1 LEGISLATURE SECRETARIAT KARNATAKA LEGISLATURE SECRETARIAT NOTIFICATION NO. ADM-1/180/SB/91, Bangalore, dated 1st June 1991 THE KARNATAKA LEGISLATURE (MEMBERS FREE TRANSIT BY AIR AND RAILWAYS) RULES 1990.
In exercise of the powers conferred by Section 15 read with clause (CCC) of Section 12 of the Karnataka Legislature Salaries, Pensions and Allowance Act, 1956 (Karnataka Act 2 of 1957), the Special Board of Karnataka Legislature hereby makes the following rules, namely :
I. Short Title and Commencement : (1) These rules may be called the karnataka Legislature (Members Free Transit by Air and Railways) Rules, 1990.
(2) They shall be deemed to have come into force from the 1st day of November, 1990
2. Definition :- In these Rules, unless the context otherwise require-
(i) 'Act' means the Karnataka Legislature Salaries, Pensions and Allowances Act, 1956 (Karnataka Act 2 of 1957)
(ii) 'Member' means a member of the Karnataka Legislative Assembly or of the Karnataka Legislative Council and includes a Minister, a Minister of State, a Deputy Minister, a Chairman, a Speaker, a Deputy Chairman, a Deputy Speaker, Leader of Opposition and a Government Chief Whip.
(iii) 'Secretary' means the Secretary to the Karnataka Legislature and includes a Deputy Secretary or Under Secretary of the Karnataka Legislature.
3. Subject to the provisions of these rules, every member may travel singly or with a companion, by Air or Rail in any part of India.
(ii) For the Journey so performed by Air, he shall be entitled for reimbursement of the fare paid for the said journey on production of the used Air Tickets.
(iii) For the Journey so performed by Rail, the Member shall furnish details of the journey so performed, the ticket number and the fare paid for such journey, so as to claims the benefit of reimbursement of the actual fare paid.
(iv) The air Fare/Railway Fare paid, shall be reimbursed by the Secretary, Karnataka Legislature, to the member by cheque to the maximum limit of rupee ten thousand for every financial year.

(v) The journey so performed and the members claim for reimbursement shall be valid for the year reckoned from 1st March to the last day of February of next year.
4. The Karnataka Legislature (Members Free Transit by Railways) Rules, 1979, are hereby repealed.

In exercise of the powers conferred by Section 15 read with clause (CCC) of Section 12 of the Karnataka Legislature Salaries, Pensions and Allowance Act, 1956 (Karnataka Act 2 of 1957), the Special Board of Karnataka Legislature hereby amends the Karnataka Legislature (Members Free Transit by Air and Railways) Rules, 1990, namely :
1. Short Title and Commencement : (1) These rules may be called the Karnataka Legislature (Members Free Transit by Air and Railways) (Amendment) Rules, 1993.
(2) They shall be deemed to have come into force on the 1st day of November,
1990.
2. Amendment of Long Title :- In the long title of the Karnataka Legislature (Members Free Transit by Air and Railways) Rules, 1990 (hereinafter referred to as said rules), for the words "Free Transit by Air and Railways" the words "Transit by Air and Railways Allowance" shall be substituted.
3. Amendment of Rule I. :- In sub-rule (1) of Rule 1 of the said rules, for words "Free Transit by Air and Railways", the words "Transit by Air and Railways Allowance", shall be substituted.
4. Amendment of Rule 3- For rule 3 of the said rules, the following rule shall be substituted, namely :
"3(1) Every Member shall for every financial year, be paid a sum of Rs.
10,000/- (Rupees ten thousand only) towards transit by air and railway allowance in two equal instalments payable in the months of April and October.
(ii) On receipt of the requisition from a Member for claiming transit by Air and Railway Allowance for first/second instalment, the Secretary shall scrutinise the claim, and pass for payment. A Bill for payment of such allowance shall be prepared in Form "A" annexed to these rules.
(iii) The said allowance shall be paid by the Secretary by cheque to the Member concerned".
5. Insertion of Form 'A'- After rule 4, of the said rules, the following form shall be inserted namely :
FORM 'A' (See Rule 3) Head of Account : "2011 - State Legislature 020 - State Legislature 101-05- Legislative Assembly/ 102 - Legislative Council 07 - Other Expenditure (v).

In exercise of the power conferred by section 15 read with clause (ccc) of section 12 of the Karnataka Legislature Salaries, Pensions and Allowances Act, 1956 (Karnataka Act 2 of 1957) Secretary, Karnataka Legislature with the approval of the Special Board hereby makes the following rules further to amend the Karnataka Legislature (Members Free Transit by Air and Railway) Rules, 1990, Namely :-
1. Short Title and Commencement - (1) These rules may be called the Karnataka Legislature (Members Free Transit by Air and Railways) Amendment Rules,
1997.
(2) They shall be deemed to have come into force from the first day of September 1997.
2. Amendment of Rule 3 : In rule 3 of the Karnataka Legislature (Members Free Transit by Air and Railways) Rules 1990, in clause (iv).
(i) for the words "ten thousand" the words 'Twenty thousand" shall be deemed to have been substituted with effect from the first day of September, 1993;
(ii) for the words 'twenty thousand' as so substituted the words' 'Thirty thousand' shall be deemed to have been substituted with effect from the first day of September 1997.
