Section 4: Establishment of trustee committee

The Karnataka Advocates' Welfare Fund Act, 1983State Act of Karnataka · Act 2 of 1985

(1) The State Government may, by notification, establish with effect from such date as may be specified therein a committee to be called the Karnataka Advocates' Welfare Fund Trustee Committee.

(2) The trustee committee shall be a body corporate having perpetual succession and a common seal with power to acquire and hold property and shall, by the said name, sue and be sued.

(3) The trustee committee shall consists of,- 1 [(a) The Chairman of the Bar Council who shall be the chairman of the Trustee Committee, ex-officio;

(aa) The Advocate General of Karnataka who shall be a member- Exofficio.

(b) The Secretary, Department of Law, Government of Karnataka who shall be a Member Ex-officio.]

(c) two members nominated by the State Government;

(d) 1[three]1 members of the Bar Council nominated by it;

1[(e) the Vice-Chairman of the Bar Council, who shall be the Treasurer of the trustee committee, ex-officio;]1and

(f) the Secretary of the Bar Council, who shall be the Secretary of the trustee committee, ex-officio;

(4) A member nominated by the State Government under clause (c) of sub-section (3), shall hold office for a term of 1[three years] 1.

(5) A member nominated by the Bar Council under clause (d) of subsection (3), shall hold office for a term of 1[three years]1 or for the duration of his membership in the Bar Council, whichever is less.
