Tel. 080-22034625 No. CI 60 SPI 2020(E) Date: 04.11.2020 NOTIFICATION Whereas the draft of the Karnataka Industries (Facilitation) (Amendment) Rules, 2020 was published in notification No. CI 60 SPI 2020(E), dated 04.09.2020 in Part IV-A, No. 388 of the Karnataka Gazette Extraordinary dated 04.09.2020 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of its publication in the official Gazette; And whereas, the said Gazette was made available to the public on 7th September,

2020. And whereas, no objections and suggestions were received in respect of the said draft: Now, therefore, in exercise of the powers conferred by section 21 and read with section 11A of the Karnataka Industries (Facilitation) Act, 2002 (Karnataka Act 45 of 2003), the Government of Karnataka hereby makes the following rules, namely:- RULES

1. Title and commencement.- (1) These rules may be called the Karnataka Industries (Facilitation)(Amendment) Rules, 2020 ¸ÀA¥ÀÄl -155 Volume - 155 , 12 , 2020 ( , 21, ಶಕವಷ�, ೧೯೪2) BENGALURU, THURSDAY, 12, NOVEMBER, 2020 (Karthika, 21, SHAKAVARSHA, 1942) ¸ÀAaPÉ 46 Issue 46 ¨sÁUÀ 4J ಕ£ಾ�ಟಕ ªಾಜÍಪತÎ,ಗುರು®ಾರ, 12, , 2020 3655

(2) They shall come into force from the date of their final publication in the official Gazette.

2. Amendment of rule 2.- In rule 2 of the Karnataka Industries (Facilitation) Rules, 2003 (hereinafter referred as the said rules),-

(i) after clause (a) the following shall be inserted, namely:- “(a1)“Acknowledgment certificate” means the acknowledgement certificate issued under clause (h) of sub-section (1) of section 13; (a2) “Applicant” means Medium, Small and Micro Enterprises, Large or Mega manufacturing Enterprises or manufacturing industries, whether a new or expansion Unit; (a3) “Authorized Officer” means the person authorized by Nodal Agency at State level or District level for carrying out the functions assigned in these rules;”

(ii) after clause (b) the following shall be inserted, namely:- “(b1) “Commencement of commercial operation” means the date on which the manufacturing Enterprise or Industry issues the first bill of sale or invoice or tax invoice, of the goods manufactured relating to self-certification in Form II; (b2) “District Level Nodal Agency” means the Nodal Agency at District level as appointed under section 12 of the Act; (b3) “Expansion Unit” means new manufacturing facilities set up by an existing enterprise within the existing facility or in a new site or in an adjacent vacant site for manufacturing a product which is already being manufactured with or without up-gradation of technology or the existing process;”

(iii) after clause (c) the following shall be inserted, namely:- “(c1) "New Unit" means a manufacturing industry or Enterprise which has obtained approval of the State High Level Clearance Committee or State Level Single Window Clearance Committee or District level Single Window Clearance Committee on or after the commencement of the date of the Karnataka Industries (Facilitation) (Amendment) Act, 2020 and includes an enterprise set up or proposed to be set up by an existing enterprise for manufacturing products at a location which is separately identifiable;”

3. Insertion of new rule 8A and 8B.- After rule 8 of the said rules, the following shall be inserted, namely:- “8A. Self certification.- (1) The self certification shall be submitted in Form V by the following, namely:-

(i) the proprietor, in case of proprietary enterprise;

(ii) the authorized partner in case of partnership including L.L.Ps enterprise;

(iii) the Director or the Managing Director in case of private limited or public limited companies; and

(iv) the Chief Executive Officer or Director or Trustees in case of co-operative societies or other forms of enterprises.

(2) In case the enterprise has commercial operations on more than one set of premises, a separate Self Certification shall be submitted for each such set of premises. 3656 ಕ£ಾ�ಟಕ ªಾಜÍಪತÎ,ಗುರು®ಾರ, 12, , 2020 ¨sÁUÀ 4J

8B. Procedure for grant of acknowledgement certificate.- (1) Every manufacturing enterprise or manufacturing industry seeking acknowledgement certificate shall first obtain approval for the project from the State High Level Clearance Committee or State Level Single Window Clearance Committee or District Single Window Clearance Committee and then furnish a duly filled Combined Application Form for obtaining acknowledgment certificate (CAF) in Form IV, along with relevant fees towards services and self certification in Form V, electronically on the online portal of the State level Nodal Agency.

(2) On the receipt of self certification in Form V, the acknowledgement certificate shall be granted in electronic format by the State Level Nodal Agency for the projects approved by the State High Level Clearance Committee or State Level Single Window Clearance Committee and by the District Level Nodal Agency for the projects approved by District level Single Window Clearance Committee in Form VI, stating the date of receipt of self certification and the period of validity of acknowledgement certificate.”

4. Amendment of rule 9.- In rule 9 of the said rules, the following shall be inserted at the end, namely:- “During the period of validity of the acknowledgement certificate, in instances where inspections are warranted, the inspection shall be carried out by such officers of the respective departments in consultation with the nodal agency and approval of the head of the department concerned.”

5. Insertion of new rule 9A and 9B.- After rule 9 of the said rules the following shall be inserted, namely:- “9A. Operationalising the manufacturing enterprise or industry.– (1) The manufacturing enterprise or industry shall make relevant applications for operationalising the unit under applicable Acts, rules etc. within six months before the expiry of the acknowledgement certificate. The acknowledgement certificate issued under sub-section (3) of section 13 shall be the prerequisite document for getting approvals.

