Section 9: Burden of proof

The Kerala Debt Relief Act, 1977State Act of Kerala · Act 17 of 1977

Notwithstanding anything contained in any law for the time being in force, in any suit or other proceeding, the burden of proving that a debtor is not entitled to protection under the provisions of this Act shall be on the creditor.

10 . Bar of jurisdiction of civil courts.—No civil court shall have jurisdiction to decide or deal with any question or to determine any matter which is, by or under this Act, required to be decided or dealt with, or to be determined by, the Tribunal or the appellate authority.
