Section 3: Insertion of new Chapter IV-A

After rule 17 of the said rules, the following shall be inserted, namely:- “Chapter-IV–A Application of the provisions of the Karnataka Education Act, 1983 and rules made there under in respect of teaching and nonteaching staff of educational institutions run by the notified institutions from their own fund of the temples.

17-A. Method of recruitment and Minimum Qualification etc.- The provisions regarding the staffing pattern, the method of recruitment (Common Entrance Test) and minimum qualification for teaching and non-teaching staff as prescribed under the Karnataka Education Act, 1983 and rules made there under in respect of aided Educational 2 Institutions shall mutatis, mutandis apply to the teaching and nonteaching staff of the educational institutions run by notified institutions under the Act.

(2) The Government shall constitute a Committee consisting of such members including representative from the Department of Social Welfare by a order for selection of teaching and non- teaching staff of the educational institutions.

17-B. Application of Reservation Policy.- The orders issued by the Government regarding application of reservation policy from time to time in appointment and promotion for various categories shall be applicable to the recruitment and promotion of teaching and non-teaching staff of the educational institutions run by notified institutions.

17-C. Scale of Pay, other allowances, Leave and other Conditions of Service.- The provisions of scale of pay, other allowances, leave and other benefits and conditions of service applicable to teaching and non-teaching staff an aided educational institutions under the Karnataka Education Act, 1983 and rules made there under shall mutatis mutandis apply to the teaching and non-teaching staff of the educational institutions run by notified institutions.

17 D. Disciplinary actions.-The provisions of disciplinary and conduct rules applicable to teaching and non-teaching staff of private aided educational institutions as prescribed under the Karnataka Education Act 1983 and rules made thereunder and other orders shall mutatis mutandis apply to the teaching and non-teaching staff of the educational institutions run by notified institutions.

17-E. Aid to Education Institutions run by notified Educational Institutions.- The notified institutions may spend not more than 35% ( Including Temple staff and Educational institutional Staff expenditure) of the Income of such institutions towards salary and allowance of staff and other expenses to run Educational institutions.

17-F. Notification of competent Authority.-The Revenue Department in Government may issue a notification designating an officer of Department of Hindu Religious Institutions and Endowments as Competent Authority for the purpose of Educational Institutions run by notified institutions.

17-G. Admission Procedure.- The provisions of admission procedure to classes or standards of primary school, secondary school, pre-university colleges and degree colleges as prescribed under the Karnataka Education Act 1983 and the provisions of the Right of Children to free and compulsoryeducationAct,2009(CentralAct35of2009)andrulesmadethereunde randother orders issued by the Government from time to time shall mutatis Mutandis apply to the primary schools, secondary schools, pre-university colleges and degree colleges of the Education Institutions run by notified institutions.

Explanation.- For the purpose of this Chapter“ Educational Institutions” means primary schools, secondary schools, Pre-university colleges and degree colleges and hostels run by the notified institutions from their own fund of the concerned temples.” By Order and in the name of the Governor of Karnataka K.