(2) If the applicant fails to operationalise the unit within three years from the date of issue of acknowledgement certificate, the applicant has to obtain necessary clearances for setting up or establishment of industry, from the respective departments as per regular procedure.

9B. Functions of the State Level or District Level Nodal Agency.-

(1) The State Level or the District Level Nodal Agency shall act as the coordinating and implementing agency for carrying out the purposes of the Act.

(2) The State Level or District Level Nodal Agency shall appoint one or more authorised officer in the State Level or District Level Nodal Agency for the purpose of issuance of acknowledgement certificate under the Act.

(3) The State Level Nodal Agency shall receive and address the grievances and queries of applicant related to the Act and these rules. ¨sÁUÀ 4J ಕ£ಾ�ಟಕ ªಾಜÍಪತÎ,ಗುರು®ಾರ, 12, , 2020 3657

(4) The State Level Nodal Agency shall maintain the electronic portal for carrying out the purposes of the Act and keep record of self certification and the acknowledgement certificate.

(5) State Level or District Level Nodal Agency shall, on issuance of acknowledgement certificate, forward the self certification and the acknowledgement certificate of applicant to the respective competent authorities or departments.

(6) State Level Nodal Agency shall monitor and maintain the record of the applications or proposals and acknowledgement certificate issued by both State Level or District Level Nodal Agency.

(7)State Level Nodal Agency shall be responsible for co-ordination between the competent authority or departments and the applicant. In case of dispute between the applicant and competent authority or departments, State Level Nodal Agency shall resolve the dispute and may seek directions at State High Level Clearance Committee, as and when required.”

6. (iv) I/We have not previously availed the Acknowledgement Certificate for the land or building. or premises as mentioned in 'Location of Manufacturing Enterprise/Industry' in Self Certification.

(v) I/We will maintain the safety standards in operation of the Enterprise to ensure safety and health of the workers or employees.

(vi) I/We will not engage in any manufacturing which is prohibited under any law or which may pose serious threat to public health or law and order.

(vii) I/We understand that land provided under this certification should be considered for the purpose for which it is being acquired or permission for which it is applied for

(viii) I/We understand the consequences of non-compliance of conditions specified in the Self Certification specified in The Karnataka Industries (Facilitation) (Amendment) Act, 2020.

(ix) I/We understand that in case of any inconsistency/discrepancy with respect to any other information provided elsewhere to the Government, the information provided in the Self Certification would be considered as final.

(x) I/We understand that failure to comply with the conditions specified in the undertaking or the Self Certification given to the nodal agency while applying for acknowledgement certificate or for violating any clause in the applicable Act or rule, while implementing the industrial projects, shall on conviction be punishable with fine which may extend to one lakh rupees for the first offence and for the second and subsequent offence, with fine which may extend to two lakh rupees. In addition, the departments concerned shall initiate penal action under respective Acts

If the Applicant fails to operationalise the unit within 3 years from the date of issue of Acknowledgement Certificate, the Applicant has to obtain necessary clearances for setting up or establishment of industry, from the respective Departments as per regular procedure. vi. 1. ಶೀರ್ಷಾಕೆ ಮತ್ತು ಪ್ರಾ ರಂಭ.- (1) ಈ ನಿಯಮಗಳನ್ನು ಕನಾಟಕ ಕೈಗಾರಿಕೆಗಳ (ಸೌಲಭೆ್ ) (ತಿದ್ದು ಪಡಿ) ನಿಯಮಗಳು, 2020 ಎಾಂದ್ದ ಕರೆಯತ್ಕಕ ದ್ದು .

(2) ಈ ನಿಯಮಗಳು, ಅಧಿಕೃತ್ ರಾಜೆ್ ಪತ್ರ ದಲಿ್ಲ ಅವುಗಳ ಅಾಂತಿಮ ಪರ ಕಟಣೆಯ ದಿನಾಂಕದಿಾಂದ ಜಾರಿಗೆ ಬರತ್ಕಕ ದ್ದು .

2. 2ನೇ ನಿಯಮದ ತಿದ್ದು ಪಡಿ.- ಕನಾಟಕ ಕೈಗಾರಿಕೆಗಳ (ಸೌಲಭೆ್ ) ನಿಯಮಗಳು, 2003 (ಇದರಲಿ್ಲ ಇನ್ನು ಮಾಂದೆ ಸದರಿ ನಿಯಮಗಳಾಂದ್ದ ಉಲಿ್ೇಖಿಸಲಾಗಿದೆ) ರ 2ನೇ ನಿಯಮದಲಿ್ಲ ,-

