1. Delhi Old Age Assistance Rule, 1975.—As published in the Delhi Gazette vide Notification No. 54(A-16)/ 74-DSW/Plg. dated 2-11-1975.
Addition to Rule 5.—May be read as Rule 5(a). The prescribed application form may be submitted to the concerned District Social Welfare Officer with the recommendation of the area MLA/MP or a Gazetted Officer of the Central/Delhi Govt.
2. Financial Assistance Scheme for Widows for performing marriage of their Daughter or Marriage of orphan girls.—As published in the Delhi Gazette vide Notification No. F. 1(4)/FAS/WDM/DSW/2005-06/25008- I dated21-09-2006 :— A mend men t of Rule 6(2).—The prescribed application form may be submitted to the concerned District Social Welfare Officer with the recommendation of the area MLA/MP or a Gazetted Officer of the Central/Delhi Govt.
3. National Family Benefit Scheme.—(Central Scheme adopted by the State Govt.) F. 8(1)/FAS/DSW/ NSAP/96.

'7-4 "ffW.—W *VI tr( fel* Tiffigrii 1,4,4 v-4r4 * f 114T-trri Twig 'ffe -ffw real? twrot * realm za 3rfwtO mierft (114i4 41-4 rates? * dvor,NiertaftTErN artaiTtarri.t. f i i -er 374-4-r • %Hit, TIN-4 DEPARTMENT OF TRAINING AND TECHNICAL EDUCATION NOTIFICATION Delhi, the 17th July, 2008 No. F. 196/EDCIL/2006/DTTE/Part-III/10.18.—In exercise of the powers conferred by sub-section (1) of Section 23 read with Section 22 of the HIT (Indraprastha Institute of Information Technology)—Delhi Act, 2007 (Delhi Act 5 of 2008), the Government of National Capital Territory of Delhi, after obtaining the prior approval of the Chancellor, hereby, makes the following Statutes of the Indraprastha Institute of Information Technology, Delhi, namely :-
1. Short title and Commencement.—(1) These Statutes may be called the IIIT (Indraprastha Institute of Information Technology), Delhi Statutes, 2008.
(2) They shall come into force with effect from 10th July, 2008.
2. Detinitions,—In these Statutes, unless the context otherwise requires,—
(a) "Act" means the HIT (Indraprastha Institute of Information Technology), Delhi Act, 2008 (Delhi Act 5 of 2008);
(b) "clause" means a clause of the Statutes in which that expression occurs;
(c) "Finance Committee" means the Finance Committee of the Institute;
(d) "section" means a section of the Act;
(e) "Teachers and academic staff" means Professor, Associate Professor, Assistant Professor and other academic staff of the Institute.
(2) Words and expressions used but not defined in these Statutes shall have the meanings assigned to them in the Act.
3. The Chancellor and Functions.—The Chancellor, by virtue of his office, shall be the Chairman of the General Council.
4. General Council.—(1) Within six months from the close of each financial year, the General Council shall meet on such date as may be decided by the General Council to consider and adopt audited accounts of the institute and annual report on the working of.the Institute during the previous year.
(2) The General Council shall meet whenever the Chancellor thinks fit, provided that the Chairman, Board of Governors shall call a meeting of the General Council upon a written request from not less than one-third of the existing members (fraction being rounded off to the next higher number), whichever is more. In addition, the General Council shall meet whenever the Chairman recommends the same for transaction of urgent business.
(3) For every meeting of the General Council at least fourteen days clear notice shall be given to the members, excluding the day of the posting the notice and day of the meeting. However, in the case of any urgency, the Chairman, with the permission of the Chancellor, may call a meeting of the General Council at shorter notice.
(4) One-third of the existing members including the Chancellor shall constitute the quorum at any meeting of the General Council, any fraction being rounded off to the next higher number.
(5) In case, the quorum is not present within thirty minutes of the time notified for the commencement of meeting, the meeting if called on the requisition of the members shall stand dissolved.
(6) The decisions of the General Council shall be by a simple majority of the members present and voting.
