A land· lord (other than a sthani or the trustee or owner of a place of public religious worship) who is not in possession of any land or is in posses sion of land less than five standard acres and who needs the holding for the purpo&e of constructmg a building bona fzde for his own 1 residence or for that of any member of his fam1ly may resume from his tenant-
(i) an extent of land not exceeding 20 cents, where resump· tion is sought on behalf of one person ; and
(zi) an extent of land not exceeding 50 cents, where resump· tion is sought on behalf of two or more persons:
Provided that, by such resumption, the total extent of land in the possession of the landlord shall not be raised above 5 standard acres and the total extent of land in the possession of the tenant shall not be reduced below twenty cents:
Provided further that no landlord shall be entitled to resume under this section any land m the possession of a tenant belonging to the Scheduled Castes or Scheduled Tribes.
Explanatzon.-For the purposes of this section and section 16• "member of h1s family" shall mean,-
(z) in the case of a landlord who has granted a lease on behalf of a joint family, member of such family; and
(u) in any other case, wife or husband, as the case may be, or a lineal descendant of the landlord.