(i) ಖಂಡ (ಎ) ತ್ರುವಾಯ ಈ ಕೆಳಕಂಡದು ನ್ನು ಸೇರಿಸತ್ಕಕ ದ್ದು , ಎಾಂದರೆ:- 2 “(ಎ1) ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ” ಎಾಂದರೆ, 13ನೇ ಪರ ಕರಣದ (1)ನೇ ಉಪ-ಪರ ಕರಣದ (ಎಚ್) ಖಂಡದ ಮೇರೆಗೆ ನಿೇಡಲಾದ ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣ ಪತ್ರ ; (ಎ2) “ಅರ್ಜಾದಾರ” ಎಾಂದರೆ, ಅದ್ದ ಹೊಸದಾಗಿರಲ್ಲ ಅಥವಾ ವಿಸಿರಣಾ ಘಟಕವಾಗಿರಲ್ಲ ಎಾಂಎಸ್ಎಾಂಇ, ಅತಿಸಣಣ , ಸಣಣ ಮತಿ್ತ ಮಧೆ ಮ ಬೃಹತ್ ಅಥವಾ ದೊಡಡ ಪರ ಮಾಣದ ತ್ಯಾರಿಕಾ ಉದೆ ಮಗಳು ಅಥವಾ ತ್ಯಾರಿಕಾ ಕೈಗಾರಿಕೆಗಳು; (ಎ3) “ಅಧಿಕೃತ್ ಅಧಿಕಾರಿ” ಎಾಂದರೆ, ಈ ನಿಯಮಗಳಲಿ್ಲ ಗೊತಿ್ತಪಡಿಸಲಾದ ಪರ ಕಾಯಾಗಳನ್ನು ನಿವ್ಾಹಿಸ್ತವುದಕಾಕ ಗಿ ರಾಜೆ್ ಮಟಟ ದಲಿ್ಲ ಅಥವಾ ರ್ಜಲಿಾ ಮಟಟ ದಲಿ್ಲ ನೇಡಲ್ ಏಜೆನಿಿ ಗಳು ಅಧಿಕೃತ್ಗೊಳಸಿದ ವೆ್ ಕಿ್ತ ;”

(ii) ಖಂಡ (ಬಿ) ತ್ರುವಾಯ ಈ ಕೆಳಕಂಡದು ನ್ನು ಸೇರಿಸತ್ಕಕ ದ್ದು , ಎಾಂದರೆ:- “(ಬಿ1) “ವಾಣಿಜೆ್ ಕಾಯಾಚಟುವ್ಟಿಕೆಯ ಪ್ರರ ರಂಭ್” ಎಾಂದರೆ, ಉತ್ಪಾ ದನ ಉದೆ ಮ ಅಥವಾ ಕೈಗಾರಿಕೆಯು ನಮೂನೆ-II ರಲಿ್ಲ ಸಾ ಯಂ ಪರ ಮಾಣಿೇಕರಣಕೆಕ ಸಂಬಂಧಿಸಿದಂತೆ ಉತ್ಪಾ ದಿಸಿದ ಸರಕುಗಳ ಮಾರಾಟದ ಮೊದಲ ಬಿಲ್ ಅನ್ನು ಅಥವಾ ಇನ್ ವಾಯಿ್ಸ (ಬೆಲ್ಪಟಿಟ ) ಅಥವಾ ತೆರಿಗೆ ಸರಕು ಬೆಲ್ ಪಟಿಟ ಯನ್ನು ನಿೇಡುವ್ ದಿನಾಂಕ; (ಬಿ2) “ರ್ಜಲಿಾ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿ ” ಎಾಂದರೆ, ಅಧಿನಿಯಮದ 12ನೇ ಪರ ಕರಣದ ಮೇರೆಗೆ ನೇಮಕ ಮಾಡಿದಂತ್ಹ ರ್ಜಲಿಾ ಮಟಟ ದಲಿ್ಲನ ನೇಡಲ್ ಏಜೆನಿಿ ; (ಬಿ3) “ವಿಸಿರಣಾ ಘಟಕ” ಎಾಂದರೆ, ಅಸಿಿತ್ಾ ದಲಿ್ಲರುವ್ ಉದೆ ಮವು ತಂತ್ರ ಜಾಾ ನವ್ನ್ನು ಮೇಲು ಜೆಾಗೇರಿಸ್ತವುದರಾಂದಿಗೆ ಅಥವಾ ಹ್ವಗಿಲಿದೆ ಅಥವಾ ಈಗಿರುವ್ ಕಾಯಾವಿಧಾನದಲಿ್ಲಯೇ ಈಗಾಗಲೇ ತ್ಯಾರಿಸ್ತತಿಿರುವ್ ಉತ್ಾ ನು ವ್ನ್ನು ತ್ಯಾರಿಸ್ತವುದಕೆಕ ಈಗಿರುವ್ ಸೌಲಭೆ್ ದಲಿ್ಲಯೇ ಅಥವಾ ಹೊಸ ಸಥ ಳದಲಿ್ಲ ಅಥವಾ ಪಕಕ ದ ಖಾಲ್ಲ ಸಥ ಳದಲಿ್ಲ ಸಾಥ ಪಿಸಿದ ಹೊಸ ಉತ್ಪಾ ದನ ಸೌಲಭೆ್ ಗಳು”.

