Section 7: Remittance and appropriatioD of fee

Jharkhand Highways Fee (Determination of Rates & Collection) Rules, 2011State Rules of Jharkhand · 2004

(1) In case of public funded projects, the fee collected under the provisions ofthese rules by every executing authority or an agent shall be retnitted to Government.

Provided that the Government may by notification allow any or all executing authorities to appropriate the whole or aIIy part of the fee for such purposes and subject to such conditions as may be specified in the said notification,

Provided further that in casq of private investment projects, the fee collected under the provisions of theso rules shall be appropriated by the concassionaire in accordance with the provisions of and for the porformance of its obligations under tho agreement entered into by such concessionaire' gTrcro-S rrrile (qBrErr{ur). frrdqrt 3 rrg. 2ot1

(2) Every executing authority shall remit to the Government, the finount of fee collocted over arrd above the amount permitted to be appropriated by the executing authority under sub-ruls (l) of rule 7, within ninety days from the date of the sle5ing of the financial year along with aa annual r"*:r r66ying the arnount collectod and the expenditure incurred on collection of fee, including the administrative and management expenses.

(3) The Govemment shall by notification determine the administrarive and management expenses whioh may be allowed to be deducted and retained by the executing authority.
