Whereas the said Gazette was made available to the public on 6th August, 2q01.

And ufrereas the obiec{ions and suggestions received have been considered.

Now, therefore in exercise of the poners confened by sr.rFsection (1) of section 3 read with seclion I of the lQmataka Strate CMI Services Act, 1978 (Kamatalra Act 14 of 1990), the Govemment of lGmataka hereby rnake the follwving rules, namely :- RUTES l. Titfe, Gommencement and Appliadion :- (1) These rules may be called the .Kamataka State CMI Services (Unfilled vacancies.resenred forthe persons belonging to the Sclreduled Castes ard the Scfieduled Tribes) (sctal Recruiilnent) Rules,2@1.

(2) They shall come into force on the date of their publication'in the Otficial Gazette.

2. Ilefinlfions i (1) In thee rules, unless the context othenrise requires ,-

(a) .Appointing Adhody means the. appointing-autho{es as specified in ruJe zr-' or-bbrn- z of S6neOul€s : ll airO ttt ol the Karnataka Givil .Services tcra"sification, control and Appeal) Rules, 1957 and in case, it is not so ipbcified, the head ol the department;

(b) "Qualification' means the minimum qualification fqr recruitnent to any sqryce\-' ;port prescriUea in ttre rules of recruifinent specially made in respect of that seruice o, po"i or in any other rules made or deemed io have been made under ttr" 6"rn"Ai" Sitt" Civil Servjces Act, 1978 (Kamatraka Act 14 of 1e90);

(2) Other words and etpressions used in these rulbs but not defined shall have the same rneaning assigrred to'them in the lGmatraka GMI Services (General Recruitment) Rufes, 1977.

3. Agpr Notwithstanding anything to the contrary contrained in the tGmataka Civil Services (General Recruifninq Rules, 1977, or the rules of r.ecruifrnent specially made for recruitment to'any service or post, the cand'rdates for recruitment to any service or3ost under these rules must have attained the age of eighteen years but not attained the age of fortyyears 4, Release of yaeancles to fill-up the unfllled vacanci€si (1) The Appointing Authorities @ncemd shall re{ease the unfilled vacancies, subiect to their availability, to the Setecting Uu{totrt, lor the purpose of recruitment under these rules.

(2) The Appointing Authorities concemed shall presume the @ncurrence of Finance Depary"m lor tfre purpose of releasing of vacancie$ to fill up as relerred to in sub-rule (1), to the Sdecting Authori$:

5. ilode of Recruitrrent- (1) Notnifrstanding anything to the contrary contained in the lgmataka Civil Services (General Recruitment) Rules, 19'Tl or the rules of recruifrnent specially made lor recruitment to any seMce or post, recruitment under these rules shall be made by the Selecting AuthoritY.

(2) The Selecting Authority shall, for recruirnent to the category oJ nosts.pfened.to in ru;e.4, cauEe to irwite applicaiions,from tte cardidates possessing ttre qualification, by publishing in the fficial Gazette and in more than one widely circulaled regional newspapers, of u,hich, at least, one shall be in Kannada.

6. , provided that if two or more candidates have #cured equal percentage of total marks in the qualifiing examination, the order ol merit in respecf 9! yq candidates shall be fixed on the bisis 6t.tileir age, the one oHer in age being placed highgr in the order of merit.

The number of candidates Io be included in sucfi list of eligible candidates shall be egual to 'the totral number of vacancies notified under these rules.

(2) The inclusion of name of a candklate in the list published under rule 6 shall not confer any right of appointment.

S. Application of offier Rules:- The lGrnataka Civil Services Rules, the lGmataka CMf Services (Probation) Rules, 1977 and such other rules lor the time being in forceregulating the conditions ,of service rnade or deemed to have been made under the .

lGmataka State Civil SeMces Act, 1978 (lQmataka Ast No.14 of 19S)) in so far as they are not inconsi'stent with the provisions of these rules shall be applicable to the ircrsons appointed under these rules.
