Section 4: Custody of immovable property.

The Jammu and Kashmir Migrant Immovable Property (Preservation, Protection and Restraint on Distress Sales) Act, 1997Union territory Act of Jammu and Kashmir · Act 16 of 1997

(1) Within 30 days from the commencement of this Act, the District Magistrate shall take over the possession of immovable property, belonging to Migrants, falling within his territorial jurisdiction and shall, on the expiry of said period of 30 days, be deemed to have the custody of such immovable property.

(2) The District Magistrate shall take all such steps as may be necessary for preservation and protection of such property :

Provided that possession of such property shall not be handed over to one save with the express consent of the migrant in writing.
