Section 63: Power to remove encroachments in the market yard

(1) Any officer or servant of the Committee or the Board empowered by the State Government, by notification, in this behalf shall have the power to remove any encroachment over the property owned by the Board or the Committee including the market yard, and the expenses of such removal shall be paid by the encroacher, if he fails to pay such expenses, the same shall be recovered in the same manner as arrears of land revenue.

(2) All the Police Officers shall be bound to assist the officers empowered under sub-section (1), when required, in the performance of their duties under this Act, and for that purpose, shall have the same powers which they have in the discharge of their ordinary police duties.

(3) If any officer or servant of the Board or the Committee empowered under sub-section (1) fails to remove the encroachment within the market yard, he shall be punished with simple imprisonment which may extend to H. P. AGRICULTURAL AND HORTICULTURAL PRODUCE MARKETING (DEVELOPMENT AND REGULATION) ACT, 2005 38 three months or with fine which may extend to one thousand rupees or with both.