(7) Every meeting of the General Council shall be chaired by the Chancellor, and in his absence, by the Chairman, Board of Governors.
(8) Each member of the General Council, who has a votinsg right, shall have one vote and if there be an equality PAT IV] DELHI GAZETTE : EXTRAORDINARY 9 of votes on any question to be determined by the General Council, the Chairperson of the meeting in addition to his own right as a member shall have and exercise a casting vote to decide the issue.
5. The Board of Governors.—(1) The Board of Governors shall have the overall power of management and administration of the Institute.
(2) The Board of Governors will lay down policies for the functioning of the institute and for the manner of implementation of these policies.
(3) Subject to the povisioni of the Act, the Statutes and the Ordinances, the Board of Governors shall, in addition to the other powers vested in it by and under the Act and Statutes, have the following powers, namely :—
(a) to make appointments or to enter into contract with such Professors, Associate Professors, Assistant Professors and such academic staff, as may be necessary, on the recommendations of the selection committee constituted for the purpose;
(b) to make appointments to temporary vacancies of any academic staff;
to specify the manner of appointment to temporary vacancies of the academic staff;
(d) to provide for the appointment of visiting professors, and determine the terms and conditions of such appointment; •
(e) to create administrative, ministerial and other necessary posts after taking into account the recommendations of the Finance Committee and to specify the manner of appointment thereto;
to regulate and enforce discipline amongst the employees in accordance with the Statutes and the Ordinances;
to delegate any of its powers to the Director, and 'on the recommendations of the Director to the Registrars, the Controller of Finance or any other Officer, employee for authority of the Institute or to a Committee appointed by it.
(4) The Board of Governors shall exercise all the powers of the Institute not otherwise provided for by the Act,the Statutes, the Ordinances and the Regulations for the fulfillment of the objects of the Institute.
(5) The Chairman, Board of Governors shall convene or cause to be convened meetings of the General Council, with the approval of the Chancellor.
(6) Meeting of the Board of Governors
(a) The Board of Governors shall ordinarily meet once every three months provided that the Chairman or Director, with the permission of the Chairman, may whenever thinks fit, or, on a written requisition of not less than one-third of the existing members of the Board of Governors (fraction being rounded off to next higher number) call for a meeting. Not less than seven days notice shall be given for every 211S b 603 meeting of the Board of Governors. In case of urgnecy, the Chairman or the Director, with the permission of the Chairman, may call for a meeting at a shorter notice:
Provided that the interval between the two consecutive meetings of the Board of Governors shall not exceed six moths.
(b) One-third of the existing strength of the Board of Governors or five members, whichever is higher shall constitute a quorum for any meeting of the Board of Governors, any fraction being rounded off to the next higher number.
(c) The decisions of the Board of Governors shall be by a simple majority of the members present and voting.
(d) Each member of the Board of Governors including the Chairman shall have one vote and if there shall be an equality of votes on any question to be determined by the Board of Governors, the Chairperson of the meeting shall in addition to his own vote have and exercise a casting vote to decide the issue.
(e) Every meeting of the Board of Governors-shall be chaired by the Chairman, and in his absence, by one of the members chosen from amongit the Board of Governors present at the meeting.
(f) Any resolution may be adpoted by circulation among all its members and any resolution so circulated and adopted by a majority of the member who have signified their approval or disapproval on such resolutions shall be as effective and binding as if such resolution had:been passed at a meeting of the Board of Governors,
6. The Director.— (1) The Director shall be a wholetime salaried officer of the Institute.
(2) The Director shall hold office for a term of five years from the date on which he/she enters upon his/her office and shall be eligible for re-appointment for not more than one more term:
Provided that the person appointed as Director shall, on completion of sixty-five years of age during his term of office, cease to hold office.
(3) The emoluments and other conditions of service of the Director shall be as decided by the Board of Governors.
(4) If the office of the Director becomes vacant due to death, resignation or otherwise, or if the Director is unable to perform his duties due to ill health or for any other reason, the senior-most Professors shall perform the duties of the Director.
