NOTIFICATION Whereas the draft of the Karnataka Women and Child Development services (Absorption of Employees of the Border Area Project, Anekal of the Karnataka State Social Welfare Advisory Board in the State Civil Services) Rules, 2022 was published as required by clause (a) of sub-section (2) of section 3 of the Karnataka State civil Services Act, l978 (Karnataka Act l4 of 1990) by exercising the powers conferred by sub-section (l) of Section read with Section 8 of the said Act in Notification No: WCD 1l6 SJD 2019(P-l) dated:02-01- 2023 and in Part IV-A of the Karnataka Gazette Extraordinary dated:06-01-2023 inviting objections and suggestions by all persons likely to be affected thereby within fifteen days from the date of its publication in the Official Gazette.
Whereas the said Gazette was made available to the public on 06th January
2023.
And whereas no objections or suggestions were received by the State Government.
Now, therefore in exercise of the powers conferred by sub-section (l) of Section 3 read with Section 8 of the Karnataka State Civil Services Act, l978 (Karnataka Act l4 of 1990) the Government of Karnataka hereby makes the following rules, namely:- l. Title and commencement:- 1) These rules may be called the Karnataka Women and Child Development Services (Absorption of Employees of the Border Area project Anekal of the Karnataka State Social Welfare Advisory Board in the State Civil Services) Rules, 2022.
2) They shall come into force with effect from the date of their final publication in The official Gazette
2. Definitions:- 1) In these rules, unless the context otherwise requires :- a) "Employee" means an employee working as Balasevika in the Border Area Project, Anekal of the Karnataka State Social Welfare Advisory Board under the Central Government Scheme which was closed on 31-03-2005.
b) "Schedule” means Schedule appended to these rules.
2) Other words and expressions used in these rules, but not defined therein shall have the same meaning as assigned to them in the Karnataka Civil Services (General Recruitment) Rules, 1977.
3) Absorption of Employees of Border Area Project Anekal of the Karnataka State Social Welfare Advisory Board in the State Civil Services:- Not withstanding anything contained in the Karnataka Civil Services (General Recruitment) Rules, 1977 or any other rules made under the provisions of the Karnataka State Civil Services Act, 1978 ( Karnataka Act 14 of 1990), an employee mentioned in column (2) of the Schedule below who were holding the posts mentioned in column (3) thereof in the Border Area Project, Anekal of the Karnataka State Social Welfare Advisory Board shall absorbed in the posts of Karnataka Women and Child Development Department Services, with effect from 01-04-2005 in the corresponding entries as specified in column (4) thereof vide Government Order No. WCD 267 SJD 2005 dated 13-02-2008 read with Head office Directorate of Women and Child Development order No. DWCD/ ICD/ CNP/ 09/ 2004-05/ 2007-08 dated 13-02-2008.
4) Leave and Seniority and Salary of persons absorbed:- The services rendered under the Border Area Project, Anekal of the Karnataka State Social Welfare Advisory Board, by an employee mentioned in column (2) of the Schedule absorbed under these rules, be taken into consideration for determining their leave, seniority and salary from the date of their absorption with effect from 01- 04-2005.
5) Application of other rules:- The provisions of the Karnataka State Civil Services Rules, the Karnataka Civil Services (Conduct) Rules, 1966 and all other rules regulating the conditions of service of Government Servants shall in so far as they are not inconsistent with the provisions of these rules be applicable to the employees absorbed under these rules.
