Notification G.S.R…………………In exercise of the powers conferred by Section-18 of the Jharkhand Minority Commission Act, 2002 (Bihar Act-7, 1991), the Governor makes the following rules:
1. Short title, extent, and commencement: -
(a)- This shall be called Jharkhand State Minority Commission Rules, 2002
(b)- It extends to the whole of the state.
(c)- It shall come into force on the date of assumption of office by the chairman /vice-chairman.
2. Definitions - In these rules, unless the context otherwise provides,
(a) ‘Commission’ means, Jharkhand State Minority Commission constituted under the provision of section -4 of the Jharkhand State Minority Commission Act, 2002(Bihar Act-7, 1991).
(b) ‘Government’ means the Government of Jharkhand.
(c) ‘State’ means the state of Jharkhand
(d) ‘Section’ means section of Jharkhand State Minority Commission Act, 2002 (Bihar Act-7, 1991)
3. Status and emoluments of Chairman, Vice President and Members of the Commission: -
(a). The status of the chairman of the commission will be that of a minister of Jharkhand State and the status of vice-president will be that of Minister of State, Jharkhand.
The salaries and allowances payable to and others terms and conditions of service are-
(i) The payment of salary to the chairman and vice president will be at the following rate:
Sl. no Head Chairman Vice- Chairman 1 Salary 3,000.00 3,000.00 2 Regional Allowance 4,000.00 4,000.00 3 Guest Allowance 1,000.00 500.00 Total= 8,000.00 7,500.00 Dearness allowance will be payable Rs.350/- per day in the state and Rs.500/- per day off the state.
Income tax payable on salary and allowances will be paid by the commission.
The Chairman /Vice Chairman and members of their family shall be entitled for medical treatment and free medical care and supply of medicines and concession in hospital accomodation, the expenditure on which shall be borne by the commission on the basis of entitlement.
B- Entitlement of private employees:
(i) 1(one) Private Secretary who may be outsourced with a minimum qualification of graduation. As per the desire of chairman/vice-chairman will be entitled to pay Rs.6500/- per month, HRA according to salary and allowances payable to governments official by the government.)
(ii) 1 (one) Private Assistant to be appointed by the commission or government.
(iii) 1(one) Routine clerk to be appointed by the chairman and vice-chairman as desired.
(iv) 3 (three) peons to be appointed by the chairman and vice-chairman as desired.
(v) 1(one) driver on daily wage to work on the desire of chairman/vice Chairman.
The salaries of all the above employees will be paid by the commission's fund.
For vehicle provided by the government or the commission, petrol/diesel at the rate of 250 litres each month or if the chair person/vice chair person use their own vehicle then 1500/- rupees as travelling allowance will be paid by the commission.
On rail travel the chairperson/vice chairperson will be entitled to two berths in second class AC Coach.
On travel by flight the chairperson/vice chairperson will be entitled to only one ticket in the highest class.
Their attendants will be entitled to travel by rail or road.
D- The chairperson/vice-chairperson shall be provided a telephone with an S.T.D facility for the office and residence each.
E- (i) The financial liability of the entitled facilities of the chairman/vice chairperson shall be formulated in the budget provision related to the Commission by the Welfare Department.
(ii)The members of the Commission, who are members of the State Legislative Assembly, will be entitled to travel allowance and daily allowance as per the rate payable according to the Jharkhand Legislature (Salary, Allowance, and Pension of Members) Act, 2001 (Act No. 3, 2001).
(iii) The members of the Commission, who are not members of the state legislature, shall be entitled to travel allowance and daily allowance payable to the first-class officers of the state government under the travel allowance rules.