• 7. Powers and Functions of Director.—(1) The Director shall be entitled to be present at, and address, any meeting of any other authority or any other body of the

(2) It shall be the duty of the Director to see that the provisions of the Act, the Statutes, the Ordinances and the Regulations are duly observed and he shall have all the powers necessary to ensure such observance.
(3) The Director shall have all the powers necessary for the proper maintenance of discipline in the Institute and he may delegate any such power to such officer or officers as he may deem fit.
(4) The Director shall be empowered to grant leave to any officer of the Institute and make necessary arrangements for the discharge of the functions of such officer during his absence.
(5) The Director shall grant leave of absence to any employee of the Institute in accordance with the rules and, if he so decides, may delegate such power to another officer of the Institute.
(6) The Director shall convene or cause to be convened the meetings of the Board of Governors, the Senate and the Finance Committee,
(7) It shall be the responsibility of the Director to see that all moneys are expended for the purpose for which they are granted or allotted.
(8) He shall be the custodian of the records and such other property of the institute as the Board may commit to his charge.
(9) All expenditure within the budget shall be approved and sanctioned by the Director, or a member of the staff to whom he may delegate this power with the approval of the Board of Governors, provided that such exdpenditure does not exceed the limits specified by the Ordinances, if any. The Director shall also have the power to make re-appropriation with the approval of the Finance Committee :
Provided that re-appropriation to augment the provisions under the head Salaries and Allowances, shall require the prior approval of the Board of Governors,
(10) The Director shall submit the accounts, the budget estimates and other proposals of the Institute to the Board for its consideration.
(11) The Director shall conduct all official correspondence on behalf of the Institute and the Board.
(12) The Director may convene meetings of the Board with the approval of the Chairman.
(13) The Director shall be responsible for implementation of the resolutions passed by the Board.
(14) The Director may assign tasks to the staff members of the Institute, manage the undertaking of these tasks and exercise overall control, including disciplinary control on staff members.
(15) The director may appoint committees or subcommittees by whatever name called, of members of the staff to manage such activities as he may deem fit and/or otherwise authorize any officer of the Institute to appoint such committees.
(16) The Director shall participate or nominate members of staff to participate in national conferences and in international conferences in the areas of interest to the Institute.
(17) The Director shall execute all contracts, deeds and assurances of property made on behalf of the Institute after obtaining the approval of the Board.
(18) The Director shall draw, make, accept, and endorse cheques, notes or other negotiable instruments for the purpose of the Institute in terms of delegation by the Board.
(19) The Director may re-delegate some of his powers to any of his subordinates, with the prior approval of the Board.
(20) The Director may exercise such other powers as may be assigned to him by the Statutes and Ordinances.
8. The Deans.:--(1) There shall be Deans to deal with academics, research, consultant and to deal with such other aspects as the Board , Governors deems it necessary.
• (2) Every Dean shall be a ointed by the Board of Governors on the advise of the Director, from among the professors of the Institute for a period of three years and slifk/he shall be eligible for re-appointment
Provided that a Dean on attaining the age of sixtyfive years shall cease to hold office :
Provided further that if at. any time, there is no professor in a department, the Dire%or, or a Dean authorized by the Director in this behalf, sh4exercise the powers of the Dean.
(3) When the office of the Dean is vacant or where the Dean is by reason of illness, absence or for any other cause is unable to perform the duties of his office, the duties of his office shall be performed by the senior most Professor of that branch.
(4) The Dean will be the head of the functional cluster assigned to her/him and shall be responsible for the conduct and maintenance of the standards of work in the function assigned to her/him.
(5) The Dean shall perfonn such other functions as may be prescribed by the Board of Governors.
9. The Registrars.---(1) The Board of Governors shall constitute a selection committee for the appointment of Registrars.
(2) Every Registrar shall be appointed by the Board of Governors on the recommendation of the selection committee constituted under clause (1) and she/he shall be a whole-time salaried officer of the Institute.
(3) The emoluments and other conditions of service' of a Registrar shall be such as prescribed by the Ordinances :

Provided that a Registrar shall retire on attaining the age of sixty years.