(iii) ಖಂಡ (ಸಿ)ಯ ತ್ರುವಾಯ ಈ ಕೆಳಕಂಡದು ನ್ನು ಸೇರಿಸತ್ಕಕ ದ್ದು , ಎಾಂದರೆ:- “(ಸಿ1) “ಹೊಸ ಘಟಕ” ಎಾಂದರೆ, ಕನಾಟಕ ಕೈಗಾರಿಕೆಗಳ (ಸೌಲಭೆ್ ) (ತಿದ್ದು ಪಡಿ) ಅಧಿನಿಯಮ 2020ರ ಪ್ರರ ರಂಭ್ದ ದಿನಾಂಕದಂದ್ದ ಅಥವಾ ನಂತ್ರ, ರಾಜೆ್ ಉನು ತ್ ಮಟಟ ದ ಒಪಿಾ ಗೆ ನಿೇಡಿಕೆ ಸಮಿತಿ ಅಥವಾ ರಾಜೆ್ ಮಟಟ ದ ಏಕಗವಾಕ್ತಷ ಒಪಿಾ ಗೆ ನಿೇಡಿಕೆ ಸಮಿತಿ ಅಥವಾ ರ್ಜಲಿಾ ಮಟಟ ದ ಏಕಗವಾಕ್ತಷ ಒಪಿಾ ಗೆ ನಿೇಡಿಕೆ ಸಮಿತಿಯಿಾಂದ ಅನ್ನಮೊೇದನೆ ಪಡೆದಿರುವ್ ಉತ್ಪಾ ದನ ಕೈಗಾರಿಕೆ ಅಥವಾ ಉದೆ ಮ ಮತಿ್ತ ಇದರಲಿ್ಲ ಪರ ತೆೆ ೇಕವಾಗಿ ಗುರುತಿಸಬಹುದಾದ 3 ಸಥ ಳದಲಿ್ಲ ಉತ್ಾ ನು ಗಳನ್ನು ಉತ್ಪಾ ದಿಸ್ತವುದಕೆಕ ಈಗಿರುವ್ ಉದೆ ಮದ ಮೂಲಕ ಸಾಥ ಪಿಸಿದ ಅಥವಾ ಸಾಥ ಪಿಸಲು ಉದೆು ೇಶಿಸಿದ ಉದೆ ಮವು ಒಳಗೊಳುು ತಿ್ದೆ.”

3. 8ಎ ಮತ್ತು 8ಬಿ ಹೊಸ ನಿಯಮದ ಸೇಪಾಡೆ.- ಸದರಿ ನಿಯಮಗಳ 8ನೇ ನಿಯಮದ ತ್ರುವಾಯ, ಈ ಕೆಳಕಂಡದು ನ್ನು ಸೇರಿಸತ್ಕಕ ದ್ದು , ಎಾಂದರೆ:- “8ಎ. ಸವ ಯಂ ಪಾ ಮಾಣೀಕರಣ.- (1) ಸಾ ಯಂ ಪರ ಮಾಣಿೇಕರಣವ್ನ್ನು ಈ ಕೆಳಕಂಡವ್ರುಗಳು ನಮೂನೆ V ರಲಿ್ಲ ಸಲಿ್ಲಸತ್ಕಕ ದ್ದು , ಎಾಂದರೆ:-

(i) ಮಾಲ್ಲೇಕತ್ಾ ದ ಉದೆ ಮಗಳ ಸಂದಭ್ಾದಲಿ್ಲ ಅದರ ಮಾಲ್ಲೇಕ;

(ii) ಎಲ್.ಎಲ್.ಪಿ ಯ ಉದೆ ಮವು ಸೇರಿದಂತೆ ಪ್ರಲುದಾರಿಕೆಯ ಉದೆ ಮ ಸಂದಭ್ಾದಲಿ್ಲ ಅಧಿಕೃತ್ಗೊಾಂಡ ಪ್ರಲುದಾರ;

(iii) ಖಾಸಗಿ ನಿಯಮಿತ್ ಅಥವಾ ಸಾವ್ಾಜ್ನಿಕ ನಿಯಮಿತ್ ಕಂಪನಿಗಳ ಸಂದಭ್ಾದಲಿ್ಲ ಅದರ ನಿದೇಾಶಕರು ಅಥವಾ ವೆ್ ವ್ಸಾಥ ಪಕ ನಿದೇಾಶಕರು; ಮತಿ್ತ

(iv) ಸಹಕಾರ ಸಂಘಗಳ ಅಥವಾ ಇತ್ರೆ ರಿೇತಿಯ ಉದೆ ಮಗಳ ಸಂದಭ್ಾದಲಿ್ಲ ಮಖೆ್ ಕಾಯಾನಿವಾಾಹಕ ಅಧಿಕಾರಿ ಅಥವಾ ನಿದೇಾಶಕ ಅಥವಾ ಟರ ಸಿಟ .

