(22) ෴โඃ ಪ ෨ಖ เಷಯಗำ ಷฃඅಂൽಡ. ಕකბಟಕ ฃಜ ඩಲರ ಆඃ๎ඝರ ಮൡ౨ ಅವರ ກಸคನย , (ಕมವൟ.ಎ.ಎඨ) ಸ౽ბರದ ಉಪ ౽ಯბದ๏ბ ಉർಯ ಇมಒ [ಸಮನ౷ ಯ, ๅಗำ-2 ಮൡ౨ & ඩ ] 6 GOVERNMENT OF KARNATAKA No: RD 15 RBA 2022 karnataka Government secretariat Multi Stored Building Bengaluru, Dated:28.08.2024 Notification The following rules further to amend the Kitturu Development Authority Act, 2011, which the Government of Karnataka proposes in exercise of the powers conferred by section 40(1) of the Kitturu Development Authority Act, 2011, (Karnataka Act 10 of 2012) is hereby published as required by sub-section (1) of the said section, vide Notification NO: RD 15 RBA 2022, Dated 05.03.2024, in part IV-A of the of the Karnataka Gazzete dated 13.03.2024 inviting objections and suggestions from all the persons likely to be affected thereby within fifteen days from the date of its publication in the official Gazette Where the said Gazette was made available to the public on 13.03.2024 And whereas no objections and suggestions were received by the State Government with in the period of specified above. Now therefore in exercise the powers conferred by section 40(1) of the Kitturu Development Authority Act, 2011, (Karnataka Act 10 of 2012) the Government of Karnataka, proposes to make The Kitturu Development Authority Act, 2011, (Karnataka Act 10 of 2012) as follows. Namely; RULES
1. Short title and Commencement:(1) These rules may be called the Kitturu Development Authority Rules, 2024.
(2) They shall come into force with effect from the date of their publication in the official gazette.
2. Definitions: In these rules, unless the context otherwise requires :- a. “Act” means the kitturu Development Authority Act, 2011( Karnataka Act No. 10 of 2012). b. “Section” means section of the Act; and c. “Proforma” means proforma appended to these rules.
3. Travelling Allowance to Non-Official Members: The Non- Official members means members nominated under sub-section 4(t) & (u) of Section 3 of the Act. They shall entitle to get Travelling Allowance and sitting Allowance at rates fixed by the Government from time to time as per Annexure “A” of the Karnataka Government Service Rules. 7
4. Execution of Contracts: In order to execute the works or supply any materials, goods or render services on behalf of or in favour of the Authority, the rules and forms, if any, made by the Government from time to time, shall be followed, as far as practicable, and to the extent that they are not inconsistent with the provisions of the Act and these rules. The Commissioner shall place the same before next meeting of the Authority. If the Authority decides to do any modification or annual the proceedings of the Commissioner, the proceedings shall have effect only in such modified form or shall not have effect as the case may be from the date of the decision of the Authority modifying or annulling the proceedings of the Commissioner.
5. Conditions for receiving funds by the Authority: The State Government may, at the time of according sanction under clause (b) of sub-section (2) of Section 8 for receiving funds by the Authority, impose such conditions as may be mutually agreed to between the Authority and the Government.
6. Employees of the Authority: (1) The qualifications, mode of appointment and conditions of service of the Commissioner and other employees of the Authority shall be equivalent to that of Karnataka Government Employees.
(2) Every post created by the Authority shall be equivalent to a post under the Government. The Authority shall create each post with the approval of the Government.
(3) Every post under the Authority shall as far as practicable, be filled by deputation of employees of the Government of Karnataka or the Union Government or any other State Government in India or of the employees of any autonomous body within the limits of India.
(4) The pay scales applicable to the employees of the Authority shall be the pay scales applicable to equivalent posts under the Government of Karnataka.
(5) The Karnataka Civil Service Rules shall apply to employees of the Authority as far as they are not inconsistent with these rules.
(6) The employees of the Authority shall be governed by the Karnataka Civil Service (Conduct) Rules, 2021 and such other service rules applicable to the employees of the State Government, as may be notified by the Authority from time to time.
7. Disclosure of contents in the note of the Authority: (1) Under sub- sections 1, 2 and 3 of section 16, if consultation is made with any parties about facts of the subject and decision, then, the opinion of the parties and final recommendations of the Commissioner shall be disclosed in note of the Authority to be sent through circular. 8
(2)The Commissioner shall affix his signature on every such note of the Authority.
8. Conditions regarding selling of immovable property of the Authority: (1) No immovable property and movable property of the Authority worth more than one lakh shall be alienated without prior permission of the Government.
(2) The waste materials shall be sold as per the Karnataka Government Financial Code with prior permission of the Authority.
9. Form of the Budget: At the month of December every year, the Authority shall prepare a budget of next financial year, with annexures, as far as applicable similar to the form prescribed by the Finance Department of the Government.
10. Accounts Books and other Forms of registers: (1) The provisions of the Karnataka Financial Code, 1958 and the forms framed there under shall be applicable to the accounts of the Authority, mutatis mutandis .
(2) If the Government of Karnataka has not framed the regulations and /or forms suitable for the objective of the Authority, the Commissioner may specify regulations and forms to be followed and restriction of post-facto approval of the Authority shall be applicable mutatis mutandis as specified in Rule 4.
11. Reports: The Authority shall submit an audit report within the end of July every year. However, an Annual Administrative Report comprising the matters prescribed by the Government in Proforma 1 and major activities planned, undertaken and completed, financial position, staff and powers and other similar matters, shall be prepared and get approved by the Board and it shall be submitted to the Government at the end of June for the each forth coming financial year. The Government may cause to be published such report in the Official Gazette. Proforma-I (See Rule 11) Annual Administrative Report of the Kitturu Development Authority for the year. . . . . . . a. 1. Constitution of the Authority, disqualification, removal, etc.
2. Names of members of the Authority and their capacity as and Ex-officio or nominated or appointed members.
3. No. of Meetings of Authority held during the report year and reasons for not conducting such number of meetings as may be required. 9
4. (a) No. of Meetings of Executive Committee held during the report year and reasons for not conducting such number of meetings as may be required.
(b) List of members of the Authority and the Executive Committee who remained absent for the consecutive meetings or more number of meetings.
5. Constitution of Committees and Sub-Committees of the Authority.
6. Number of meetings held separately for every Committee/Sub-committee.
7. Officers and employees of the Authority.
8. Premises of the Authority and its officers and employees.
9. Furnitures and office materials.
10. Immovable property other than shown in the above item 8.
11. Motor vehicals, equipments and immovable objects.
12. Maintenance of books and proformas /forms and records.
13. Security, safety and custody of cash, valuable documents and important records.

(b) Bank account number and nature of bank account.
(c) Balance. II. Deposits and nature of deposits. III. Loans raised and its expenditure. IV. Details of grants, gratuity, contributions, donations and gifts. 10
(19) Maintenance of accounts and audit and their stage.
(20) Cases of action taken or recommendation made in the cases such as misappropriation of money and financial loss, loss of property, encroachment of property during the financial year.
(21) The Commissioner shall inspect the schemes executed by the authorised agencies along with the officers of his office and the authorised agencies, and execute the works by making notes of the schemes.
