Notwithstanding anything contained in the Indian Evidence Act, 1872, when any complaint under this Act is made in writing by any person to the prescribed authority, it may be admitted in evidence and the examination of the complainant shall not be obligatory in any trial by a Judicial Magistrate, if such person cannot be found or is incapable of giving evidence.
