Where it appears to the competent authority, after such enquiry as it thinks fit to make, that any porter employed for the assistance of the climbing/trekking parties, has been recruited otherwise than in accordance with the provisions of this Act, the competent authority may direct that such porter shall be discharged and returned to his home by and at the cost of the employer.
