All Apartment(Flat) owners, tenants of such owners, employees of owners and tenants or any other person who may in any manner use property or any part thereof >kj[k.M xtV ¼vlk/kkj.k½] o`gLifrokj 2 Qjojh] 2012 46 submitted under the provisions of this Act, shall be subject to this Act and to the Deed of Apartment(Flat) and the bye-laws of the Association of Apartment(Flat) owners adapted pursuant to the provisions of this Act. All agreements decision and determination law-fully made by the Association of Apartment(Flat) owners in accordance with the Deed of Apartment(Flat) or bye-laws shall be deemed to be binding on all Apartment(Flat) owners.
37. Removal of Doubts- For the removable of doubts it is hereby declared that the provisions of the Transfer of property Act, 1882, shall, in so far as they are not inconsistent with the provisions of this Act, apply to every Apartment(Flat) and its undivided interest in the Common areas and facilities appurtenant to such Apartment(Flat) as those provisions apply in relation to any immovable property, and not withstanding anything contrary to any contract the provisions of this Act shall take effect.
38. Repeal and Savings-
(1) The Jharkhand Apartment(Property Regulation and Ownership) Act, 2005 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken in exercise of any power conferred by or under the said “The Jharkhand Apartment(Property Regulation and Ownership) Act, 2005” shall be deemed to have been done or taken in exercise of powers conferred by or under this Act as if this Act was in force on the day on which such things was done or action taken.
