Government of Himachal Pradesh Department of Home No. Home (A)A(3)-2/2007-IV Dated : Shimla-171002, 17.12. 2019 Notification WHEREAS, the draft Himachal Pradesh Police Department (Appointment 0f Special Police Officers) Rules, 2019 were published in the Rajpatra (e-Gazette), Himachal Pradesh, vide this Department’s Notification of even number dated 31.08.2019 for inviting objection(s) and suggestion(s) from the persons likely to be affected thereby, as required under sub-section (1) of section 141 of the Himachal Pradesh Police Act, 2007 (Act. No.7 of 2007);
AND WHEREAS, no objection(s) and suggestion(s) has been received within the stipulated period by the State Government in this behalf;
NOW THEREFORE, in exercise of the powers conferred under section 19 read with section 141 of Himachal Pradesh Police Act, 2007 (Act No.17 of 2007), the Governor, Himachal Pradesh is pleased to make the following rules,namely:-
1. Short title and commencement.
(1) These rules may be called the Himachal Pradesh Police Department (Appointment of Special Police Officers) Rules, 2019.
(2) These rules shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.
2.
Age and qualification.
(1) Candidate appearing in the test for the post of Special Police Officer should have completed 18 years 8 of age and should not have crossed 35 years of age as on the last date of making application; and
(2) Candidate must have passed 10th class from any recognized University/Board.
3 Out- Door Test. The Out Door test will be conducted as under ;

The candidates who qualify out-door test will be interviewed by a three member committee headed and constituted by the Superintendent of Police. Interview 9 will be of 5 marks.
5 Appointment/Engagement. Appointment of Special Police Officers will be made Police Station wise and candidates belonging to the Police Station concerned are only eligible to appear in the test conducted for the Police Station concerned.
The candidates belonging to other Police Station shall not be allowed to appear in the test.
6 Advertisement The date and time for conducting Police Station wise test for the selection of Special Police Officers will be published in the local daily news paper.
7. Appointing authority Superintendent of Police will be the final appointing authority for Special Police Officers.
8. Merit list On the basis of out-door test and interview, the Superintendent of Police will cause to be prepared a Police Station wise merit list, of all the candidates. The vacancies will be filled up as per Police Station wise merit list. The vacancies arising subsequently will be filled up from the same merit list which will be valid for a period of one year only.
10 9 Terms and conditions.
(1) Special Police Officers will be engaged initially for a period of 89 days and can be re-engaged further by giving a break of one day, if the conduct and performance of the Special Police Officers remains satisfactory. In no case a Special Police Officers shall be engaged for a period of more than five years. Only those candidates shall be given appointment who are not involved in any kind of criminal activities in the past and are neither bound down by a court for good behavior.
(2) In case a Special Police Officer is found indisciplined or involved in criminal case/act or inefficient in the discharge of his duties, his services can be terminated without giving any notice, by the Superintendent of Police.
(3) Special Police Officers will be attached with Police Station, Police Posts, Company Head Quarters, Out Check Post/Barrier Check Posts and other places where their services are considered necessary.
(4) Special Police Officers will be given an honorarium as fixed by the State Government from time to time.
(5) No honorarium will be paid against absentee period.
(6) Special Police Officers can seek permission to 11 proceed on leave from the in-charge concerned.
They will be entitled to avail 4 days leave in lieu of Sundays per month. However, they can be refused leave in view of exigencies of duties.
(7) Special Police Officers during their period of engagement shall be insured for a sum of Rupees 10 lacs in case of death on duty, by the Government. In case of suffering from any disability the compensation will be granted by the State Government as per norms provided under the Workman Compensation Act and in addition they shall be entitled for fixed medical allowance as decided from time to time.
(8) Special Police Officers will be given training for one week at the concerned Police Station /Company Headquarters of their sector of deployment and for this period they will get honorarium. The training shall include intelligence collection, handling of arms, right of private defence, duties of public to give information about certain offences etc.
(9) Special Police Officers will assist in patrolling, nakabandi, long range patrolling duties etc.
(10) Special Police Officers will collect intelligence of the local area, particularly about the visits of unknown/suspected persons in the village and will convey the same as soon as possible to the 12 nearest Police Station /Police Post for further necessary action/ verification as the case may be.
(11) Special Police Officers will also inform the officer in charge of Police Station/ Police Post with regard to the absence of persons of locality for a considerable period.
(12) Special Police Officers will work under the directions of Station House Officers, In-charge of Police Post, Company Commander, Incharge Out Check Post (OCP)/Barrier where they are attached.
(13) The Incharge, where Special Police Officers are attached will report about each Special Police Officer indicating the actual work done by him i.e. No. of patrolling / Long Range Patrolling done, No. of days spent on intelligence collection, making liaison with Village Defense Committee members and any other work assigned.
(14) Special Police Officers will be held personally responsible for maintenance and safety of the weapons issued to them. Superintendent of Police will ensure that an Armourer from the District/Battalion which is deployed in the border area, visits the Outer Check Posts and clean the weapons issued to Special Police 13 Officers.
(15) Superintendent of Police will send a consolidated report regarding the details of intelligence collected and other important observations made during the Long Range Patrolling by the Special Police Officers by 10th of every month to Additional Director General of Police, Armed Police And Training and /or to any other authority as may be directed by the Director General of Police.
