Section 47: Conditions binding on applicant.

The Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010Union territory Act of Jammu and Kashmir · Act 21 of 2010

(1) On transfer of a field channel to the applicant, the applicant or his representative in interest shall be bound to construct and maintain, to the satisfaction of the Assistant Executive Engineer and for the convenience of the neighbouring land, all the works necessary for––

(a) the passage across such field channel existing prior to its transfer ;

(b) the drainage intercepted by it ; and

(c) for providing proper communications across it.

(2) If any field channel transferred hereinabove is not used for three years continuously, the right of the applicant or of his representative in interest to occupy such field channel shall cease absolutely and same shall vest in the State.
