1. Title, commencement and application. - (1) These rules may be called the Karnataka Animal Husbandry and Veterinary Services (Cadre and Recruitment) (Amendment) Rules, 2022.
(2) They shall come into force on the date of their publication in the official Gazette.
2. Amendment of Schedule. –In the Schedule of the Karnataka Animal Husbandry and Veterinary Services (Cadre and Recruitment) Rules, 2017, at serial number 26, in the entries relating to the category of post of “Veterinary Assistant”,
(i) in column (2), for the words “Veterinary Assistants” and wherever they occur in the schedule, the words “Junior Veterinary Inspector” shall be substituted; and
(iii) in column (5), serial number (3) and the entries relating thereto shall be omitted. (2) They shall come into force from the date of their publication in the Official Gazette.

3. Wharfage shall be in addition to any charges towards rent for storage of goods in the quays, warehouses, transit sheds or landing places of the port.

The Stevedores/Custom House Agent (CHA)/Port User filing export application to the Port Authority shall be held solely and severally responsible for any Act or omission for breach of any Laws, Acts, Rules, Procedures, Orders etc., and for authentication of any documents / papers filed before the Port Authorities in respect of the cargo loaded / unloaded to the vessels. ¨sÁUÀ 4J , , 14 , 2022 5657
5. The Stevedores/CHA/Port User filing export application to the Port Authority shall be held solely and severally responsible for the authentication of the quantity of cargo loaded / unloaded to the vessels.
6. All goods intended for shipment shall be assessed on Shipping Bill.
7. All goods landed within the limits of the port shall be assessed on import application and the wharfage shall be paid before the goods are delivered.
8. The port shall not assume custody of any export cargo / import cargo and handle the same at the wharf or jetties.
9. Overtime allowance admissible.
10. For the purpose of levy of fees, less than half metric tonne shall be reckoned as half metric tonne and half Metric Tonne and more but less than one tonne shall be reckoned as one Metric tonne.
11. Tiles, Bricks, Coconuts (The rates in respect of which have been fixed for unit of 1,000) 500 and above will be reckoned as one unit and below 500 will be charged at half the rates.
12. Where the unit of charge is by weight it shall be the gross weight and not the net weight.
13. Where the unit of charge is by measurement 1.4 cubic meters (40-44 cft) shall be reckoned as one metric tonne.
14. The weight of firewood loaded upto the gunwale will be calculated at two thirds of the registered tonnage of the vessel and if loaded above the gunwale it will be taken as three fourths of tonnage of the vessels. When the firewood is loaded below the gunwale or if some other cargo is also loaded in the same vessel the fees shall be levied on firewood, be actual measurement adopting 2 cubic meters equal to one metric tonne.
15. 0.5 Metric tonne or above, or 0.7 cubic meter and above shall be reckoned as one metric tonne and below that quantity shall be reckoned as half tonne.
16. 0.5 Cubic meters and above shall be reckoned as one cubic meter.
17. Goods exempted from wharfage charges. i. Bonafede consumable / non consumable ship stores. 5658 , , 14 , 2022 ¨sÁUÀ 4J ii. Passenger and seaman’s Bonafede baggage and personal effects accompanying them. iii. Empty gunnies and twines / Dunnage wood sent to ship to facilitate landing or loading of cargoes.
18. Penalty under sub-section (2) of Section 3 of the Act,shall be payable at Twenty Five Percent per annum on the delayed payments of any charge under the schedule of rates. (Delay in payments by user will be counted only 7 days after the date of raising the bills by Port Authority)

