8.0, No. 422—In exercise ot‘Lhe pc wers conferred under section 13 1 ofthe .1thth Panchayat Raj Act, 2001,and in the light ofthe provisions contained under section 91) (2) and 92 (2), the following rules ofthe Jharkhand Panchayat Samiti establishment (Appointment, Service Conditions and duties) are framed— 1 Short title, Extent & commencement :- 0) These rules may be called the Jharkhand Panchayat Samiti establishment (Appointment, Service conditions and duties) rules 2008.
(ii) It shall extend lo the Whole ofthe state otharkhand.
(iii) These rules shall come into effect fromthe date ofnotification by the Govemment
2. Definitions :- ln these rules, unless there is anything repugnant in the subject or context:-
(a) “Appointing Officer" means Oflicer appointed by government for the appointment ofofficer/m in the Panchayat: Samtti;
(in) “Government" means the Government ofiharkhand;
(C) “ Service” means the services renc ered by various posts created by the Government under the Panchayat Sami‘ti;
(d) “Panchayat Samiti” means the l’anchayat Samiti constituted under section 32 of the J’harkhand Panchayat Raj Act 2001;
(a) “Section” means section of the Jharkhand Panchayat Raj Act 2001;
(f) "Service condition" means the conditions regarding appointment, posting, seniority, transfer, salary, Allowances, Leave, Promotion, Administrative control, Punishment, Retirement, Pension, Gratuity and provident fund etc,

Block Development Olfmerz—
(r) The Blocl: Development ofiicer posted in every Panchayat Samiti will he the Executive Officer‘of the Samiti and discharge the responsibilities ofthe Secretary ofthe Panchayat Samifl too;
(i) The Block lilevelopment Officer will be in~charge ofthe ofiice ofthe Panchayat Samiti;
(iii) The service condition ofthe Block Development Officer will be such as may be prescribed by the State Government;
(iv) The Block Development Officer in the capacity of the executive officer ofthe Panchayat Samitiwill exercise following powers and fimctions: ,

(f) (E) To supervise and contra rill the works executed by the Panchayat Sanriti;
To cc ntrol, supervise and assign the duties ofall the officers, staffor the rank holders working under the F‘anchayat Sarmti;
To make necessary efi'or:s for speedy implementation ofdevelopmental schemes and all the works ofthe Parr chayat Samiti;
To keep in custody all the papers and documents regarding the proceedings of the meetings ofthe Prmchay at Samiti and its sub—committee;
To draw and disburse amounts from the fluid of the Panchzryat Samiti;
To deal with the works in order to execute limctrons specified under section 76 of the Act;
To comply and perform all other dunes assigned under specific or general order ofthe State Goverrunent or provided in the Act or the mles;

(21) The Assistant secretary (Gram Pancliayat Supervisor) will be a Non—Gazzeted employee and known as Block Panchayat Raj Officer;
(b) The Block Panchaynt Raj Officer will function as the Assistant secretary ofthe Pancbamt Samiti Service cadre
(a) The service cadre of the Block Panchayat Raj Odicer will be ofState level
(in) The Total strength ol‘the cadre will be as such as may be prescribed time to time by the State Government;
(0) Every Pancbayat Samiti will have a Block Panchayat Raj Ofiicer, who will per— form the works ofAssistant Secretary ofthe Panchayat Samiti;

(a) 50% posts ofthe Block Panchnyat Raj ()flicer (GP. S./ Assistant Secretary) will be filled from the merit list of‘the competitive examination conducted by Jharkhand Public Service Commission or State Subordinate Service Selection Council;
(1)) Remaining 50% post ofthe Block I’anchayat Raj Oificer (GP S /Assistant Secretary) will be filled fiomtbe Panchayat Secretary through the limited competitive termination;
Reservation in the Appointment:~ Reservations will be in acoo dance with the relevant Government orders effective at the time ofthe appointment for the ("landidates belonging to Scheduled Caste/ Scheduled tribe/ Backwards & others cla Eligibility
(a) Minimum qualification for the 50% posts to be filled through Jharkhand Public Seance Commission or State Subordinate Services Selection Council will be graduate or equivalent from any recognised University.
For Selection through limited competitive examination the Panchayat Secretary having a graduate degree and a minimum service of (7) seven yearswill be eligible for candidature.
The Syllabus for the posts to be filled directly by Jharkhand Public Service Commission or State Sub-ordinate Services Selection Council and to be filled through the limited competitive examination will bethe same '; 0 M)

