GOVERNMENT OF KERALA NOTIFICATION In exercise of the powers conferred by sections 29(1), 30, 30A, 52(1), 53(1), 54(1), 54(B) and 67(1) of the Inland Vessels Act, 1917 (Central Act 1 of 1917), the Government of Kerala hereby make the following rules further to amend the Kerala Inland Vessels Rules, 2010 issued by notification under G.O. (P) No. 5/2010/CSIND, dated 30th April, 2010 and published as S.R.O. No. 424/2010 in the Kerala Gazette Extraordinary No.1055 dated 30th April, 2010, namely:— G.O. (P) No. 1/2021/CSIND.

1. Short title and commencement.—(1) These rules may be called the Kerala Inland Vessels (Amendment) Rules, 2021.
(2) They shall come into force at once.
2. Amendment of the Rules.—In the Kerala Inland Vessels Rules, 2010,—
(1) in rule 33,—
(i) to sub-rule (1), following provisos shall be added, namely:— “Provided that in the case of electrical boat fitted with less than 220 HP and both steering and engine control are mounted at wheel house and both can be controlled by a serang and passenger capacity is below 100, one lascar can be replaced with engine driver who possess both engine driver certificate and lascar certificate issued under these rules:
Provided also that in the case of internal combustion engine boat fitted with less than 150 HP engine and both steering and engine control are mounted at wheel house and both can be controlled by serang, engine power is less and passenger capacity is below 100, one lascar can be replaced with engine driver who possess both engine driver’s certificate or boat driver’s certificate or engineer’s certificate and lascar certificate issued under these rules.”
(ii) In sub-rule (2),—
(a) in clause (i) the word “inboard” shall be omitted and for the figures and words “565 BHP” the figures and words “600 BHP” shall be substituted;
(b) in clause (ii) the word “inboard” shall be omitted and for the figures and letters “226 BHP” the figures and letters “300 BHP” and for the figures and letters “565 BHP” the figures and letters “600 BHP” shall be substituted;
(c) in clause (iii) the word “inboard” shall be omitted and for the figures and letters “113 BHP” the figures and letters “150 BHP” and for the figures and letters “226 BHP” the figures and letters “300 BHP” shall be substituted;
(d) in clause (iv) the word “inboard” shall be omitted and for the figures and letters “113 BHP” the figures and letters “150 BHP” shall be substituted;
(e) in the clause IV, after item (c), following items shall be added, namely:— 2 This is a digitally signed Gazette.
Authenticity may be verified through https://compose.kerala.gov.in/ “(d) in case of both steering and engine control are mounted at wheel house and both can be controlled by serang and passenger capacity is below 100, one lascar can be replaced with engine driver who possess engine driver’s certificate or boat driver’s certificate or engineer’s certificate and lascar certificate issued under these rules.
(e) if passenger capacity is more than 100, then clause (b) and (c) are applicable.”
(iii) sub-rule (3) shall be omitted;
(iv) for sub-rule (4) the following shall be substituted, namely:— “(4) For any vessel with passenger capacity not exceeding 10 in number and length not exceeding 12 m and fitted with inboard or outboard engine of any propulsion and less than 75 hp the owner or any person may navigate the vessel if he possesses a serang-cum-driver certificate.
If passenger exceeds 10 in number, the vessel shall have one Lascar also.”
(v) after sub-rule (5), the following sub-rules shall be added, namely:— “(6) Inboard or outboard engine can be of any means of propulsion i.e., IC engine, electric motor, jet propulsion or hydraulic motor.
(7) All applicants must produce a police verification certificate at the time of submitting application for any of the certificate mentioned in this rule.
(8) For category D vessels crew requirement shall be as follows, namely:—
(i) one row man if the passenger capacity is below 20;
(ii) one helper also required if the passenger capacity is above 20.
(9) For category E vessels crew requirement shall be as follows, namely:—
(a) the operator/serang shall have valid certificate issued from National Institute of Water Sports (NIWS) of Yachting Association of India (YAI) and all power boat/parasail boat/jet Ski/Water scooter operator shall have PBH certificate level 3 issued from National Institute of Water Sports (NIWS) or Yachting Association of India (YAI) with an experience of one year from a registered operator.
(b) an engine driver is required if the engine power is more than 150 hp;
(c) a Lascar is required if the passenger capacity is more than 12.” By order of the Governor, LEEMA MANUEL, Additional Secretary.

The Managing Director, Kochi Metro Rail Limited has submitted a proposal requesting to amend the Inland Vessels Rules, 2010. At present they are operating boats which have very modern features similar to boats operated in Western countries. The manning requirements need to be amended to achieve substantially of operation in organised water metro projects. But the present provisions in Kerala Inland Vessels Rules, 2010 are general in nature and for traditional boats. Hence for limiting the crew to minimum the Government have decided to amend the Inland Vessels Rules, 2010.
The notification is intended to achieve the above object.
