Section 42: Duties of Superintendent

(1) The Superintendent shall give effect to every resolution of the Visiting Committee which is in accordance with the provisions of the Act and these rules. if in the opinion of the Superintendent any resolution is inconsistent with the Act or these rules or if it is inexpedient to give effect to any such resolution, he shall obtain the orders of the inspector General on such resolution,. If the Inspector General agrees with him the Superintendent shall communicate his views with the orders of the Inspector General to the Chairman of the Visiting Committee. If the Inspector General takes a different view and directs him to give effect to the resolution he shall do so.

(2) The Superintendent shall-

(a) bring to the notice of the Visiting Committee.

(i) the cases of all inmates falling within the scope of section 15 of the Act.

(ii) the cases of all inmates who. Owing to mental deficiency are unfit for Borstal Training and ..12 -12-

(b) advise the Visiting committee on the merits of each case”
