(i) ಉಪ-ಪ ಕರಣ (1)ರย “ಛ ෦ೕಣ” ಎಂಬ ಪದವඝ౬ ಟ “ನಗರ” ಎಂಬ ಪದವඝ౬ ഖౣ ಡತಕౙ ൿ౪ .

Whereas the Karnataka Legislative Assembly and the Karnataka Legislative Council are not in session and the Governor of Karnataka is satisfied that the circumstances exist which render it necessary for him to take immediate action to promulgate an Ordinance for the purposes hereinafter appearing;
Now, therefore, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor of Karnataka is pleased to promulgate the following Ordinance, namely:-
1. Short title and commencement.-(1) This Ordinance may be called the Karnataka Compulsory Service by Candidates Completed Medical Courses (Amendment) Ordinance, 2025.
(2) It shall come into force at once.
2. Amendment of section 3.- In section 3 of the Karnataka Compulsory Service by Candidates Completed Medical Courses Act, 2012 (Karnataka Act 26 of 2015) (hereinafter referred to as the principal Act),- 5
(i) in sub-section (1), after the existing proviso, the following proviso shall be inserted, namely:- “Provided further that, the vacancies in the rural areas shall be filled on priority and in case the number of candidates are more than the vacancies in rural areas then the vacancies in urban areas may be filled by posting of candidates to render one year compulsory service.”
(ii) in sub-section (3), the word ‘rural’ shall be omitted;
(iii) in sub-section (4),-
(a) the word ‘rural’ shall be omitted;
(b) after the proviso, the following proviso shall be inserted, namely:- “Provided further that, candidates may be given a conditional No Objection Certificate to pursue higher studies like MD or MS or Fellowship in the universities established by law upon submitting an affidavit or undertaking stating their commitment to fulfill the obligation of one year compulsory service post-completion of higher studies failing which he shall be liable for penalty and such other consequences specified in the affidavit or undertaking.”
3. Insertion of new section 3A.- In the Principal Act, after section 3, the following shall be inserted, namely:- “3A. Priority and exemption.- Notwithstanding anything contained in this Act, while filing up of existing vacancies specified by the Government for compulsory service in the Government hospitals under sections 3,4 and 5 the candidates who have passed medical courses under Government quota seats shall be filed on priority and the remaining vacancies may be filed by the candidates who have studied medical courses under institutional seats and the surplus candidates may be exempted from the compulsory service.
Explanation: For the purpose of this section “Government seats” and the “Institutional seats” shall have the same meaning as defined in the Karnataka Professional Educational Institutions (Regulation of Admission and Determination of Fee) Act, 2006 (Karnataka Act 8 of 2006).”
4. Amendment of section 4.- In section 4 of the Principal Act,-
(i) in sub-section (1), the word ‘rural’ and the word ‘urban’ shall be omitted;
and 6
(ii) after the proviso, the following proviso shall be inserted, namely:- “Provided further that, candidates may be given a conditional No Objection Certificate to pursue higher studies like Super-specialty or Fellowship in the universities established by law upon submitting an affidavit or undertaking stating their commitment to fulfill the obligation of one year compulsory service postcompletion of the higher studies failing which he shall be liable for penalty and such other consequences specified in the affidavit or undertaking.”
5. Amendment of section 5.- In section 5 of the principal Act, in sub-section (2),-
(a) in the existing proviso, the word “rural”, shall be omitted; and
(b) after the existing proviso, the following proviso shall be inserted, namely:- “Provided further that, candidates may be given a conditional No Objection Certificate to pursue higher studies like fellowship in the universities established by law upon submitting an affidavit or undertaking stating their commitment to fulfill the obligation of one year compulsory service post-completion of the higher studies failing which he shall be liable for penalty and such other consequences specified in the affidavit or undertaking.” The above translation of ಕකბಟಕ ็ದ ౾ೕಯ ಆೕბಗಳඝ౬ තಣბತัದ ಅಭ ൮ბಗಳ ಕറ ಯ ฿ (ൟൿ౪ ಪല) ಅඋ ඃಶ, 2025 (2025 ರ ಕකბಟಕ ಅඋ ඃಶ ಒ : 06) be published in the official Gazette under Article 348 of the Constitution of India.