(2) ಉದೆ ಮವು ಒಾಂದಕ್ತಕ ಾಂತ್ ಹೆಚಿಿ ನ ಸಥ ಳಗಳಲಿ್ಲ ವಾಣಿಜೆ್ ಕಾಯಾಚಟುವ್ಟಿಕೆಯನ್ನು ಹೊಾಂದಿರುವ್ ಸಂದಭ್ಾದಲಿ್ಲ , ಅಾಂಥ ಪರ ತಿಯಾಂದ್ದ ಸಥ ಳಗಳಗೆ ಒಾಂದ್ದ ಪರ ತೆೆ ೇಕ ಸಾ ಯಂ ಪರ ಮಾಣಿೇಕರಣವ್ನ್ನು ಸಲಿ್ಲಸತ್ಕಕ ದ್ದು . 8ಬಿ. ಸ್ವ ೀಕೃತಿ ಪಾ ಮಾಣಪತ್ಾ ವನ್ನು ಮಂಜೂರು ಮಾಡುವ ಪಾ ಕ್ರಾ ಯೆ.- (1) ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣ ಪತ್ರ ವ್ನ್ನು ಕೇರುತಿಿರುವ್ ಪರ ತಿಯಾಂದ್ದ ಉತ್ಪಾ ದನ ಉದೆ ಮ ಅಥವಾ ಉತ್ಪಾ ದನ ಕೈಗಾರಿಕೆಯು, ಮೊದಲು ರಾಜೆ್ ಉನು ತ್ ಮಟಟ ದ ಒಪಿಾ ಗೆ ನಿೇಡಿಕೆ ಸಮಿತಿ ಅಥವಾ ರಾಜೆ್ ಮಟಟ ದ ಏಕಗವಾಕ್ತಷ ಒಪಿಾ ಗೆ ನಿೇಡಿಕೆ ಸಮಿತಿ ಅಥವಾ ರ್ಜಲಿಾಮಟಟ ದ ಏಕಗವಾಕ್ತಷ ಒಪಿಾ ಗೆ ನಿೇಡಿಕೆ ಸಮಿತಿಯಿಾಂದ ಯೇಜ್ನೆಗಾಗಿ ಅನ್ನಮೊೇದನೆಯನ್ನು ಪಡೆಯತ್ಕಕ ದ್ದು ಮತಿ್ತ ನಂತ್ರ, ಸೇವೆಗಳ ನಿೇಡಿಕೆಗೆ ಸಂಬಂಧಿಸಿದ ಶುಲಕ ಗಳೊಾಂದಿಗೆ ಮತಿ್ತ ನಮೂನೆ-V ರಲಿ್ಲ ಸಾ ಯಂ ಪರ ಮಾಣಿೇಕರಣದೊಾಂದಿಗೆ, ರಾಜೆ್ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯ ಆನ್ಲೈನ್ ಪೇಟಾಲ್ನಲಿ್ಲ ವಿದೆ್ದ ನಾ ನ ರೂಪದಲಿ್ಲ ನಮೂನೆ-IV ರಲಿ್ಲ ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ವ್ನ್ನು ಪಡೆಯುವುದಕಾಕ ಗಿ ಸರಿಯಾಗಿ ಭ್ತಿಾ ಮಾಡಿದ ಸಂಯೇರ್ಜತ್ ಅರ್ಜಾ ನಮೂನೆಯನ್ನು (ಸಿಎಎಫ್) ಸಲಿ್ಲಸತ್ಕಕ ದ್ದು .

(2) ನಮೂನೆ-V ರಲಿ್ಲ ಸಾ ಯಂ ಪರ ಮಾಣಿೇಕರಣವ್ನ್ನು ಸಿಾ ೇಕರಿಸಿದ ತ್ರುವಾಯ, ರಾಜೆ್ ಉನು ತ್ ಮಟಟ ದ ಒಪಿಾ ಗೆ ನಿೇಡಿಕೆ ಸಮಿತಿ ಅಥವಾ ರಾಜೆ್ ಮಟಟ ದ ಏಕಗವಾಕ್ತಷ ಒಪಿಾ ಗೆ ನಿೇಡಿಕೆ 4 ಸಮಿತಿಯಿಾಂದ ಅನ್ನಮೊೇದಿತ್ವಾದ ಯೇಜ್ನೆಗಳಗಾಗಿ ರಾಜೆ್ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯು ಮತಿ್ತ ರ್ಜಲಿಾ ಮಟಟ ದ ಏಕಗವಾಕ್ತಷ ಒಪಿಾ ಗೆ ನಿೇಡಿಕೆ ಸಮಿತಿಯಿಾಂದ ಅನ್ನಮೊೇದಿತ್ವಾದ ಯೇಜ್ನೆಗಳಗಾಗಿ ರ್ಜಲಿಾ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯು ನಮೂನೆ-VI ರಲಿ್ಲ ಸಾ ಯಂ ಪರ ಮಾಣಿೇಕರಣದ ಸಿಾ ೇಕೃತಿಯ ದಿನಾಂಕವ್ನ್ನು ಮತಿ್ತ ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣ ಪತ್ರ ದ ಸಿಾಂಧುತ್ಾ ದ ಅವ್ಧಿಯನ್ನು ನಮೂದಿಸಿ ವಿದೆ್ದ ನಾ ನ ನಮೂನೆಯಲಿ್ಲ ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ವ್ನ್ನು ನಿೇಡತ್ಕಕ ದ್ದು .

4. 9ನೇ ನಿಯಮದ ತಿದ್ದು ಪಡಿ.- ಸದರಿ ನಿಯಮಗಳ 9ನೇ ನಿಯಮದಲಿ್ಲ , ಈ ಕೆಳಕಂಡದು ನ್ನು ಕನೆಯಲಿ್ಲ ಸೇರಿಸತ್ಕಕ ದ್ದು , ಎಾಂದರೆ:- “ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣ ಪತ್ರ ದ ಸಿಾಂಧುತ್ಾ ದ ಅವ್ಧಿಯಲಿ್ಲ , ತ್ಪ್ರಸಣೆಗಳನ್ನು ಸಮರ್ಥಾಸ್ತವ್ ಸಂದಭ್ಾಗಳಲಿ್ಲ , ನೇಡಲ್ ಏಜೆನಿಿಯಾಂದಿಗೆ ಸಮಾಲೇಚಿಸಿ ಮತಿ್ತ ಸಂಬಂಧಪಟಟ ಇಲಾಖ್ಯಯ ಮಖೆ್ ಸಥ ರ ಅನ್ನಮೊೇದನೆಯಾಂದಿಗೆ ಸಂಬಂಧಪಟಟ ಇಲಾಖ್ಯಗಳ ಅಧಿಕಾರಿಗಳ ಮೂಲಕ ತ್ಪ್ರಸಣೆಯನ್ನು ಕೈಗೊಳು ತ್ಕಕ ದ್ದು .”

