Section 40: Power of Director to withdraw and transfer petitions

The Director may, at any stage after notice to parties and for reasons to be recorded, withdraw any election petition pending before a prescribed authority 16 H. P. AYURVEDIC AND UNANI PRACTITIONERS ACT, 1968 and transfer it for trial to another prescribed authority; and upon such transfer, that prescribed authority shall proceed with the trial from the stage at which it was withdrawn:

Provided that such authority may, if it thinks fit, recall and re-examine any of the witnesses already examined
