Section 82: Seizure and confiscation

the Himachal Pradesh Minor Minerals (Concession) and Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2015State Rules of Himachal Pradesh · 1957

(1) whenever any person raises or causes to be raised without any lawful authority, any mineral from any land and for that purpose, uses any tool, equipment or any other thing shall be liable to be seized by an official or authority especially empowered in this behalf by the Government under sub-section (4) of the section 21 of the Act.

(2) Any mineral, tools, equipment or any other thing seized under sub-rule (1), shall be liable to be confiscated by an order of the court competent to take cognizance of the offence under rules 73 & 78 and shall be disposed of in accordance with the directions of such court.
