(l ) L: those rules, unless the context otherwise requires,-
(a) "Act" means the The Indian Tolls (Jharkhand Amendment) Act, 2002;
(b) 'lbase year" means the period from lst April 2OO7 to 31st March 2008;
(c) "bypass" mears a section of the State highway, MDR ,ODR bypassing a town or city;
(d) "concessionaire" means a person or firm and includes successors, assignees and permitted substitutes with whom an agreement has , been entered into under section 2Aof theAct;
(e) "elevated highway" me:rns any 'section of State higl*'ay, MDR, ODR raised above ground level through support of piers or columns;
(f) "executing authority'r means an officer or authority subordinate to the Govemrnent notified by the state Govemment under section 2 of the The Indian Tolls (Jharkhand Amendment) Act,2002:'
(g) "expressway" means a state highway having a divided carriageway suitable for high speed trafEc and with fuIl or partial control of access;
(h) "financial year" meaus the year commoncing on the lst day of April of a ye:!r and ending on 3 1 st day of March of the succeeding year;
(i) "gross vehicle weight" in respect of any vehicle means the total weight of the vehicle ana to;a certified and registered by the glclsru-s rqe (sr€rrrl{Dl). qardrsrc s tr{, zorr registering authority as permissible for that vehicle r:nder the Motor Vehicles Act, 1988 (59 of 1988);
(r) "Iane"'means a lane forming part of the main carriageway and having a minimutn width of three meters and fifty centimeters;
(k) "mcchanical vehicle'r means any vehicle driven under its own power including a motor vehicle as defined under the Motor Vehicles Act, 1988;
0) "notilication" means a notification published in the Official Gazette;
(m) *private lnvestment project" means a project relating to section of State highway, MDR, ODR bridge, lnterchange, Flyover, ROB/RUB, bypass or tunnel, as the case may be, for which an agreement is entered into with a concessionaire;
(n) "public funded project" means a project which is not a private investment project, as defined in clause (m) above and includes a private investlnent project in respect of which the agroement has expired;
(o) "toll plaza" means any building, stnrcture or booth made for collection of fee.
(p) .'WPI" means the wholesale price index as published by Ministry of Commerce & Industry, Government of India or arry Index published in substitution thereof by the Govemment of India.
(q) "Governmerit" means the Govemment of Jharkhand
(r) "user fee" meaus collection of prescribed fee fiom any person of various categories of mechanical vehicles for the use of State highway, Major District Road, Other District Road bridge, Interchange, Flyover, ROB/RUB, blaass and tunnel The user fee is also termed as fee/ Toll / Toll fee.