5. 9ಎ ಮತ್ತು 9ಬಿ ಹೊಸ ನಿಯಮದ ಸೇಪಾಡೆ.- ಸದರಿ ನಿಯಮಗಳ 9ನೇ ನಿಯಮದ ತ್ರುವಾಯ, ಈ ಕೆಳಕಂಡದು ನ್ನು ಸೇರಿಸತ್ಕಕ ದ್ದು , ಎಾಂದರೆ:- “9ಎ. ಉತ್ಪಾ ದರ್ನ ಉದಯ ಮ ಅಥವಾ ಕೈಗಾರಿಕೆಯ ರ್ಕಯಾನಿವಾಹಣಾ ಪಾ ಕ್ರಾ ಯೆ.-

(1) ಉತ್ಪಾ ದನ ಉದೆ ಮ ಅಥವಾ ಕೈಗಾರಿಕೆಯು, ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ದ ಅವ್ಧಿಯು ಮಕಿಾಯವಾಗುವ್ ಮಾಂಚೆ ಆರು ತಿಾಂಗಳುಗಳ ಒಳಗಾಗಿ ಅನಾ ಯಿಸಬಹುದಾದ ಅಧಿನಿಯಮಗಳು, ನಿಯಮಗಳು ಮಾಂತ್ಪದವುಗಳ ಮೇರೆಗೆ ಘಟಕದ ಕಾಯಾನಿವ್ಾಹಣೆಗೆ ಸಂಬಂಧಪಟಟ ಾಂತೆ ಸಂಬಂಧಿಸಿದ/ಅವ್ಶೆ ಅರ್ಜಾಗಳನ್ನು ಸಲಿ್ಲಸತ್ಕಕ ದ್ದು . 13ನೇ ಪರ ಕರಣದ

(3)ನೇ ಉಪ-ಪರ ಕರಣದ ಮೇರೆಗೆ ನಿೇಡಲಾದ ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ವು ಅನ್ನಮೊೇದನೆಗಳನ್ನು ಪಡೆಯುವುದಕಾಕ ಗಿ ಪೂವ್ಾಭಾವಿ ದಸಿಾವೇಜು ಆಗಿರತ್ಕಕ ದ್ದು .

(2) ಒಾಂದ್ದ ವೇಳ, ಅರ್ಜಾದಾರನ್ನ ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ವ್ನ್ನು ನಿೇಡಿದ ದಿನಾಂಕದಿಾಂದ ಮೂರು ವ್ಷಾಗಳ ಒಳಗಾಗಿ ಘಟಕದ ಕಾಯಾನಿವ್ಾಹಣೆಯನ್ನು (ಕೆಲಸವ್ನ್ನು ) ಪ್ರರ ರಂಭಿಸಲು ವಿಫಲನದರೆ, ಅರ್ಜಾದಾರನ್ನ ನಿಯತ್ ಪರ ಕ್ತರ ಯೆಯ ಅನ್ನಸಾರವಾಗಿ ಕೈಗಾರಿಕೆಯನ್ನು ಸಾಥ ಪಿಸ್ತವುದಕಾಕ ಗಿ ಸಂಬಂಧಪಟಟ ಇಲಾಖ್ಯಗಳಾಂದ ಅವ್ಶೆ ಕ ಅನ್ನಮತಿಯನ್ನು ಪಡೆಯತ್ಕಕ ದ್ದು . 9ಬಿ. ರಾಜ್ಯ ಮಟಟ ದ ಅಥವಾ ಜಿಲ್ಲಾ ಮಟಟ ದ ನೀಡಲ್ ಏಜೆನಿಿ ಯ ಪಾ ರ್ಕಯಾಗಳು.- (1) ರಾಜೆ್ ಮಟಟ ದ ಅಥವಾ ರ್ಜಲಿಾ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯು, ಈ ಅಧಿನಿಯಮದ ಉದೆು ೇಶಗಳನ್ನು ಕಾಯಾಗತ್ಗೊಳಸ್ತವುದಕಾಕ ಗಿ ಸಮನಾ ಯ ಮತಿ್ತ ಅನ್ನಷ್ಠಾ ನ ಏಜೆನಿಿಯಾಗಿ ಕಾಯಾನಿವ್ಾಹಿಸತ್ಕಕ ದ್ದು . (2) ರಾಜೆ್ ಮಟಟ ದ ಅಥವಾ ರ್ಜಲಿಾ 5 ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯು, ಈ ಅಧಿನಿಯಮದ ಅಡಿಯಲಿ್ಲ ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ದ ನಿೇಡಿಕೆಯ ಉದೆು ೇಶಕಾಕ ಗಿ ರಾಜೆ್ ಮಟಟ ದ ಅಥವಾ ರ್ಜಲಿಾ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯಲಿ್ಲ ಒಬಬ ರು ಅಥವಾ ಅದಕ್ತಕ ಾಂಥ ಹೆಚಿಿ ನ ಅಧಿಕೃತ್ ಅಧಿಕಾರಿಯನ್ನು ನೇಮಕಮಾಡತ್ಕಕ ದ್ದು .

