THE JAMMU AND KASHMIR EXTRACTION OF RESIN RULES, 1986 Forest Department Notification SRO-613 dated 27th September,
1986.–– In pursuance of powers conferred by section 7 of the Jammu and Kashmir Extraction of Resin Act, 1986, the Governor is pleased to make the following rules, namely :––
1. Short title, extent and commencement. ––(i) These rules may be called the Jammu and Kashmir Extraction of Resin Rules, 1986.
(ii) These shall extend to the whole of J&K.
(iii) These rules shall be deemed to have come into force from the date the Jammu and Kashmir Extraction of Resin Act, 1986 came into force.
2. Definition.–– Unless the context otherwise requires, the definitions in these Rules shall carry the same meaning as prescribed under the Jammu and Kashmir Extraction of Resin Act.
3. Manner of extraction of Resin. ––(i) System of working.–– All operations with respect to extraction of resin from chir/kail trees would be conducted only departmentally. The Forest Department would make necessary arrangements for extraction, storage and movement of resin from and to the depots departmentally.
(ii) Method of tapping.–– The extraction of resin from chir or kail trees would be by French Cup & Lip method for which the norms of working are indicated herein below :––
(a) Dimension of Blazes.–– The dimensions of blazes on the tree for extraction of resin would be as under :–– Length 38 cms (48 cms in 1st yr) Width 8cms Depth 2 cms.
Inter blazes 10 cms between two blazes :
Provided further that the department would take appropriate steps in course of time to shift over to rill method of resin tapping and in the meanwhile, the Department would resort to rill method of tapping in certain suitable areas on experimental and demonstrational basis.
4. Limit of size of trees for tapping.–– The limit of size of trees for resin tapping would be :–– 40-60 Cms (dbh) One blaze.
Over 60 Cms (dbh) Two blazes.
5. Yield per blaze.–– The yield per blaze of standard size as per sub-rule (ii) of rule 3 above would be 2 Kgs with plus-minus provision of 5% to 10%.
6. Annual yield of resin.–– The prescribed yield of resin from Chir/ Kail forests of Jammu would be restricted to whatever quantity may be scientifically obtained by the prescribed method of tapping and the whole operation would be subservient to the health of trees and ecological balance in the forests.
7. Setting aside areas for rest.–– The Forest Department may, from time to time, delineate or set aside for rest such areas as have remained in continuous tapping. No resin shall be extracted from forests in such areas for the period so specified, for the regeneration of Chir/Kail trees in such areas.
8. Manner in which resin is to be stored.–– The resin shall be stored in standard containers in transit depots which would be established near the actual sites of work and would, in each case, be registered by the DFO concerned. The movement of resin to the depots would be by authorised challans and the record of receipt and despatch would be maintained on proper lines. Further, appropriate arrangements would be made for safety of resin stores from theft and fires.
Each division, depending upon physiography and contiguity, shall have one central depot where proper arrangements for weighment shall be made. The resin, extracted in the manner prescribed under these rules by the Forest Department, shall be sold to the Jammu and Kashmir Industries, Ltd., at such rates as would be fixed in accordance with the provisions of section 5 of Jammu and Kashmir Extraction of Resin Act, 1986.
9 Enumeration of blazes.–– Fresh enumeration of blazes shall be conducted in all the resin yielding divisions and, thereafter, fresh marking shall be done after every 5 years so as to help necessary check and supervision.
10. Schedule of operation.–– The schedule for various resin tapping operations in the forests shall be as follows :–– Crop setting Mid April.
Collection of resin From mid April to mid November.
Handing back forests Latest by mid January.
Transportation of resin Latest by mid February.
11. (1) When a person, who has proprietary rights on some Chir/ Kail trees, desires that resin be extracted therefrom, he shall write to the concerned Divisional Forest Officer for this purpose. Upon receiving such communication, the Divisional Forest Officer shall report the matter to the concerned Conservator of Forests who shall arrange for making the trees and blazes from which the resin may be extracted in accordance with these rules. The resin shall be got extracted from such trees by the Forest Department and a due account of the same shall be kept by the concerned Range Officer, authenticated by the concerned DFO and communicated to the owner of such trees.
(2) For the resin thus extracted by the Forest Department, the Government shall pay to the owner of such trees the price which it receives therefor from JKI in accordance with the rate fixed under section 5 of the Act, after deducting the expenses that the Forest Department may incur on account of marking of trees and blazes, extraction, transportation, sale and supervision, etc. of such resin.
12. (1) The resin and turpentine manufactured by JKI from the resin purchased from or through the Government and which it cannot utilize in its own units for the manufacture of downstream products, may be sold to the private units existing in the *State. The price at which resin and turpentine will be sold to these units will be fixed after taking into account the prevailing market rate and also the price determined by the consortium of the Resin Producing States.
(2) The surplus resin and turpentine will be sold to the existing private units keeping into consideration any agreement or promise that existed between the *State and such units and the processing capacity of these units at the time of passing of the Act.
13. Effective control of tapping operation.–– To ensure that tapping, transportation and storage of resin is conducted strictly in accordance with these rules, the Chief Conservator of Forests will pass such orders and make such arrangements as are deemed by him to be necessary or desirable.
14. Maintenance of records to ensure effective control on resin tapping.–– The following measures shall be taken to ensure proper maintenance of records and effective control over resin tapping operations :––
(i) Foresters, Range Officer and DFOs shall make field inspections. The Conservators shall also inspect each coupe periodically.
(ii) Uniform formats for maintenance of records and progress of work for resin receipts and despatch are prescribed as are shown in Schedules 1, 2, 3, 4, 5, 6, 7, 8, 9 and 10 attached to these rules.