(4) A Registrar designated specially in this behalf by the Board of Governors shall have the power to take disciplinary action against such of the employees, excluding teachers, as may be specified by the Board of Governors by general or special order made in this behalf.
(5) An appeal against any order made by the Registrar in pursuance of clause (4) shall lie to the Director.
(6) In case, an inquiry discloses that a punishment beyond the powers of the Registrar is called for, the Registrar shall, consequent to the inquiry, make a report to the Director sling with his recommendations for such action as the Director may deem fit :
Provided that in such a. case an appeal against an order of the Director imposing any penalty on an employee shall lie to the Board of Governors.
(7) The Board of Governors shall designate a Registrar to act in one or more of the following capacities, ,under the administrative control of the Director, namely :— -
(i) Secretary to the General Council;
(i) Secretary to the Board of Governors;
(ii) Secretary to the Senate.
(8) A Registrar so designated shall, in relation to the authority concerned,
(a) be the custodian of the records, the common seal and such other properties of the Institute as the Board of Governors may commit to his charge;
(b) issue notices and convene meetings of that authority and the committees appointed by it;
(c) keep the minutes of the meetings of that authority and the committees appointed by it;
(d) conduct the official proceedings and correspondence; and
(e) supply to the Chancellor a copy each of the agenda of the meetings of the authorities of the Institute as soon.as it issued and the minutes of such meetings.
(9) Any Registrar may be designated by the Board of Governors to represent the Institute in suits or proceedings, by or against the Institute, verify pleadings and depute his representative for the purpose.
(10) The Registrar shall perform such other functions as may be specified in the Statutes, Ordinances or Regulations or as may be required from time to time by the Board of Governors.
10. Funds of the Institute.—(1) The Institute shall have its own fund consisting of — () all moneys provided by the Government;
(ii) all fees and other charges received by the Institute;
(iii) all moneys received by the Institute by way of grants, loans, gifts, donations, benefactions, bequests or transfers;

(iv) all moneys received by the Institute from the Schools sponsored by Corporations as per the provisions of the agreements with the Corporations or otherwise;
(v) corpus created through hinds from the Government, surplus of funds available with the institute, surpluses from sponsored research projects or consultancy assignments, funds generated from commercialization of intellectual property generated by the institute, grants, donations, gifts, etc.;
(vi) all moneys received from sponsors of research or consulting projects entrusted to the institute;
(vii) all moneys received from faculty members or employers by way of services provided by them to other organizations and as per the pattern evolved by the Board of Governors;
(viii) all moneys received by the Institute in any other manner or from any other source;
Rent, interest, dividend or any other income received upon the investment of the funds of the Institute.
(2) All moneys credited to the Fund shall be invested in accordance with the provisions of Section 11(5) of Income Tax Act, 1961 as the council may deem expedient from time to time in the interest of the Institute.
(3) The funds and the property of the institute howsoever derived, shall be applied only towards the attainment of the objectives of the institute as laid down by the Government.
11. Accounts and audit.—( I )The Director 31181Ikeep or cause to be kept proper accounts of the receipts and payments, income and expenditure and of the property, assets and liabilities of the Institute. The Annual Accounts shall be made up by the end of the financial year.
(2) The Accounts of the Institute shall be audited by an auditor who shall be a Chartered Accountant or a firm of Chartered Accountants as defined in the Chartered Accountants Act, 1949 and shall be appointestby the Board of Governors.
(3) Statement of Accounts audited by the Chartered Accountant shall be sent to the. Comptroller and Auditor General of India for their views and the audited. accounts along with the views ofthe Comptroller and Auditor General of India shall be placed before the Legislative Assembly of Delhi through the Government.
12. Other Officers.—(1) The Board of Governors shall constitute a selection committee for the appointment of the other Officers.
13. Controller of Finance.—(1) The Controller of Finance shall be appointed by the Board of Governors on the recommendations of the selection committee constituted under clause 12(1) and she/he shall be a wholetime salaried officer of the Institute and shall work under the control of the Director.

