And In exercise of the power conferred by section 4and 16 of The Karnataka Epidemic Diseases Act, 2020 (Karnataka Act 26 of 2020), the Government of Karnataka hereby makes the following regulations to amend the Karnataka Epidemic Diseases Regulations, 2020, namely :- REGULATIONS
1. Title and commencement . – (1)These regulations may be called the Karnataka Epidemic Diseases (Amendment ) Regulations, 2024.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Definitions.–In these regulations unless the context otherwise requires,
(a) “Act” means the Karnataka Epidemic Diseases Act, 2020 ( Karnataka Act 26 of 2020) ; and
(b) “Competent Authority” means the Chief Commissioner of the Bruhat Bengaluru Mahanagara Palike (BBMP) for the Jurisdiction of BBMP area and theDeputy Commissioner of the concerned district for the Jurisdiction of the Districts other than BBMP area”.

3. Responsibilities of owners, occupiers, etc., It shall be the duty of every owner, occupier, builder or other person in-charge of any land or building or any place including water tanks, parks, play-ground to take necessary measures to prevent breeding of mosquitoes therein which are included but not limited to the following, namely: -
(i) every person, authority or institution, intending to build house or multistoried building or any other building for any purpose shall take measures with the objective of preventing the breeding of mosquito as part of such activity;
(ii) the owner or occupier of household, any building, construction site or shed or land shall ensure to cover or secure the water storage containers, sumps or overhead tanks with a lid or any material to prevent mosquito breeding. And dispose solid waste material to prevent water accumulation & mosquito breeding;
(iii) the owner or occupier of household , any building or shed or land shall not keep any empty vessels, pot saucers, cans, containers, unused tyres, parts or any other solid waste materials in such manner that it is likely to collect and retain water which may cause breeding of mosquitoes;
(iv) the owner or occupier of any building or land shall not allow unused tank, pits, burrows in the building or land wherein water is likely to collect and accumulate which may cause breeding of mosquitoes;
(v) every person, institution or agency shall take care to prevent collection or accumulation of water, inside or outside the premises, so as to prevent nuisance to the neighbors or the community as a source for mosquito breeding;
(vi) for the purpose of prevention of mosquito breeding, the owner or occupier of building, under construction building or open space shall take all measures to prevent breeding of mosquitoes and collection of water resulting in breeding of mosquitoes; and
(vii) the owner or occupier or any person in-charge of such land or building belonging to private individual or the Government, semi Government or local authority, shall take all necessary steps to prevent collection or accumulation of water which causes mosquito breeding.

4. Power of competent authority to enter, inspect the premises, issue directions, levy penaltiesetc:-
(1) The competent authority is empowered in their jurisdiction to ensure implementation of allremedial measures and guidelines prescribed from time to time by Health & Family welfare department of the state to curb the spread of vector borne diseases.
(2) The competent authority shall have power to inspect periodically, all the lands,buildings, building premises, water tanks, parks, playgrounds etc., and to recommend &take measures as are necessary to prevent the breeding of mosquitoes;
(3) The competent authority may at all reasonable time between sunrise and sunset and after giving such notice in writing as may appear to him reasonable enter and inspect any land or building and the owner or occupier as the case may be of such land or building shall give all facilities necessary for such entry and inspection and supply all such information as may be required by him for the purpose of finding out water storage or water collection etc., leading to mosquito breeding.
(4) The competent authority or its authorized officer may by notice in writing require the owner or the occupier of any place containing any collection of water in which mosquitoes breed or likely to bread within such time as may be specified in the notice, not being less than twenty four hours, to take such measures to prevent the mosquito breeding or to destroy the same by such physical, chemical or biological method, being measures or methods as the competent authority may consider suitable in the circumstances;
(5) If the person on whom a notice is served, fails or refuses to take measures to adopt the method of treatment specified in such notice within the time specified therein, the competent authority or its authorized officer may itself take such measures or adopt such treatment, specified in such notice within the time specified therein, and cause double the cost to be recovered from the defaulter.
(6) The competent authority or its authorized officer shall have powers to levy penalty on anyone who disobeys or refuses or fails to take measures as specified in these regulations with a fine amount as shown in the table below.

(2) The competent authority or its authorized officer shall have power to levy and recover the penalty as specified in these regulations.
