Section 59: Power to make rules.

The Jammu and Kashmir Housing Board Act, 1976Union territory Act of Jammu and Kashmir · Act 7 of 1976

(1) The Government may by notification in the [Government Gazette] and subject to the condition of previous publication, make rules, for carrying out the purposes of this Act.

(2) In particular and without prejudice to the generality of the foregoing power, such rules may be made for all or any of the following purposes, namely:––

(a) the manner and form in which contracts shall be entered into ;

(b) the form of the annual budget to be laid before the Board; and the other particulars to be contained there in ;

(c) the manner of publication of housing schemes included in the Budget ;

(d) the form of notices ;

(e) the matters to be decided by the Tribunal ;

(f) the procedure to be followed by the Tribunal ;

(g) the procedure to be followed in taking possession of any Board premises ;

(h) the manner in which damages may be assessed ;

(i) the manner in which appeals may be preferred and the procedure to be followed in such appeal ;

(j) the conditions subject to which the Board may borrow any sum ;

(k) the manner of preparation, maintenance and publication of accounts ;

(l) the date before which, the form in which, the interval at which and the matters on which reports shall be submitted to and by the Board ;

(m) the time at which and the form and manner in which statistics, returns, particulars (statements, documents, and papers) shall be submitted to and by the Board ; and

(n) any other matter which is or may be prescribed under this Act.
