Section 36: Holidays, hours of work and other conditions of service

The Inter–State Migrant Workmen (Regulation of Employment and Conditions of Service) (Tamil Nadu) Rules, 1983State Rules of Tamil Nadu · 1979

(1) Holidays, hours of work including extra wages for overtime work done and other conditions of service of migrant workman shall not less favourable than those obtaining in that establishment or in similar employments in the area in which the establishment is located, as the case may be.

(2) Where there is any dispute in this regard or with regard to applicability of holidays, hours of work including extra wages for overtime work done and other conditions of/ service to a migrant workman under clause (a) of sub-section (1) of section 13, the same shall be decided by the Commissioner of Labour whose decision shall be final.