(2) The emoluments and other conditions of service of the Controller of Finance shall be prescribed by the Board of Governors :
Provided that the Controller of Finance shall retire on attaining the age of sixty years.
(3) In case, the office of the controller of Finance is vacant or when the Controller of Finance is, by reason of ill health, absence or for any other cause, unable to perform his functions as the Controller of Finance, his functions shall be performed by such person as the Director may appoint for the purpose.
(4) The Controller of Finance shall —
(a) exercise general supervision over the funds of the Institute and advise it as regards its financial policies; and
(b) perform such other financial functions as may be assigned to her/him by the Board of Governors or as may be prescribed by the Statutes or the Ordinances:
Provided that the Controller of Finance shall not incur any expenditure or make any investment exceeding three lakh, rupees or such other amount as may be fixed by the Board of Governors.
(5) Subject to the control of the Director and the Board of Governors, the Controller of Finance shall
(a) hold and manage the properties and investments of the Institute, including trust and immovable properties, for fulfilling any of the objects of the Institute;
(b) ensure that the limits fixed by the Finance Committee for recurring and non-recurring expenditure for a year are not exceeded and the money is expended or spent for the purposes for which it was granted or allotted;
(c) be responsible for the preparation of the annual accounts and the budget of the Institute and for their presentation to the Board of Governors after they have been considered by the Finance Committee;
(d) keep a constant watch on the cash and bank balances and investments;
(e) watch the progress of collection of revenues and advise on the methods of collection employed;
(f) suggest steps for enhancing the revenues and containing the costs of the institute;
(g) effectively implement the financial policies of the institute and to ensure that revenues and expenditure are in accordance with the budget of the institute;
(h) ensure that the registers of properties of the Institute are maintained properly and that stock checking of the equipment and other material in the offices, different departments and Centres of the Institute is conducted in a time-bound manner;
(i) bring to the notice of the Director any unauthorized expenditure or any other financial irregularity and suggest appropriate action against the person at fault; and
(j) call from any office of the Institute, including different centers of the Institute, any. information or report that she/he may consider necessary for the performance of her/his functions.
(6).Any receipt given by theControl ler of Finance or by the person or persons duly authorized in this behalf by the Board of Governors shall be a sufficient discharge for payment of moneys to the Institute.
14. The Senate.—(1) Subject to the relevant provisions of the Act, the Statutes and the. Ordinances, the Senate shall, in addition to all other powers vested in it by the Act or under the Statutes, have the Following powers, namely :—
(a) To consider matters of general academic interest either on its own initiative or on a reference from the Director or Deans of the Institute and shall take appropriate action thereon; and
(b) To frame such regulations as are consistent with the. Statutes and the Ordinances regarding the academic functioning of the Institute, including discipline, admissions, fees and other academic requirements.
(e) The above regulations framed by the Senate will take effect after approval of the Board of Governors.
15. The Finance Committee.— (1) There shall be a Finance Committee to develop financial policies of the institute and to oversee the revenues and expenditures of the institute.
(2) The Finance Cammittee shall make recommendations on generating revenues through the institute's activities and these recommendations of the Finance Committee shall be placed before the Board of Governors for a decision.
(3) The Finance Committee shall make recommendations on improving the operational efficiency of the institute's activities, synchronizing the costs of the institute's activities with its projected revenues, and on major expenditure proposals of the institute, as may be required by the Board of Governors.
• (4) The Controller of Finance shall be the ex-officio Secretary of the Finance Committee.
(5) The annual accounts and the budget of the Institute prepared by the Controller of Finance shall be placed before the Finance Committee for approval before being submitted to the Board of Governors.
16. Selection Committees.--(1) Selection Committees shall be constituted for making recommendations to the Board of Governors for appointment to the posts of Professors, Associate Professors, Assistant Professors and other academic staff.

