Section 309: Power to enquire and report about misconduct of certain officers or officials.

(1) On a complaint being made to the municipality by any member that an officer or official of the municipality or any other class of Government Officer or official discharging any duties in relation to the functions of the municipality to which the Government may, by notification, extend the provisions of this section has mis-conducted himself in his official capacity, the municipality may enquire into the matter and submit a report alongwith the prima facie evidence to the superior officer whom it may concern, or to the Deputy Commissioner or any other officer appointed by the Government, as the case may be, and the said officer shall, after such further enquiry as may be required, take suitable action under intimation to the municipality and the Director.

(2) On the report being made by any member that an officer or official of the municipality or any other class of Government officers or officials discharging any duties in relation to the functions of the municipality, to which the Government may by notification extend the provisions of this section, has failed to perform any duty imposed, upon him by any law or rules, the municipality may, by notice fixing a reasonable period, require him to perform the duty and on his failure to do so, shall report the matter to the superior officer whom it may concern, or to the Deputy Commissioner and the said officer shall, after such enquiry as may be required, take suitable action under intimation to the municipality and the Director.
