HUMAN RESOURCE DEVELOPMENT DEPARTMENT (HIGHER EDUCATION) NOTIFICATION THE 7th October, 2004 File No.- 5/B1-79/01-1288—In exercise of the power conferred by Section-16 of Jharkhand State Unaided Educational Institution (Grant) Act, 2004 (Jharkhand Act no. 04/2004) the Governor of Jharkhand is pleased to make Jharkhand State Unaided Educational Institution (Grant) Rule, 2004.

CHAPTER-1 Short name and commencement :-

1. This rule shall be called Jharkhand state unaided Educational Institution (Grant) Rule, 2004.

2. It shall come into force with effect from the date of its publication in Government Gazette.

CHAPTER-2 Rule for releasing recurring grant under section-9 of the Jharkhand State unaided educational institution (Grant) Act, 2004 to Educational institutions possessing eligibility as provided in the Section-3 of the said Act.

Rule 1: Academic Calendar shall be submitted along with the application and in the next year it shall be compulsory to submit the compliance report.

Rule 2: Extracurricular activities such as N.C.C./N.S.S./Sports/Youth festival should have been organized.

Rule 3: The college/School shall make efforts to enhance the internal resources.

Rule 4: Estimated expenditure of the expected amount of grant shall be submitted by the college/School to the Government and the expenditure shall be incurred accordingly.

Rule 5: Before receiving the grant, the Secretary and the Principal of the college/School shall give declaration letter to the effect that :-

(a) The use of the grant money shall be done according to the estimated expenditure and in no case the fund shall be diverted.

(b) The Governing body/managing committee of the college/School shall abide by the conditions determined by the State Government from time to time.

Rule 6: The State Government may change or stop the amount of grant after review of the activities of the college/School.

Rule 7: The grant shall be released in one installment.

Rule 8: The grant shall be stopped if in any year the result of the examination conducted by the concerned University for degree/Jharkhand Academic Council falls below forty percent.

Rule 9: The grant may be given on priority basis to women’s college/Girl’s School, Colleges/Schools for disabled and colleges/Schools for Scheduled castes/Tribes.

(B) The calculation of the number of students for degree course shall be done by trebling the number of students registered in Degree Part one of all the faculties.

(C) For institutions located outside the municipal/notified area, the last census of the area within 5sq. Km shall form the basis of the calculation of population.

(II) School of General Standard/High Schools, Primary Schools and Middle Schools.

Rule 11: Prayer for non-recurring grant with justification for the objectives enumerated in Section-10 of the Act shall be made to the concerned Director till the appointed date, The concerned Directorate shall after examination of proposal and after getting approval of the State Government shall make available the grant to the Secretary of the concerned college/School, The State Government shall have the right to reject any prayer without assigning any reason.

Rule 12: The application for receiving recurring/non-recurring grant shall be made in the prescribed proforma. The concerned Directorate shall prepare the prescribed proforma after getting the approval of the Departmental Minister.
