Bl.<!il.f.!. 388(31), <rR\"@ 19 ~. 2008. i'YIINISTRY OF CONSUMER AFFAffiS, FOOD AND PUBLIC DISTRIBUTION (Department of Food and Public Distribution) NOT!FlCATION New Delhi, the 7th July, 2009 G.S.R SOS(E).-ln exerciseof!he powers conferred by section 9 of the Sugar Development Fund Act, 1982 ( 4 of 1982), the Central Government hereby makes the following rules further to amend the Sugar Development fund Rules, 1983, namely: l. (I) These rules may be called the Sugar Development Fund (Amendment) Rules, 2009.
(2) They shall come into force on the dale of their publication in Official Gazette.
2. In the Sugar Development Fund Rules, 1983, (I) after rule 16, the following rule shall be inserted, nameiy, "16- A (I) Tbe Central Government, having regard to the availabili~; of sugar and such other factors as it may consider necessary, and after consultation with the Committee, may sanction and notify schemes, to give loans for modernisation of sugar factories to purchase and install ~achinery and equi}HD.ent required fOr simultaneous processing of faw sugar· with crushing of ccmc for the manufacture of sugar.
(2) under sub-rule (1) the schemes may provide for the following, namely:
(i) llre amount of loan that may he disbursed to various categories of sugar factories;
(ii) the manner and form in which applications may be made under this rule;
(iii) the manner io which such loans may be disbursed including the condition regarding signing of contract or agreement and monitoring of utilisation of the loan;
(iv) the period during which such scheme for grant of loans will be operative; ·
(v) any other mailer which is required to be made or notified in the scheme.
(3) Only such sugar factories as have fully repaid all sums, which have become due in respect of sugar development fund and levy sugar price equalization fund will be eligible to apply for loan under tlre schemes notified under sub-rule (I).
(4) The repayment of loans sanctioned under any scheme under sub-rule (I) together with interest shall be made in four· equal ~unual instalments and shall commence on expiry of one year from the date of disbursement ofUre loan." .
3. For rule 17-A, the following shall be substituted, namely,- "17- A (l) The Central Government, having regard to the anilability of sugarcane for crushing by the sugar factories, situation of sugar production in the country and s11ch other factors as it may consider necessary, and after consultation with the Commiltee, may sanction and notify schemes to give loans lo -sugar factories for the development of sugarcane in their specified areas for the following purposes, namely1
(a) pmchase of seeds,
(b) pmchase of fertilizers,
(c) purchase of pesticides. {2) under sub-rule (l) the schemes may provide for the following, namely, ~) the aroounl ofloan that may be disbursed for various categories of sugar factories;
(u) the milJIDer and fonn in which applications . may be made under this rule;
(ill) the manner in whic~ such loans may be disbursed including the conditions regarding signing of coolract and monitoring of utilisation of the loan;
(iv) the period during which such scheme for grant of loans will be operative;
(v) any other matter which is required to be made or notified in the scheme.
(3) Only such sugar factories as have fully repaid all sUIDS, which have become due in respect of sugar development fund and levy sugar price equalization fund will be eligible to apply for loan under sub rule (I).
(4) The repayment of loans sanctioned under any scheme notified under sub-rule (1), together with interest shall be made in four equal annual instalments and shall commence on expiry of one year from lbe d.ate of disbursement of the loan.".
4. ln rule 25,
(a) in sub-rule (1), for the words and figures "Sugar Development Fund Rules 16, 17, 21, 22 and 23 ", the words and figures "Sugar Development Fund Rules 16, 16-A, 17, 17-A, ' 4 THE GAZETTE OF INDIA: EXTRAORDINARY [PtJ>:r !J-Suc. ~(i>, ~====~~~~~~~~~==~=~·~ 2!, 22 and 23" shall be substituted;
(b) in llle proviso 10 sub-rule (5), after O>e words "prov idcd lllat" the words and figures "in ease of short term IoailS \UJdcr mles 1 6-A and 1 7-A, any sugar factory and" shall be substituted.
