KERALA MINISTERS, SPEAKER AND DEPUTY SPEAKER TRAVELLING ALLOWANCE AND DAILY ALLOWANCE RULES, 1959 (Rules framed by Government under section 7 of the Act) In exercise of the powers conferred by subsection (1) and (2) of Section 7 of the Payment of Salaries and Allowances Act, 1951 (Act XIV of 1951), the Government of Kerala make the following rules, namely:-
1.(i) These rules may be called "The Kerala Travelling and Daily Allowances of Ministers, Speaker, Deputy Speaker, the Leader of the Opposition and the Chief Whip Rules, 1959".
(ii) They shall be deemed to have come into force on 3171957.
2. 'Day' means a calendar day beginning and ending at midnight.
3. (1) The Ministers, the Speaker, the Deputy Speaker, the Leader of the Opposition and the Chief Whip shall be entitled to claim daily allowance for halts outside headquarters in accordance with the provision of subrule (2):
Provided that in the case of enforced halts enroute while touring on public business necessitated due to blockade of roads or railways on account of floods, rains, landslides or other acts of God, or delayed journeys or cancellation of scheduled motor conveyances, trains or aircrafts, the Ministers, the Speaker, the Deputy Speaker, the Leader of the Opposition and the Chief Whip shall be entitled to draw daily allowance at threefourths of the rate applicable to them at the stations at which the enforced halt takes place for the period of enforced halt excluding the first day of such halt for which no daily allowance shall be allowed.
(2) Daily allowance for halt on tour at an outstation shall be calculated on the basis of the period of halt which shall begin from the time of arrival at the outstation and shall end at the time of departure from that outstation. The rate of daily allowance shall be as follows:—
1. Halt upto six hours Nil
2. Halt exceeding six hours but not exceeding twelve hours Half daily allowance
3. Halt exceeding 12 hours but not exceeding twenty four hours Full daily allowance
4. Halt exceeding twenty four hours. One daily allowance for every 24 hours. For fraction of 24 hours at the end halt. daily allowance will be calculated as indicated above.
Note. Daily allowance for halt under this rules is to be calculated after computing the total number of hours of halt at an outstation, irrespective of the total number of days of halt and whether or not the daily allowance is exchanged for mileage allowance,
(3) If there is halt at more than one station on the same day, the halt at each place may be reckoned separately provided that the sum total of daily allowance admissible for a stay of 24 hours, shall not exceed one daily allowance This applies only if the halts at more than one station begin and terminate within the duration of 24 hours. If the duration of halt at the second station extends beyond 24 hours from the commencement of halt at the first outstation, daily allowance admissible for halt at the second station is to be reckoned separately.
(4) When a Minister, the Speaker, the Deputy Speaker, the Leader of the Opposition, or the Chief Whip, while on tour, visits various outstation on duty over a number of days, the total daily allowance admissible under this rule shall not exceed the total daily allowance calculated on the basis of the total numbers of hours between the time of arrival at the first outstation and the time of departure from the last station of tour.
4. The Speaker, the Deputy Speaker, the Leader of the Opposition and the Chief Whip as in the cases of Ministers shall be entitled to draw T. A. and D. A. while touring on public business.
4A. For the purpose of claiming incidental expenses for air journeys by the Minister, the Speaker, the Deputy Speaker, the Leader of the Opposition and the Chief Whip each journey shall mean journeys from starting point to destination or vice versa.
5. In the case of journeys outside the State, a Minister or the Speaker or the Deputy Speaker or the Leader of the Opposition or the Chief Whip may draw travelling allowance advance subject to the following conditions namely:
(i) the advance shall be limited to 75% of the travelling allowance admissible;
(ii) the advance shall be adjusted in full in the final travelling allowance bill for the month which shall be drawn before the close of the month following the month in which the journey was performed failing which further advances for travelling expenses will not be admissible, and
(iii) the advance will be sanctioned by the concerned Minister or the Speaker or the Deputy Speaker or the Leader of the Opposition or the Chief Whip as the case may be.