(3) ರಾಜೆ್ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯು, ಅಧಿನಿಯಮ ಮತಿ್ತ ಈ ನಿಯಮಗಳಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಅರ್ಜಾದಾರನ ಕುಾಂದ್ದಕರತೆಗಳನ್ನು ಮತಿ್ತ ಪರ ಶ್ನು ಗಳನ್ನು ಸಿಾ ೇಕರಿಸತ್ಕಕ ದ್ದು ಮತಿ್ತ ಅವುಗಳನ್ನು ಪರಿಹರಿಸತ್ಕಕ ದ್ದು .

(4) ರಾಜೆ್ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯು, ಅಧಿನಿಯಮದ ಉದೆು ೇಶಗಳನ್ನು ಕಾಯಾಗತ್ಗೊಳಸ್ತವುದಕಾಕ ಗಿ ವಿದೆ್ದ ನಾ ನ ಪೇಟಾಲ್ ಅನ್ನು ನಿವ್ಾಹಿಸತ್ಕಕ ದ್ದು ಮತಿ್ತ ಸಾ ಯಂ ಪರ ಮಾಣಿೇಕರಣದ ಮತಿ್ತ ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ದ ದಾಖ್ಲ್ಯನ್ನು ಸರಿಯಾದ ರಿೇತಿಯಲಿ್ಲ ನಿವ್ಾಹಿಸತ್ಕಕ ದ್ದು .

(5) ರಾಜೆ್ ಮಟಟ ದ ಅಥವಾ ರ್ಜಲಿಾ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯು, ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣ ಪತ್ರ ವ್ನ್ನು ನಿೇಡಿದ ಮೇಲ್, ಅರ್ಜಾದಾರನ ಸಾ ಯಂ ಪರ ಮಾಣಿೇಕರಣ ಪರ ಮಾಣಪತ್ರ ವ್ನ್ನು ಮತಿ್ತ ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ವ್ನ್ನು ಸಂಬಂಧಪಟಟ ಸಕ್ಷಮ ಪ್ರರ ಧಿಕಾರಿಗಳಗೆ ಅಥವಾ ಇಲಾಖ್ಯಗಳಗೆ ಕಳುಹಿಸತ್ಕಕ ದ್ದು .

(6) ರಾಜೆ್ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯು, ರಾಜೆ್ ಮಟಟ ದ ಅಥವಾ ರ್ಜಲಿಾ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿ ಈ ಎರಡರಿಾಂದಲೂ ನಿೇಡಲಾದ ಅರ್ಜಾಗಳ ಅಥವಾ ಪರ ಸಿಾವ್ನೆಗಳ ಮತಿ್ತ ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ದ ದಾಖ್ಲ್ಯನ್ನು ಮೇಲ್ಲಾ ಚಾರಣೆ ಮಾಡತ್ಕಕ ದ್ದು ಮತಿ್ತ ನಿವ್ಾಹಿಸತ್ಕಕ ದ್ದು .

(7) ರಾಜೆ್ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯು ಸಕ್ಷಮ ಪ್ರರ ಧಿಕಾರ ಅಥವಾ ಇಲಾಖ್ಯಗಳು ಮತಿ್ತ ಅರ್ಜಾದಾರನ ನಡುವೆ ಸಮನಾ ಯ ಸಾಧಿಸ್ತವುದಕಾಕ ಗಿ ಜ್ವಾಬಾು ರಿಯಾಗಿರತ್ಕಕ ದ್ದು . ಅರ್ಜಾದಾರನ ಮತಿ್ತ ಸಕ್ಷಮ ಪ್ರರ ಧಿಕಾರದ ಅಥವಾ ಇಲಾಖ್ಯಗಳ ನಡುವೆ ವಿವಾದಗಳು ಉಾಂಟಾದ ಸಂದಭ್ಾದಲಿ್ಲ , ರಾಜೆ್ ಮಟಟ ದ ನೇಡಲ್ ಏಜೆನಿಿಯು, ಅಾಂಥ ವಿವಾದವ್ನ್ನು ಬಗೆಹರಿಸತ್ಕಕ ದ್ದು ಮತಿ್ತ ಅಗತೆ್ ವೆನಿಸಿದಾಗ ರಾಜೆ್ ಉನು ತ್ ಮಟಟ ದ ಒಪಿಾ ಗೆ ನಿೇಡಿಕೆ ಸಮಿತಿಯಿಾಂದ ನಿದೇಾಶನಗಳನ್ನು ಪಡೆಯಬಹುದ್ದ.”

