Section 48: Death of a candidate before poll

If a candidate whose nomination has been found valid on scrutiny and who has not withdrawn his candidature, dies and a report of his death is received before the commencement of the poll and the number of remaining contesting candidates is more than one the election shall not be countermanded but in case there remains only one candidate in the field, the election shall take place de-novo as per the directions of the State Election Commission:

Provided that no fresh nomination shall be necessary for a candidate who was a contesting candidate at the time of countermanding of the election.
