Section 35: Procedure in execution

Unless the decree-holder has expressed a desire that proceedings should be taken in a particular order as laid down in sub-rule (2) of Rule 34 execution shall ordinarily be taken in the following manner,- 81

(i) moveable property of the judgment-debtor shall be first proceeded against; but this shall not preclude the immoveable property being proceeded against simultaneously in case of necessity;

(ii) if there is no moveable property, or if the sale proceeds of the moveable property or properties attached and sold are insufficient to meet in full the demand of the decree-holder the immoveable property mortgaged to the decree-holder, or other immoveable property belonging to the judgmentdebtor may be proceeded against.
