Section 6: Term of expert members

(1) Every expert non-official member appointed under sub-rules (2) and (3) of rule 4 shall subject to the pleasure of State Government hold office for a period of five years or until;- a) he resigns his office writing under his hand and addressed to the Chairperson, and it his resignation is accepted by the Chairperson the resignation shall take effect from the date of his acceptance;

b) he is removed from office by an order of the State Government, if the State Government considers:- i. that he has misused the powers of his office;

ii. that he holds any office of profit under the Government of India or the Government of any state specified in the First schedule to the Constitution of India, or under any local or other authority subject to the control of any of the said Government other than such offices as are declared by rules made under said Act not to disqualify the holder:

Provided that no such order shall be passed for removal under clause (i) against any expert non-official member without giving him a reasonable opportunity of being heard; or

(c) he had been adjudged as of unsound mind by a competent court of law; or .

(d) he has been elected as a. member to a Municipal Corporation or a .

Municipality or Zilla Panchayat or Taluk Panchayat or Gram Panchayat or to the State Legislature or to the Parliament.

(2) In case of occurrence of any vacancy in the seat of Expert member, due to resignation, removal or otherwise, the State Government may appoint a new expert non-official member to fill the vacancy.