4. If cargo is stacked on any of river bed before shipment or after landing instead of within the public landing place, such river bed shall be deemed to be included, within the extent of landing place and ground rent levied accordingly.
5. Conservator of the Port directed by the Government Under section 4 of the Act may grant the land to a maximum period of 11 months on first come first serve basis / nomination basis (as per the Karnataka Minor Port Land Allotment Guidelines 2020).
6. Karnataka Maritime Board can allot port land inside custom bond area for a period of more than 11 months.
7. Subletting of Port premises including buildings shall not be permitted.
8. Sugar and Pulses and other essential commodities as declared by the Government of India shall not be allowed to remain in the port area after thirty days. In case such cargoes remain after thirty days demurrage at the rate of Rs. 5/- per wharfage unit per day shall be levied in addition to the fees specified above. ¨sÁUÀ 4J , , 14 , 2022 5661
9. The port land shall be allotted as per the Karnataka Minor Ports Land Allotment Guidelines 2020 and any revision.
10. The Application Form for grant of long lease, execution of the lease agreement, penalty etc, will be as per the Karnataka Minor Ports Land Allotment Guidelines 2020.

6. The vessel for whose convenience an adjacent berthis kept vacant due to the nature of cargo to be handled at that particular berth shall be charged berth hire charges applicable to the berths kept vacant in addition to berth hire charge for the berth occupied by the vessel. Explanation:-
1. The rates of Overtime fees will be the same for indoor and outdoor works.
2. The Duty hours will be from 10 A.M to 5.30 P.M on all the working days both for the indoor and outdoor works as specified by the Government or the competent Authority from time to time.
3. Holidays means the holidays declared for the office of the Karnataka Port and Inland Water Transport Department by the Government or the Competent Authority from time to time.
4. Pay indicated above is the Basic pay as per the Karnataka Civil Services (revised pay) Rules, 2018 consequent to subsequent revision of the pay scale, if any, the corresponding stage of pay fixation under this subsequent revision of pay scales should be taken into consideration for admissibility of the overtime fixed to the employees coming under the corresponding stage of pay.
5. In calculating the overtime fees for the period excess of one hour, the period of 15 minutes and less shall be ignored, while the period of over 15 minutes shall be reckoned as one hour. However if the total overtime period is less than one hour the same will be treated as one hour.
6. The total monthly overtime fees admissible to an employee during the month shall be restricted to a maximum limit of fifty of his total monthly emoluments (i.e., 50% of the pay + various allowances admissible to him thereon during the month) and remaining overtime fees amounting excess of 50% of his monthly emoluments shall be credited into the Government Treasury to the Port Department head of account concerned.
7. While calculating one hour overtime fees, 11/2 hourly time of overtime fees admissible to the employee deputed for the overtime work will be collected from the 5676 , , 14 , 2022 ¨sÁUÀ 4J Shippers / shipping agent / Private Parties concerned and out of such 11/2hour times of overtime fees collected an amount of one hourly, time of overtime fees will be paid concerned employee who is deputed for the overtime work. And the remaining half hour overtime fees will be credited into the Government Treasury, to the Port Department head of account concerned.
8. The above overtime fees rates according to the pay of the employees concerned are applicable to all the officers / Official (i.e., all groups C and D employees) of the Karnataka Ports Department including the executive staff, Ministerial staff, supervisory staff, staff / Crew working on the Departmental floating crafts and the equipment, who are actually engaged for the overtime works.

(iv) The party interested in handling container will have to make their own arrangement for bringing the container to the port area.
(v) As far as possible the container vessels at the port shall be given preference over other general cargo vessel.
(vi) Information about the arrival and details of container vessels expected to call at the port should be furnished to the port officer one week in advance.
(vii) Application for allotment of open space at Wharf for storage of container should reach Port Officer, Karwar for seven days in advance.
(viii) The applicant shall accept all risk and responsibility for goods stored at the rental space so allotted and shall make his own arrangement for security of the goods stored in such space.
(ix) No container should be left over the Wharf so as to pose hindrance of the Port operation.
(x) Hire charges for the port machineries whenever utilized by the Shipper, will be charged separately according to the scale of rates in force from time to time.

7. In case of emergent repairs of departmental crafts or other Government crafts the user will have to vacate the Dry Dock within twenty four hours of intimation.
8. User shall have to pay all the fees before undocking of the respective vessel from the Dry Dock.