(2) Each of the selection committees for appointment to the posts of Professors, Associate Professors and Assistant Professors shall consist of the following members, namely :—
(i) The Director—Chairman (it') A nominee of the Chairman Board of Governors
(iii) Concerned Dean
(iv) Three experts not connected with the Institute to be nominated by the Chairman Board of Governors from a panel of not less than seven names approved by the Senate for each post
(v) Four members of the selection committee (who shall include at least two experts) shall form a quorum for a meeting of the selection committee constituted under clause (2).
(3) The procedures to be followed by the selection committees constituted under this statute shall, in making recommendations, be such as laid down in the Ordinances.
(4) If the Board of Governors is unable to accept a recommendation made by a selection committee, it shall record the reasons for not accepting the recommendation and submit the case to the Chancellor whose decision in the matter shall be final.
17. Special Mode of Appointment.—(1) Notwithstanding anything contained in Statute 11, the Board of Governors may invite a person of high academic distinction and professional attainment to accept the post of a professor or any other academic post in the Institute on such terms and conditions as it may deem fit, and appoint the person to such post.
(2) The Board of Governors may appoint any member of the academic staff working in any other Institute or organization on a teaching assignment or for taking up a project or any other work on such terms and conditions as may be determined by the Board of Governors..
18. Terms and Conditions of service and code of ethics for the teachers and other academic staff Of the Institute.—(l ) All the academic and administrative staffof the Institute shall be governed by the terms and conditions of service and code of ethics as are specified by the act, Statutes and the Ordinances.
(2) Every member of the academic and administrative staff shall be appointed on a written contract.
(3) A copy of every contract referred to in clause (2) shall be deposited with the Registrar.
19. Removal of employees of the Institute.—(1) In case, there is an allegation of serious misconduct against an employee of the Institute, the Director may, in the case of a teacher or a member of the academic staff, or the authority competent to appoint (hereinafter referred to as appointing authority) in the case of any other employee, as the case maybe, by order in writing, place such employee under suspension and shall forthwith report to the level above the appointing authority the circumstances in which the order was made, In the event that the Board of Governors is the appointing authority, such infonnation shall rest at the level of the Board of Governors.
(2) Notwithstanding anything contained in the terms o f the contract of appointment or in other terms ofconditions of service of the employees, the appointing authority, in respect of other employees, shall have the power to remove on grounds of misconduct, and/or malfeasance.
(3) Save as aforesaid, the appointing authority, shall not remove any employee without giving her/him three months notice to him and in lieu thereof pay three month's salary or a combination of the two.
(4) No teacher, member of the academic staff or other employee shall be removed under clause (2) or clause (3) unleSs he has been given a reasonable opportunity of showing cause against the action proposed to be taken against him.
(5) Notwithstanding anything contained in the foregoing provisions of this Statute, a teacher, a member of the academic staff or other employee may resign from the Institute :
Provided thatsuch resignation shall take effect only from the date on which the Board of Governors, or the appointing authority accepts the resignation, as the case may be.
20. Operation of Bank Account.—The bank— accounts of the Institute shall be kept in the name of the" Institute and shall be operated upon jointly by any two or three officers as may be designated by the Board of Governors.
• 21. Maintenance of discipline amongst the students of the Institute.—(1) The powers regarding discipline and disciplinary action in regard to the students of the Institute shall vest in the Director who may delegate all or any of his powers, to such authority as she/he may deem fit.
(2) Without prejudice to the generality of her/hie* powers relating to the maintenance of discipline and taking„;„.
such action as she/he may deem appropriate for the maintenance of discipline, the Director may, in exercise of his powers, by order, direct that students be not admitted to a course or courses of study *in the Institute or an institution for a stated period, or be punished with a fine for an amount to be specified in the order, or that the result of the student or students concerned in the examination or examinations, in which he has or they have appeared, to be withheld.
22. Legal Proceedings.— The Institute may sue or be sued in the name of the Director or such person as shall be determined by the rules and regulations of the Institute and in default of such determination, such person as shall be determined by the Board.
23. Other Provisions.—Until the Institute is able to make specific Statutes/Ordinances/Regulations on a subject, general regulations or procedures ofthe Govt ofNCTDelhi will apply.
