Section 20: Damages

The High Court of Jharkhand Hindu Marriage Rules, 2017State Rules of Jharkhand · 1955

Any husband may, in petition for divorce, claim damages from the corespondent on the ground of his having committed adultery with the wife of such petitioner-

(i) Such petition shall be served on the said co-respondent and the wife unless the Court dispenses with such service in accordance with the provisions of rule 15.

(ii) The damages to be recovered on any such petition shall be ascertained by the Court although the respondent or either of them may not appear.

After the Court decision has been given, the Court may direct in what manner the damages shall be paid or applied.