6. ಹೊಸ ನಮೂನೆ IV, V, ಮತ್ತು VI ರ ಸೇಪಾಡೆ.- ಸದರಿ ನಿಯಮಗಳಗೆ ಸೇರಿಸಲಾದ ನಮೂನೆ-III ರ ತ್ರುವಾಯ, ಈ ಕೆಳಕಂಡ ಹೊಸ ನಮೂನೆಗಳನ್ನು ಸೇರಿಸತ್ಕಕ ದ್ದು , ಎಾಂದರೆ:- ನಮೂನೆ-IV (8ಬಿ ನಿಯಮವ್ನ್ನು ನೇಡಿ) ಸಿಾ ೇಕೃತಿ ಪರ ಮಾಣಪತ್ರ ವ್ನ್ನು ಪಡೆಯುವುದಕಾಕ ಗಿ ಸಂಯೇರ್ಜತ್ ಅರ್ಜಾ ನಮೂನೆ (ಭಾಗ-ಎ ಮತಿ್ತ ಭಾಗ-ಬಿ ರಲಿ್ಲ ಅರ್ಜಾಯ ವಿವ್ರಗಳು) ಘೀಷ್ವವ ರೆ 6 ಕಾ ಮ ಸಂಖ್ಯಯ ಒಪ್ಪಾ ಗೆಗಳು ಇಲ್ಲಖ್ಯ ಅನವ ಯಿಸುವಿಕೆ ಹೌದ್ದ/ಇಲ್ಾ ಶುಲ್ಕ ಸಂದಾಯ (ಹೌದ್ದ/ಇಲ್ಾ )

1. ಕೃಷಿ ಭೂಮಿಯನ್ನು ಖ್ರಿೇದಿಸ್ತವುದಕಾಕ ಗಿ ಕನಾಟಕ ಭೂ ಕಂದಾಯ ಅಧಿನಿಯಮ [KLR] ದ 109ನೇ ಪರ ಕರಣದ ಮೇರೆಗೆ ಅನ್ನಮತಿಗಳು. ಕಂದಾಯ ಇಲಾಖ್ಯ

2. ಕೃಷಿಯೇತ್ರ ಉದೆು ೇಶಕಾಕ ಗಿ ಭೂಮಿಯ ಪರಿವ್ತ್ಾನೆ ಮಾಡುವುದ್ದ. ಕಂದಾಯ ಇಲಾಖ್ಯ

3. ಮರವ್ನ್ನು ಕಡಿದ್ದ ಹ್ವಕುವುದಕೆಕ /ಕತಿ್ರಿಸಿ ಕೆಡವುದಕೆಕ ಅನ್ನಮತಿ ಪಡೆಯುವುದ್ದ.  ಬಿಬಿಎಾಂಪಿ  ಕನಾಟಕ ಅರಣೆ ಇಲಾಖ್ಯ

4. ಮರ ಸಾಗಾಣಿಕೆಗೆ ಅನ್ನಮತಿ ಪಡೆಯುವುದ್ದ. ಕನಾಟಕ ಅರಣೆ ಇಲಾಖ್ಯ

5. ಕಟಟ ಡದ ನಕೆಷ ಗೆ ಅನ್ನಮೊೇದನೆ ಪಡೆಯುವುದ್ದ.  ಕೆಐಎಡಿಬಿ  ಕೆಎಸ್ಎಸ್ಐಡಿಸಿ  ಬಿಡಿಎ  ಬಿಬಿಎಾಂಪಿ  ಇತ್ರೆ ನಗರ ಸಥ ಳೇಯ ಸಂಸೆಥ [ಯುಎಲ್ಬಿ]/ ಸಥ ಳೇಯ ಯೇಜ್ನ ಪ್ರರ ಧಿಕಾರಗಳು ಮತಿ್ತ  ಪಂಚಾಯಿತಿಗಳು 7

6. ಪ್ರರ ರಂಭ್ದ ಪರ ಮಾಣಪತ್ರ .  ಕೆಐಎಡಿಬಿ  ಕೆಎಸ್ಎಸ್ಐಡಿಸಿ  ಬಿಡಿಎ  ಬಿಬಿಎಾಂಪಿ  ಇತ್ರೆ ನಗರ ಸಥ ಳೇಯ ಸಂಸೆಥ [ಯುಎಲ್ಬಿ]/ ಸಥ ಳೇಯ ಯೇಜ್ನ ಪ್ರರ ಧಿಕಾರಗಳು ಮತಿ್ತ  ಪಂಚಾಯಿತಿಗಳು

7. ಕಟಟ ಡದ ನಿಮಾಾಣಕಾಕ ಗಿ ಅಗಿು ಶಾಮಕ ಮತಿ್ತ ತ್ತತ್ತಾ ಸೇವೆಗಳ ನಿರಾಕೆಷ ೇಪಣ ಪರ ಮಾಣಪತ್ರ (ಎನ್ಒಸಿ) ಪಡೆಯುವುದ್ದ. ಕನಾಟಕ ರಾಜೆ್ ಅಗಿು ಶಾಮಕ ಮತಿ್ತ ತ್ತತ್ತಾ ಸೇವೆಗಳ (ಕೆಎಸ್ಎಫ್ಇಎಸ್) ಇಲಾಖ್ಯಯಿಾಂದ

8. ಕಟಟ ಡ ಪೂಣಾಗೊಾಂಡ ನಂತ್ರ ಅಗಿು ಶಾಮಕ ಮತಿ್ತ ತ್ತತ್ತಾ ಸೇವೆಗಳ ಒಪಿಾ ಗೆ ಪರ ಮಾಣಪತ್ರ ಪಡೆಯುವುದ್ದ. ಕನಾಟಕ ರಾಜೆ್ ಅಗಿು ಶಾಮಕ ಮತಿ್ತ ತ್ತತ್ತಾ ಸೇವೆಗಳ (ಕೆಎಸ್ಎಫ್ಇಎಸ್) ಇಲಾಖ್ಯಯಿಾಂದ
