Section 5: Removal of Ombudsman.

(1) The Ombudsman shall not be removed from his office except by an order made by the [Lieutenant Governor] on the ground of proved misbehaviour or incapacity after the High Court, on reference being made to it by the [Lieutenant Governor], has, on inquiry held in accordance with the procedure prescribed in that behalf by the High Court, has reported that the Ombudsman ought on any such ground be removed.

(2) Notwithstanding anything contained in sub-section (1), the [Lieutenant Governor] may by order remove from office the Ombudsman if he––

(i) is adjudged as insolvent ; or

(ii) engages during his term of office in any paid employment outside the duties of his office ; or

(iii) is unable to continue in office by reason of infirmity of mind or body ; or

(iv) is of unsound mind and stands so declared by a competent court ; or

(v) is convicted of an offence involving moral turpitude ; or

(vi) is, without leave of absence, absent from his office for thirty days.
