Section 39: Delegation of functions of State Election Commission

Kerala Panchayat Raj ActState Act of Kerala · Act 13 of 1994

The functions of the State Election Commission under this Act or the rules made there under, may subject to such general or special directions, if any, given by the State Election Commission in this behalf be performed also by the Secretary to the State Election Commission:

Provided that the commission shall have power to examine any such decision taken by the Secretary either suo moto or on the basis of any complaint, and take suitable decision thereon.
