1. Short title and commencement

(i) These rules may be called the Indian Nursing Council (Technical and Administrative posts), Recruitment Rules, 2017.

(ii) They shall come into force on the date of its notification/ publication in the Official Gazette.

2. Definitions:

(a) “Act” means The Indian Nursing Council Act, 1947 as amended from time to time.

(b) “Appendix” means an Appendix to the Schedule to these Rules.

(c) “Council” means the Indian Nursing Council established under the Indian Nursing council Act, 1947

(d) “Departmental candidate” means those employees working on regular basis in the Indian Nursing Council but does not include employees working on ad-hoc, daily wages or on contract basis.

(e) “Executive Committee” means the Executive Committee of the Indian Nursing Council

(f) “Experience” means experience after acquiring the minimum educational qualifications prescribed for the post.

(g) “Government” means the Central Government.

(h) “On probation” with relation to a person, means a person appointed to any post on Direct Recruitment basis as specified in these Rules.

(i) “President” means the President of Indian Nursing Council

(j) “Regular service” means service rendered by an employee in the Cadre of Indian Nursing Council on a regular basis other than the service rendered on contract or daily wages;

(k) “Schedule” means a Schedule to these Rules.

(l) “Selection Committee” means a composition of members of Selection Committee including Departmental Promotion Committee specified in the Appendix-1 and 2 to the Schedule to these Rules.

3. Authorized permanent strength and temporary strength of the Council

(i) The authorized permanent strength of various grades/posts of the service on the date of notification, the number of posts, their classification and the scales of pay attached thereto shall be as specified in the Schedule annexed to these Rules

Provided that the President with the approval of the Executive Committee may make temporary additions/deletions to any of the grade/posts in the council as found necessary in the interest of the working of the Council.

4. Method of recruitment, age limit and other qualifications

(i) The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns 6 to 10 of the Schedule.

(ii) Age limit shall be with reference to the last date prescribed for receipt of applications from candidates residing in India (and not the closing date prescribed for those in Assam, Meghalaya, Arunachal Pradesh, Mizoram, Manipur, Nagaland, Tripura, Sikkim, Ladakh Division of J&K State, Lahaul & Spiti district and Pangi Sub Division of Chamba district of Himachal Pradesh, Andaman & Nicobar Islands or Lakshadweep).

(iii) For appointment to various posts against direct recruitment/open selection, the composition of the Selection Committees for different categories of posts will be as given in Appendix-1 ¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 17 and 2. Every appointment through direct recruitment/open selection shall invariably be made only after making an open advertisement in leading newspapers / Employment News by giving at least 4 weeks’ time for forwarding their applications. If in a few cases where there are compelling reasons to fill up the vacancy on urgent basis, a shorter time-limit may be prescribed with the approval of President, INC.

(iv) In respect of deputation to Group A & B posts the Armed Forces Personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed shall also be considered. Such persons would be given deputation terms up to the date on which they are due for release from the Armed Forces; thereafter they may be continued on re-employment.

(v) The Recruitment year for promotions will be on the basis of calendar year. In cases where promotion has been prescribed as a method of recruitment, the eligibility list for promotion shall be prepared with reference to the date of completion of the prescribed qualifying service by the officers in their respective cadre/post as on 1st January of the Recruitment year.

(vi) An employee shall be considered for promotion only if he i. has rendered the prescribed qualifying service in the feeder grade;

ii. has successfully completed probation, where prescribed; and

(vii) Notwithstanding anything contained in these Rules, the President may, in case of exigencies, shall make appointment on Contract/ Short-term basis. In such cases the contract period/short term basis shall normally not exceed six months.

5. Disqualification.- No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any post in the Council

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Probation Every person appointed through direct recruitment/open selection or promotion to a post under the Council shall be on probation for the period as mentioned in the schedule pertaining to the post or for the extended period as ordered.

7. Power to relax Where the Executive Committee of the Council, upon recommendations made by the President, is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these Rules with respect to any class or category of posts or persons.

8. Repeal and savings Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided by the Council for the Scheduled Castes, Scheduled Tribes, Other Backward Classes, Physically Handicapped persons, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

9. Interpretation

(i) Any question relating to interpretation of these Rules, the decision of the Executive Committee shall be final unless otherwise, specifically included in these rules.

ii) Notwithstanding, anything contained in these rules, the Executive Committee shall have the power to alter or modify, any of the provisions of these rules.

10. Removal of difficulties If any difficulty arises in the implementation or operation of any of the provision of these Rules, the President may, from time to time, issue with the approval of the Executive Committee, such general or special directions in respect of the provisions of those Rules, which appeared in his opinion to be necessary for the purpose of removing such difficulty.