(d) The limited competrtive exarninationwill be conducted either by JPSC or by State Sub ordinate Selettion Council as per the decision ofthe State Government;
Age :-
(a) The upper age limit as prescribed by the State Government will be applicable for the posts to be filled through the direct recruitment;
(b) No upper a go limit will b a applicable for the posts to be filled through the limited competitive exzunination;
Procedure oprpointment :-
(a) The Department ofthe Panchayati Raj will determine the number ofvacancies to be tilled during the year and the number ofvacancies reserved for SCs/ STs/ Backwards and others on provided under the rules 5 (iv);
Cb) 3 months training will be compulsory for the Block Panchayat Raj Officer (GP5/ Assistant Secretary) selemed and appointed through direct appointment/ appointment through limited competitive examination by Jliarkhand Public Service Commission or State Subordinate Service Council respectively in a prescribed training institute;
to) After Completion ofTra-‘ning , they will be posted in districts;
(d) Passing the Hindi Noting and drafling examination prescribed by the Govemment will be compulsory;
(e) Promotion from the post ofAssi stant Secretary and the transfer and posting of Assistant Secretary will be made by the establishment/ Promotion Board in the light ofoirculars issued by the Government from time to time;
Determination of Seniority :-
(a) Intense seniority amongst the Block Panchayat Raj Officers (Assistant Secre— tary/ GP Si) directly selected through Jhmrkhand Public Service Commission or State Subordinate Services Selection Council will be determined in the light ofthe relevant Govemment rul 35/ circulars;
(b) Intense senionty amongst the Block Panchayat Raj Officers selected through the limited competitive examination will be determined as per the Government rules/ cirmlars effective at that time;
Salary andAllowanees :-‘ (I) Afler these rules come into force, the salary and allowances ofthe persons appointed on the posts in the service will be as per the decisions ofGovernment in this regard fiom time to time;

Posting and Transfer :—
(a) The persons appointed inthiz service will be posted on thevaeant posts anywhere in the state by the appointing officer,
(h) The Persons appointed in the service will not be posted in their home Blocks;
(0) Transfer ofthe persons appointed in the senioe will be considered alter the completion of3 years ofporting in a place but the appointing officerwill be competent to transfer prior to stipulated three years ofposting in a place keeping in View the circumstances;
(cl) Transfins & postings will be mwdeby the Establishment Board Constituted tor the purpose, Other ennditionr pertaining to the service :- Any other action for the persons appointed in service will be taken in accordance with the Government service code and relevant Government orders i ssued time to time;

(f) To dispose ofthe works allotted and entrusted by the secretary, Panchayat Samiti for the execution ofthe fiinmioins ofthe Panchayat Samiti as provided under section ‘76 ofthe Act;
To perform the function ofSecretary, Panchayat Samiti in his absence;
To supervise, inspec:, imd control all the works ofPanchayats;
Cheques forthe undergoing developmental works by the Panchayat Samiti will be disbursed with thejoint signature ofthe Secretary and theAssistant Secretary;
To present the ahsentees details ofthe Panchayat Secretary and to direct the Panchayat Secretary specifi: lawful instructions for the compliance;
To assist the Executive Ofli cer discharging the powers and fiinctions section 90

0 To ensure the compliance ofall other fimctions which may be entrusted by the act or rules or any general or specific order ofthe Government in this regard, To carry out those other fiuictionri which are assigned by the secretary of the Panchayat Samiti through General or specific orders;

(r) TheAssistant Secnnary ofthe szchayat Samiti will be administratively respon— sible to the Secretary) Pa nchnyat Samiti. It would be essential to ensure compliance ofall the lawful inst notions ofthe Secretary;
Service Conditions and duties of other officers and staffworking under the Panchayat Samiti--- ' The service condition and duties ot‘the other officers and stafl‘working under Panchayat Samiti will be as such as may be determined by the Government. The Directions given by the State Govemmerrtwill be complied with regard to their duties;
Contml of the appointing officer :- The Block Panchayat Raj Ofl‘icer (GPS/Assistant Secretary) will be governed by the subordinate Services Discipline and Appeal (Bihar & Orissa), Jharkhand Service Code-22004 and Jharlrhrmd Board’s Miscellaneous Rules;
Removal ofdifficulties: .. Ifahy drfliculty arises in giving, effect to the provisions ofthese rules, the Gov ernrnent may, by order published in the official Gazette as the occasion may require, do anything which appears to it to be necessary to remove the difficulty;
Repeal and Saving :- All these rules corresponding efi‘ective prior to the present rules are hereby repealed;
Anything done or any action taken, under these rules so repealed shall be deemed to have been clone or taken under the corresponding provision ofthese rules to the extent that they are inconttistent with the provision of these nrles;
