Section 38: With-holding of marks card or pass Certificate

Where there is a doubt that a second year annual pre-University marks card or Certificate is not genuine or not the one issued by the Department, the Director shall detain such marks card or pass Certificate and make such enquiry as he the deems fit, after giving the candidate an opportunity or being heard and may order withholding the marks card or pass certificate or to return it to the candidate. The burden of proving the genuineness of such marks card or pass certificate shall be on the candidate. The Director may take appropriate action in accordance with law against persons responsible for altering or fabricating or forging a marks card or pass certificate.
