be substituted;
(ii) in column (2) the words ‗‗polyethylene terephthalate‘‘ shall be omitted;
8. In the said rules, in SCHEDULE VIII,-
(i) in Column (2) against serial numbers 1, 2 and 3 relating to Basel Nos. B1010, B1050 and B1100 for item (e), the following shall respectively be substituted, namely: - ‗‗(e) The Chemical analysis report of the wastes being imported other than wastes covered under the Institute of Scrap Recycling Industries (ISRI) code or equivalent code prevalent in international trade;‘‘.
(ii) after S. No. 6 and the entries relating thereto the following shall be inserted, namely: - ‗‗7. ‗‗B2020 Glass wastes in nondispersible form:
- Cullet and other waste and scrap of glass except for glass from cathoderay tubes and other activated glasses‘‘
(a) Duly filled up Form 6 - Movement document;
(b) The import license from Directorate General of Foreign Trade, wherever applicable;
(c) Pre-shipment inspection certificate issued by the inspection agency of the exporting country or the inspection and certification agency approved by Directorate General of Foreign Trade;
(d) The consent to operate under the Air (Prevention and Control of Pollution) Act, 1981 (21 of 1981) and the Water (Prevention and Control Pollution) Act, 1974 (25 of 1974) and the authorisation under these rules, for actual users. For traders, only valid authorisation from concerned State Pollution Control Board is required;
(e) The chemical analysis report of the waste being imported;
(f) an acknowledged copy of the annual return filed with concerned State Pollution Control Board for import in the last financial year.‘‘.
9. In the said rules, in Form 4,–
(i) after serial number 4 ending with the brackets and words ‗‗(product wise), wherever applicable, the following shall be inserted, namely: - ‗‗4a. Import of wastes during the year (waste-wise), wherever applicable‘‘;
(ii) in Part A, in the heading, for the words ―hazardous waste generators‖, the words 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ―hazardous waste generators or importers‖ shall be substituted.
10. In the said rules, in Form 7,–
(i) for serial number 3, and the entries relating thereto the following shall be substituted, namely: - ‗‗3. Description along with Institute of Scrap Recycling Industries (ISRI) or any other equivalent code where applicable or composition of the waste being imported and the quantity‘‘;
(ii) for serial number 5 and the entries relating thereto, the following serial numbers and entries shall be substituted, namely: - ‗‗(5a). Name and address of authorised actual user (s): [Applicable for import of Basel No.
B3020 (Paper, paperboard and paper product wastes);
(5b). Name and address of prospective actual user [Applicable for import of other wastes]‘‘.
11. In the said rules, after Form 7, the following Form shall be inserted, namely: -

4. This authorisation is granted as per the provisions of clause (c) of sub-rule (2) of rule 13, of Hazardous and Other Waste (Management and Transboundary Movement) Rules, 2016.
5. This authorisation is subject to the following general and specific conditions:- A. General conditions:
(i) The authorised person shall comply with the provisions of the Environment (Protection) Act, 1986 (29 of 1986), and the rules made thereunder.
(ii) This authorisation shall be produced for inspection at the request of an officer authorised by the State Pollution Control Board.
(iii) The person authorised shall not import, store and trade in the imported other wastes other than those wastes permitted through this authorisation.

(iv) Authorised person shall intimate the State Pollution Control Board regarding change in the storage location or closure of storage facility.
(v) The waste which gets generated during storage and trading of imported other wastes shall be treated and disposed of as per prevailing regulations.
(vi) The importer shall bear the cost of import and mitigation of damages if any caused during the process of import, storage and trading.
(vii) Any other conditions for compliance as per the Guidelines issued by the Ministry of Environment, Forest and Climate Change or the Central Pollution Control Board, as the case may be, from time to time.
(viii) Annual return as per FORM 4 shall be filed by June 30 th for the period ensuring 31 st March of the year.
(ix) The Authorised Trader shall be responsible to obtain other statutory permissions as may be required.
