No. 14(5)/LA-2003/1156.—The following Act of the Legislative Assembly of the National Capital Territory of Delhi received the assent of the President of India on 13-7-2003 and is hereby published for general information. "The Industrial Disputes (Delhi Amendment) Act, 2003 (Delhi Act No. 9 of 2003)". (As passed by the Legislative Assembly of the National Capital Territory of Delhi on 3-4-2003) An Act to amend the Industrial Disputes Act, 1947 in its application to the National Capital Territory of Delhi. Be it enacted by the Legislative Assembly of the National Capital Territory of Delhi in the Fifty-fourthYear of the Republic of India as follows :—
1. Short tide, extent and commencement-0) This Act may be called the Industrial Disputes (Delhi Amendment) Act, 2003.
(2) It extends to the whole of the National Capital Territory of Delhi. .
(3) It shall oome into force on such date as the Lieutenant Governor of the National Capital Tenitory of Delhi may, by notification in the Official Gazette, appoint.
2. Amendment of Section 10.—In Section 10 ofthe Industrial Disputes Act, 1947(14 of 1947), in its application to the National Capital Territory of Delhi, after sub-section (4), the following sub-section Shan be inserted, namely :— " (4A) Notwithstanding anything contained in Section 9C and in this section, in the case of a dispute falling within the scope of Section 2A; the individual workman concerned may, within twelve months from the date of communicationto him of the order of discharge, dismissal, retrenchment or termination or the date of commencement of the Industrial Disputes (Delhi Amendment) Act, 2003, whichever, is later, apply in the prescribed manner, to the Labour Court or the Tribunal, as the case may be, for adjudication of the dispute and the Labour Court or Tribunal, as the case may be, shall dispose of such application in the same manner as a dispute referred under sub-section (1)."
