PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY जिजध और न् याय मतं्रालय (न् याय जिभाग) अजधसचूना नई ददल् ली, 23 अगस्ट् त, 2022 सा.का.जन. 649(अ).—केन् रीय सरकार, उच् चतम न् यायालय न् यायाधीि (िेतन और सेिा ित ) अजधजनयम, 1958 (1958 का 41) की धारा 24 की उपधारा (1) और उपधारा (2) के खंड (ग) और (च) द्वारा प्रदत् त िजत तयक का प्रय ग करत े हुए उच् चतम न् यायालय न् यायाधीि जनयम, 1959 का और संि धन करने के जलए जनम् नजलजखत जनयम बनाती ै , अथाात् :-
1. (1) इन जनयमक का संजिप् त नाम उच् चतम न् यायाधीि (संि धन) जनयम, 2022 ै ।
(2) य ेराजपत्र में इनके प्रकािन की तारीख क प्रिृत् त ैकग े।
2. उच् चतम न् यायालय न् यायाधीि जनयम, 1959 (जजसे इसमें इसके पश् चात् उत त जनयम कैा गया ै ) के जनयम 3ख के उप जनयम (3) में, परंतुक के पश् चात् जनम् नजलजखत परंतुक अतं:स्ट् थाजपत दकया जाएगा, अथाात:- “परंत ु यै और दक सेिाजनिृत् त मु् य न् यायमूति त और उच् चतम न् यायालय के सेिाजनिृत् त न् यायाधीि के साथ जनम् नजलजखत कमाचािरिंृद, उच् चतम न् यायालय या उच् च न् यायालय के स्ट् थापन से उच् चतम न् यायालय के जनयजमत कमाचािरयक क अनुज्ञेय पूणा िेतन और भत् तक के साथ सेिाजनिृजत की तारीख से एक ि ा की अिजध के जलए जनय जजत दकए जाएंगे:- (क) चालक (उच् चतम न् यायालय में चालक के स्ट् तर के समतलु् य) (ख) सजचिालजयक सैायक (उच् चतम न् यायालय में िाखा अजधकारी के स्ट् तर के समतलु् य) ।” ।
3. उत त जनयमक के जनयम 3ख के पश् चात ्जनम् नजलजखत उप जनयम अंत:स्ट् थाजपत दकया जाएगा, अथाात:- स.ं 574] नई ददल्ली, मगंलिार, अगस्ट् त 23, 2022/भार 1, 1944 No. 574] NEW DELHI, TUESDAY, AUGUST 23, 2022/BHADRA 1, 1944 सी.जी.-डी.एल.-अ.-23082022-238277 CG-DL-E-23082022-238277 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “3ग. सुरिा किच.— भारत के सेिाजनिृत् त मु् य न् यायमूति त और उच् चतम न् यायालय के सेिाजनिृत् त न् यायाधीि, सेिाजनिृजत् त की तारीख से एक ि ा की अिजध के जलए 24 घटें ि यजत तक सुरिा गाडा के अजतिरत त जनिास स्ट् थान पर 24 घंटे सुरिा किच के ैकदार ैकगे।” ।
4. उत त जनयमक के जनयम 4 में, स्ट् पष् टीकरण से पैल ेजनम् नजलजखत परंतुक अंत:स्ट् थाजपत दकया जाएगा, अथाात:- “परंत ु सेिाजनिृत् त मु् य न् यायामूति त, सेिाजनिृजत् त की तारीख से छै मास की अिजध के जलए ददल् ली में टाइप-VII (पदाजभजैत िासकीय िास-सुजिधा से जभन् न) दकराया मुत त िास-सुजिधा के ैकदार ैकगे।” ।
5. उत त जनयमक के जनयम 5 के पश् चात् जनम् नजलजखत जनयम अतं:स्ट् थाजपत दकया जाएगा, अथाात:- “5क. नयाचार.— सेिाजनिृत् त मु् य न् यायामूति त और सेिाजनिृत् त न् यायाधीि, जिमानपत् तनक के समार ै जि्ाम किक में जिस्ट् तािरत जिष् टाचार के नयाचार के ैकदार ैकगे । [फा.सं. एल-11017/1/2020-न् या.-I] नीरज कुमार गयागी, संयुत त सजचि पाद िटप् पण: मूल जनयम सा.का.जन. सं. 935, तारीख 4 अगस्ट् त, 1959 पृष् ठ 1161(गृै मंत्रालय, सं. 15.6.58-न् या.-I) द्वारा भारत के राजपत्र, भाग II, खंड 3, उपखंड (i) में प्रकाजित दकए गए थे और जनम् नजलजखत द्वारा पश् चातित संि धन दकया गया:-

18. सा.का.जन. 531(अ), तारीख 4 अगस्ट् त, 2021 [भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 MINISTRY OF LAW AND JUSTICE (Department of Justice) NOTIFICATION New Delhi, the 23rd August, 2022 G.S.R. 649(E).—In exercise of the powers conferred by sub-section (1) and clauses (c) and (f) of sub-section (2) of section 24 of the Supreme Court Judges (Salaries and Conditions of Service) Act, 1958 (41 of 1958), the Central Government hereby makes the following rules further to amend the Supreme Court Judges Rules, 1959, namely:-
1. (1) These rules may be called the Supreme Court Judges (Amendment) Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Supreme Court Judges Rules, 1959 (hereinafter referred to as the said rules), in rule 3 B, in sub-rule (3), after the proviso, the following proviso shall be inserted, namely:- “Provided further that the following staff shall be deployed with a retired Chief Justice and a retired Judge of Supreme Court for a period of one year from the date of retirement from the establishment of Supreme Court or a High Court with full pay and allowances admissible to regular employees of Supreme Courta) chauffeur (equivalent to the level of Chauffer in the Supreme Court). b) secretarial assistant (equivalent to the level of the Branch Officer in the Supreme Court).”.
3. After rule 3 B of the said rules, the following rule shall be inserted, namely:- “3 C. Security Cover.- A retired Chief Justice or retired Judges shall be entitled to a security cover round the clock at residence in addition to round the clock personal security guard for a period of one year from the date of retirement.”.
4. In rule 4 of the said rules, before the explanation, the following proviso shall be inserted, namely:- “Provided that a retired Chief Justice shall be entitled to a rent free Type-VII accommodation at Delhi (other than the designated official residence) for a period of six month from the date of retirement.”.
5. After rule 5 of the said rules, the following rule shall be inserted, namely:- “5 A.Protocol.- A retired Chief Justice or a retired Judge shall be entitled to protocol to extend courtsies at ceremonial lounges at airports.
